White, Director of Community Service~__~,,~' ORDINANCE FOR INTRODUCTION RECOMMENDATION To adopt the attached Ordinance amending the Tustin City Code relative to uses permitted in public parks and places. BACKGROUND At the request of co,,,unity groups, the Co,,,unity Services Director and Police Chief have been researching a permit process whereby alcoholic beverages could be allowed at certain community events. Staff has drafted such a procedure which has been approved by the Acting Police Chief, the Community Services Director, and the Interim City Manager. The attached Ordinance was drafted by the City Attorney to interface properly with the proposed permit procedure. The key to this policy change.is the permit procedure, which will be handled administratively. There are three checkpoints in the process: each permit must be approved by the Community Services Director, the Police Chief, and the City Manager. A draft is attached for Council's information. Staff is confident that the process will be successful; other cities have utilized a similar process with good results. FISCAL IMPACT The fiscal impact will be minimal; each applicant must post a cleaning and damage deposit. There may be a very slight increase in revenues, as there will be a small fee for permits. The City Council of the City of Tustin, California, does hereby ordains that the Tustin City Code be amended as follows hereinafter: 1. Section 6310 is hereby amended to read as follows: 6310. DRINKING IN PUBLIC It shall be unlawful for any person to drink any alcoholic beverage on any street, alley, highway, court, park, railway depot, city center, city-owned property, public place or square or in any automobile in any public place in the City, provided, however, that alcoholic beverages may be sold, possessed and/or consumed in accordance with written permits issued for special events by the Director of Community Services pursuant to established procedures and policies of the Community Services Department and upon approval of the City Manager and Chief of Police. 2. Section 7112 is hereby amended to read as follows: 7112. PROHIBITED ACTIVITIES IN PARKS The following activities, sports and uses are hereby prohibited at any park or-playground: (a) Sale, possession or use of fireworks. (b) 'Sale, possession or use of narcotics. (c) Sale, possession or use of alcoholic beverages except upon written permit duly issued by the Director of Community Services as provided in Section 6310. (d) Gambling. (e) Sale, possession or use of firearms or weapons of any kind, including, but not limited to, air rifles, slings, knives or clubs. (f) Littering, defacing or damaging of property. Application: Application for alcohol use permits on public parks shall be made to the COllU,unity Services office, in writing, signed by the applicant if an individual, or by a duly authorized agent thereof, if a club, organization, or non-profit corporation, and shall contain the following statements and information: 1. The name and address of the applicant in the case of an individual; in the case of a club, organization, or corporation, the names and addresses of the officers and directors of the club, organization, or corporation; 2. The name of the facility the applicant seeks to occupy; 3. The date and hours of the occupancy; 4. The type of function planned for said hours and date; 5. The number of persons expected to attend such function; 6. The type of food and beverages expected to be served at such function. Said application must be made.at the time the rental application is made. B. Restriction on Permits: 1. Permits are available to resident groups or persons only, for community, neighborhood, or family activities. 2. Permits shall be issued to persons who are of good character and reputation in the community. C. Requirements: In addition to the following all public facility general rules and regulations, the following requirements shall be met and shall be the responsibility of each person securing an alcoholic use permit: 1. A cleaning and damage deposit in an amount determined by the Community Services Director shall be deposited with the City. 2. Proof of an alcoholic beverage control license shall be provided if alcohol is to be sold during the scheduled activity. ALCOHOLIC BEVERAGE CONTROL LICENSE Obtained at 28 Civic Center Plaza, Santa Ana (4th and Flower) (714) 558-4101 MUST BE FILED BY PATRON BEFORE RESERVATION CAN BE FINALIZED IN CONNECTION WITH USE OF FACILITY 3. Alcohol Use Permit must be in the possession of the applicant throughout the activity. 4. Security may be required at events where alcoholic beverages will be served. These services will be provided at the expense of the facility applicant. The Tustin Police Department must be contacted if security is required. (See "Security" below.) D. Prohibited Activities: The following activities are hereby prohibited in connection with the issuance of any alcoholic use permit: 1. No alcohol or alcoholic beverages shall be served to minors. 2. All minors must be accompanied by a parent, adult, relative, or legal guardian. 3. No leftover food or b~verages shall be allowed to remain on the premises. 4. For safety reasons, glass containers are prohibited on public parks. E~ Security: 1. As determined desirable by the City of Tustin, Tustin Police officers may be required for security purposes. Said Police officers shall then be under the complete direction and control of the Tustin Police Department. Such users must make their own arrangements with the Police Department. 2. The use of any facility will NOT be granted to any organization which is deemed detrimental to the public welfare by the Tustin Police Department. Use agreements will be continued only with organizations or persons who demonstrate responsibility. F. Approval of Application: 1. Facility-use agreements and alcohol permits are issued in accordance with approved Council policy. Reservation applications must be signed and returned along with required deposits before consideration of use approval. Applications and subsequent deposits must be handled in person; we are unable to reserve a date for you by telephone. SUBMISSION OF REQUEST DOES NOT CONSTITUTE APPROVAL. Applications will be subject to the approval of the City Manager, or his designated representative. Applications will be reviewed by the Community Services Director and the Police Chief -- prior to submission to the Manager's office -- to determine the application's impact on the health, safety, and general welfare of the citizens and the City.
