There is presently $50,000 budgeted in the 1980-81 budget whid~ will be carried over in the 1981-82 fiscal year. The Engineer's estimate for construction is $49,200.00. RECOMMENDATION: That the Tustin City Co~cil, at their meeting of July 20, 1981, adopt the attached resolution approving said plans and specifications and directing the City Clerk to advertise for bids. Yd. 12 DESCRIPTION Remove existing AC and/or PCC Sidewalk and Construct 5 1/2" Thick PCC Sidewalk Select Material Backfill A-1 1 2 3 4! 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 The foregoing quantities are approximate only, being given as a basis for the comparison of bids, and the City of Tustin does not, expressly or by implication, agree that the actual amount of work will correspond therewith, but reserves the right to increase or decrease the amount of any class or portion of the work or to emit portions of the work as may be deemed necessary or advisable by the Engineer. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, 92680, upon payment of $10.00 per set, which a~ount shall be non-refundable. Plans and specifications will be mailed out upon payment of $15.00 per set, which amount shall be non-refundable. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by one of the following forms of bidder's security: a. Cash b. Cashier's check made payable to the City of Tustin. c. Certified check made payable to the City of Tustin. d. Bidder's bond executed by an accredited surety insurer, made payable to the City of Tustin. The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Security Bond ~or payment of labor and materials will be required in the amount of fifty percent (50%) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued by a Surety Company rated grade A or better and Class IX or better by the latest edition of Best's Key Rating Guide. City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The contract will be awarded to the lowest qualified bidder. Provisions of the State Contract Act are not applicable, and prospective bidders will not be required to be prequalified. Ail work to be paid for at the unit prices bid frc~ appropriated monies. 28 A-2 2 The City Council of the City of Tustin has obtained frcm the Director of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which the work is to be performed for ead~ craft or type of work needed and a copy of the s~me is on file in the office of the City Clerk. Not less than said prevailing rates shall be paid to workers employed on this public works contract as required by Labor Code Sections 1771 and 1774 of the State of California.
