~TION:
That the Tustin City Council, at their meeting of July 20, 1981, pass and adopt
Resolution No. 81-81 (revised), which amends a previously adopted Resolution No.
81-14, to amend Exhibit "C" attached thereto.
On July 6, 1981, Council adopted Resolution No. 81-81, which amended Exhibit "C" of
Resolution No. 81-14 by adding three additional properties to the required service
conversion list for the subject utility underground project. In addition to the
amendment of Exhibit "C", a public hearing date was set for July 20, 1981 at 7:30 PM
to allow any of the three additional property owners to object to the service
conversion project.
Resolution No. 81-81 was not made available to the Tustin News early enough to allow
the required time span for legal publication. As a result of this delay, the hearing
.would have to be delayed until August 17, 1981 at 7:30 PM.; however, during the past
week the three affected property owners were contacted by staff and have agreed by
petition to waive the hearing of objections and have also declared that they do not
have any objections to the proposed work, the extent of the district to be assessed
or any other objections.
Section 5132 of the Streets and Highways Code provides that the hearing of objections
shall not be required when such petitions have been signed and filed.
