Acquisition of Land, E1Modena-Irvine Channel
The Orange County Flood Control District is proposing to acquire a
parcel of land (1/2 acre) from the Atchison, Topeka and the Santa
Fe Railroad to facilitate access for maintenance purposes to the E1
Modena-Irvine Channel and the La Colina-Red Hill Channel.
In accordance with Section 65402 of the Government Code, the
Planning Commission should report to the Flood Control District as
to the conformity of the proposed acquisition with the Tustin Area
General Plan.
RECOMMENDED ACTION
Adopt Resolution No. 1989 which finds the acquisition in
conformance with the Tustin Area General Plan.

Dear Mr. Brotemarkle:
The Orange County Flood Control District proposes to acquire a parcel of land
approximately 0.5 acres in area from the Atchison, Topeka and Santa Fe Railroad
to facilitate access to the E1 Modena-Irvine Channel and the La Colina-Redhill
Channel and to provide more work space for the maintenance of these channels.
Said parcel is indicated as Parcel Number 308 and is outlined in red on the
enclosed map.
The subject property is partly in the City of Tustin and partly in the unincor-
porated territory of the County of Orange, adjacent to and northeasterly of
the E1 Modena-Irvine Channel opposite the cul-de-sac's at Woodland Drive and
Cromwell Drive.
In accordance with Section 65402 of the Governmemt Code of the State of California,
this is to request a report by your Planning Commission as to conformity of the
proposed acquisition of Parcel No. F07-308 with the general plan of the City
of Tustin. The enclosed sample resolution may be of assistance.
A Negative Declaration for this project was publicly posted and became official
on June 10, 1981. A copy is enclosed for your information.
It is requested that one date-stamped copy of your Planning Commission findings
be returned for our files. Please route the copy to the attention of Earl Hardacre,
Design A, Right-of-Way Engineering of the Right-of-Way Engineering Section.

RESOLUTION NO. 1989
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN FINDING THAT THE ACQUISITION
OF 0.5 ACRE FOR MAINTENANCE PURPOSES FOR THE
EL MODENA-IRVINE CHANNEL IS IN CONFORMANCE WITH
THE TUSTIN AREA GENERAL PLAN. THE PLANNING
AGENCY OF THE CITY OF TUSTIN HEREBY RESOLVES
AS FOLLOWS:
WHEREAS, the Orange County Flood Control District proposes to
acquire, from the Atchison, Topeka and Santa Fe Railroad, a parcel
of land partly in the City of Tustin, and partly in the
unincorporated territory of the County of Orange, adjacent to and
northeasterly of the E1Modena-Irvine Channel opposite the
cul-de-sac's at Woodland Drive and Cromwell Drive; and
WHEREAS, the Government Code of the State of California,
Section 65402, provides in part that a local agency such as the
flood control district shall not acquire real property nor dispose
of any real property, nor construct a public building or structure
in any county or city, until the location, purpose and extent of
such activity has been reported upon as to conformity with the
adopted general plan applicable thereto; and
WHEREAS, the proposed acquisition of the Atchison, Topeka and
Santa Fe Railroad property, by the Orange County Flood Control
District, has been reviewed by the City of Tustin Planning
Agency in accordance with Section 65402 of the California
Government Code.
NOW, THEREFORE, BE IT RESOLVED, that the Tustin Planning
Agency does hereby find that the acquisition of property, by
the Orange County Flood Control District, is in conformance
with the city's adopted general plan as to that portion of the
parcel located within the City of Tustin.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency held on the 6th day of July, 1981.
