OATE: TO: FROM: SUBJECT: July 6, 1981 OLD BUSINESS NO. 3 Inter-Corn Honorable Chairman and Planning Agency Members Community Development Department Use Permit 81-17 Applicant: Location: Auto Mate Leasing, Eugene and'Rita Tutt 14042 Red Hill Avenue RECOMMENDATION: Use Permit 81-17 is recommended for indefinite continuatio~ or tabling. The associated Zone Change 81-2 (Ordinance No. 846) has been approved by City Council, however, the applicant (Mr. Tutt) in writing has indicated his intent not to comply with conditions of approval. Such would render any action on the use permit moot since the zoning must be valid in order to permit such action. DISCUSSION: Mr. Cooper, operator of Auto Mate has indicated his desire to continue operation in conformance with conditions of C-1 zoning provisions. He would refrain from any vehicle display or storage of vehicles. The only vehicles on-site would be owner/employees and vehicles pre-sold or pre-leased. The delivery of vehicles to clients at the site during normal operating hours would not constitute storage or display. He recognized that display in setback, landscaped areas; parking of speculative unsold or unleased vehicles; or on street parking of vehicles would be cause for legal action by the City under C-1 zoning provisions. Staff would further recommend continued operation under the parameters indicated with any violation pursued through proper legal enforcement procedures. EMK/dat
