CITY COUNCIL, OF THE CITY OF
TUSTIN, HELD IN THE CITY HALL
OF TUSTIN, ON MONDAY EVENING,
OCTOBER 3, 1949, AT 8:00 P.M.
PRESENT WERE: COUNCILMEN HUMESTON, GRAY, MILLER AND BACON.
ABSENT WERE: COUNCILMAN CHARLETON.
CITY ATTORNEY' C. ARTHUR NISSON_ JR. WAS PRESENT.
Mayor Humeston called the meeting to order immedi-
ately after the meeting of the Tustin Planning Com-
mission was adjurned.
Minutes of the preceeding meeting were read and ap-
proved after correction was made in Paragraph 2 in
which it was stated that "CounciIman Miller moved
to accept the Taxicab Franchise application of Mr.
Arnold J. Posade." This sentence was corrected to
read that "Councilman Miller moved to receive the
application for a Taxicab Franchise of Mr. Posade."
REGARDING After discussion by the Council the request of Mr.
HOUSING OF William Nelson, Principal of the Elementary School
SCHOOL BUS District, regarding the difficulty in housing the
school bus, was referred to Street Superintendent
McMullen who was instructed to contact City En-
gineer McBride and together work out a solution.
RESOLUTION The matter of public hearing on the closing of
NO 233 Third Street, between B and-C Streets, and abandon-
ADOPTED ment of same as a thoroughfare was brought up by
CLOSING City Attorney Nisson and Mrs. Don Squires who was
THIRD ST. present, representing the Parent-Teachers Associa-
tion, stated that her organization was in favor of
closing the street and as there was no one present
to oppose the action Councilman Miller moved to
adopt Resolution No. 233 covering the action of
abandonment of the street. Seconded by Councilman
Gray the motion unanimously carried.
City Attorney Nisson was then directed to record a
certified copy of Resolution No. 233 in the County
Recorders office.
REQUEST Mrs. Don Squires requested of the Council that on
GRANTED FOR October 28, 1949, between the hours of 3 to 8 P. M.,
CLOSING OF the roping off of B Street, between First and Main
B STREET ON Streets, as a protective measure relative to the
EVENING OF Annual Carnival of the Elementary Schools to be held
OCT. 28, 1949 on the school grounds. Permission was then granted
on motion of Councilman Miller, seconded by Council-
man Gray and duly carried.
Mrs. Clark Shaw, who operates a taxicab business in
Santa Ana, was present to ascertain whether or not
the City of Tustin intends to grant a Taxicab Fran-
chise to Mr. Arnold J. Posade and spoke at length on
the subject. Mr. Posade was informed by City Attorney
Nisson of the procedure necessary for the granting
of the Franchise. Councilman Gray then moved and was
seconded by Councilman Bacon that no action be taken
at this time and that the request for the granting of
a Franchise be deferred for further study by the
Council. Motion carried.
REGARDING Mr. Spencer Browning, representing the Travelers In-
GROUP surance Co., and Mr. Lauren Griset, of the Aetna In-
INSURANCE surance Co., were present and verbally outlined their

AND FIREMEN Firemen. After discussion the Council decided to take
no immediate action on the Insurance Plan but to wait
until complete plans covering this group insurance
are presented.

ORDINANCE On motion of Councilman Miller, seconded by Councilman
N0. 77 Bacon and duly carried, the second reading of Ordinance
ADOPTED No. 77, "Regulating the erection, construction, etc. of
buildings within the City of Tustin," was read by title
only. Councilman Bacon then moved, seconded by Council-
man Miller that Ordinance No. 77 be adopted. Motion
carried.
ORDINANCE Ordinance No. 78, "Providing for the appointment of a
NO. 78 Plumbing Inspector, etc., for the City of Tustin" was
ADOPTED then presented and on motion of Councilman Bacon, sec-
ended by Councilman Miller and duly carried, was read
by title only. On motion of Councilman Miller, seconded
by Councilman Bacon and duly carried Ordinance No. 78
was adopted.
OILING OF Street Superintendent McMullen reported on the pro-
F STREET posed oiling of F Street from Third to Main Streets,
AND OF and the oiling of Third Street, from Prospect to F
THIRD ST Streets. He stated that the City of Tustin will do the
oil mixing and that the County will apply the same.
He also stated that it was agreed between Street Super-
intendent McMullen, City Engineer McBride and Assistant
County Engineer Seeley that the County will bill the
City for the oil and that the City will bill the County
for the grader work involved. A Minute Order was
granted Street Superintendent McMullen and City En-
gineer McBride to carry on through with the County on
this work.
A Minute Order was then granted to City Clerk Morris
for permission to remove the Water Box across the
street from the Fire Hall.
McMULLEN Councilman Bacon presented a request of Police Chief
AUTHORIZED McMullen for permission to attend the meeting of the

MEETING IN 5th and 6th. The Council requested Police Commissioner
SACRAMENTO Bacon to arrange the details at a cost to the City of
not more than $40.00. Councilman Miller moved, seconded
by Councilman Gray that the request of Police Chief
McMullen be authorized. Motion carried.
BILLS The following bills were presented, approved and or-
dered paid on motion of Councilman Gray, seconded by
Councilman Miller and duly carried, with the exception
of a bill from theTustin News for the printing of the
1949-50 Tax Bills. This bill was ordered held over un-
til the next Council Meeting.

Motion to adjourn the meeting until 7.30 P. M. on Wed-
nesday, October 5th, was then made by Councilman Miller,
seconded by'Councilman Bacon and duly carried·
