Recommended Action
Staff reco,,m~ends that the Planning Agency recommend to the City
Council approval of Zone Change 81-5 by the adoption of Resolution
No. 1996.

BACKGROUND
In December, 1980, the subject property was annexed into the City
of Tustin subsequent to the adoption of Resolutions No. 80-103,
80-106. A single family dwelling currently occupies the lot, and
is surrounded by multi-family residential units. Abutting on the
rear and northerly side yard is a subdivision of duplex units, all
of which front on Green Valley Drive. Along the southerly side
yard', and fronting on Red Hill, is an apartment complex.
DISCUSSION
It is felt that the applicant's request to rezone the subject
location is both appropriate and viable. The character of the
property (frontage on Red Hill and proximity to other R-3 zones)
definitively lends itself to the flexibility the R-3 zone offers.
Although the R-3 zone in this case is appropriate, a slight
variation to the standard R-3 classification is also in order.
Consideration should be given to the point that it is possible that
the applicant will not develop the property for professional office
as planned. (Reference Variance 81-5 also scheduled for public
hearing this date.)
In the event that the subject property should not be developed for
professional office, staff recommends that as a precaution a
density limit be tied to the R-3 zone. A density level of one
family unit per 2500 square feet is recommended so as to p'rovide a
compatible residential use with that of the neighboring duplexes.

CONCLUSIONS
Staff concludes that:
1. An R-3 zone designation is in conformance with the Tustin Area
General Plan.
2. The character of the subject property is such that the R-3 zone
is appropriate and viable.
Consideration should be given to potential residential uses and
therefore a density level of one unit per 2500 square feet
should be imposed.

RESOLUTION NO. 1996
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, RECOMMENDING TO THE CITY COUNCIL,
REZONING PROPERTY FROM DUPLEX RESIDENTIAL (R-2) TO
MULTI-FAMILY RESIDENTIAL (R-3-2,500) AT 14351
RED HILL AVENUE
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application, Zone Change 81-5, has
been filed by Joe A. Boswell for zone change from Duplex
Residential (R-3) for the property described in Exhibit
"A" attached hereto and incorporated herein by this
reference as though set forth herein in full.
B. That a public hearing was duly called, noticed and
held on said application.
C. That a zone change should be granted for the
following reasons:
1. The Multi-Family Residential District is in
conformance with the Tustin Area General Plan.
2. T~e Multi-Family Residential District provides a
more appropriate zone for development purposes given
the character of the property.
D. A Negative Declaration has been applied for to
conform with the requirements of the California
Environmental Act.
II.
The Planning Agency hereby recommends to the City
Council approval of Zone Change 81-5 from Duplex
Residential District (R-2) to Multifamliy Residential
District (R-3) subject to the following condition:
1. That any multifamily development on the subject
property be limited to one dwelling unit per 2,500
square feet of land area.
PASSED AND ADOPTED at regular meeting of the Planning Agency
held on the 3rd day of August, 1981.
