BACKGROUND AND DISCUSSION
A Use Permit to request authorization to convert a 6,000 square
foot commercial center to four office/retail condominiums. The
subject property is zoned C-1.
The subject project was reviewed by staff as a retail commercial
structure, and is nearly completed. The site has thirty spaces,
which is enough for either retail or office uses.
Staff recommends approval of Use Permit 81-21, with the comments in
the draft resolution as conditions of approval.
RECOMMENDED ACTION
Staff recommends approval of Use Permit 81-21, by the adoption of
Resolution No. 1984.

A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, AUTHORIZING THE CONVERSION
OF A 6,000 SQUARE FOOT COMMERCIAL CENTER TO
A RETAIL OFFICE CONDOMINIUM AT 14722 NEWPORT
AVENUE
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application,(Use Permit No.81-21), has
been filed by T.H. Forhan on behalf of Mangano and Sons,
Inc., to authorize the conversion of a 6,000 square foot
commercial center to office/retail condominiums.

B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance, and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort, or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
1. The p~oposed use is in conformance with the
requirements of Zoning Ordinance No. 157, as amended.
2. The proposed use conforms to the Tustin Area General
Plan.

D. That the establishment, maintenance, and operation
of the use applied for will not be injurious or detri-
mental to the property and improvements in the neighbor-
hood of the subject property, nor to the general welfare
of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uni-
form Building Codes as administered by the Building
Official, Fire Code as administered by the Orange County
Fire Marshal and street improvement requirements as
administered by the City Engineer.

F. This project is categorically exempt from the
requirements of the California Environmental Quality
Act.

G. Final development plans shall require the review and
approval of the Community Development Department.

II.
The Planning Agency hereby adopts Conditional Use Permit
No.81-21, to authorize the conversion of a 6,000 square
foot con~nercial center to a retail/office condominium at
14722 Newport Avenue subject to the following
conditions:

The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street
improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street
Improvement Standards". This work shall consist of,
but is not limited to: curbs and gutters, sidewalks,
drive apron, and street pavement.
B. Party walls between units shall be for a one hour fire
rated construction.
C. The site shall develop a master sign plan per Ordinance
No. 684.

Installation of street lights shall be required along
both Newport Avenue and Sycamore Avenue. Annexation
to the Tustin Lighting District shall be required.
Submission of CC&R's to the City Attorney shall be
required for review and approval, which shall include
blanket easements for all.required utilities.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency, held on the sixth day of July, 1981.
