HomeMy WebLinkAboutPH USE PERMIT 81-24 07-20-81DATE: TO: FROM: SUBJECT: July 20, 1981 Inter-Corn 7:30 p.m. Public Hearing Honorable Chairman and Planning Agency Members Community Development Department Use Permit 81-24 RECOMMENDED ACTION: Staff recommends approval of Use Permit 81-24, by the adoption of Resolution No. 1991. Applicant: Six Star Cablevision Location: 1302 Service Road BACKGROUND A request to authorize the installation of a 60-foot antenna structure (with attached 6-foot microwave antenna). Three seven-meter TVRO earth station disks, and a 10 x 20 foot equipment building are included. The site is zoned Planned Industrial District (PM). The site is currently vacant land, used for storage of broken concrete pipe. DISCUSSION: In the Planned Industrial District, a Use Permit is required where a radio tower will exceed the permitted height limit. In the PM district, the permitted height is 50 feet, and Six Star is requesting a 60-foot antenna, ten feet above the permitted height. Surrounding land uses include: to the east are tennis courts, to the west approximately 100 feet are apartments, to the north approximately 270 feet are single family homes, and industrial users to the south. The single family homes are buffered by the tennis courts and the apartment carports. Residents most directly affected will be the apartments to the west, where several second story balconies face the vacant lot. The tennis courts are surrounded by a twelve foot chain link fence, and screening the northern tennis courts will further buffer the site from the single family homes. Use Permit 81-24 July 20, 1981 Page Two The applicant is proposing three towers in the form of a triangle, connected together for stability. Staff recommends that Six Star reduce this to one single pole, and if required, utilize tie guys for stability. The proposed use of barbed wire as a security measure can be a liability to Six Star, Tustin Unified, and the City of Tustin. Staff recommends that barbed wire not be used unless evidence is represented by Six Star that they are suffering substantial damage by vandalism, or that the danger within the site is greater than the potential danger of climbing over the barbed wire. CONCLUSIONS 1. The proposal is in substantive conformance with existing and proposed requirements of the PM District. 2. Although the antenna will have a visual impact on the area, proposed conditions in the use permit will help reduce the visual effect to a minimum. 3. The area is not exclusively residential in nature, but has a mixed use of industrial to the south and residential to the north and west. If buffered, it is felt that the proposed receiving station would not have a negative effect on the area. Agency of the City of Tustin does hereby resolve as I. The Planning Agency finds and determines as follows: A. That a proper application, (Use Permit No.81-24), has been filed on behalf of Six Star Nielson Cableviston Association, to authorize the construction of a single 60-foot antenna located in the Planned Industrial District (PM). B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1~ The proposed project is in substantial conformance with requirements of the Planned Industrial District. 2. The project is in conformance with the Tustin Area General Plan. O. That the establishment, maintenance, and operation of the use applied for will not be injurious or detri- mental to the property and improvements in the neighbor- hood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uni- form Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. F. This project is categorically exempt from the requirements of the California Environmental Quality Act. G. The Planning Agency hereby adopts Conditional Use Permit No.81-24, to authorize the construction of a single 60-foot antenna for Cable Television Services located at 1302 Service Road, subject to the following conditions: A. The final site plan shall be standardized and reflect all appropriate City standard drawing numbers. The developer shall construct all missing or damaged street improvements to said development per the City of Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards". This work shall consist of, but is not limited to: curbs and gutters, sidewalks, drive apron, and street pavement. B. The eight-foot chain link fence shall be combined with redwood battens. C. Barbed wire shall not be permitted unless documented evidence is presented to the Community Development Director that substantial damage is occurring or the danger within the site is greater than the potential danger of the barbed wire. D. Any agreement between the Tustin Unified School District and Six Star Neilson Cablevision shall conform with the requirements of the State Subdivision Map Act.
