MINUTES OF THE MEETING OF THE
CITY COUNCIL, OF THE CITY OF
TUSTIN, HELD IN THE CITY HALL
OF TUSTIN, ON MONDAY EVENING,
MAY 16, 1949, AT 7:30 P.M.
PRESENT WERE: COUNCILMEN HUMESTON, MILLER, CHARLETON, GRAY AND BACON.
ABSENT WERE: NONE
CITY ATTORNEY C. ARTHUR NISSON JR. WAS PRESENT.
Mayor Humeston Called the meeting to order at 7:30 P. M.
Minutes of the proceeding meeting were read and approved
with the exception of Paragraph 4 relating to the "Reso-
lution of Intention to Grant Electric Franchise No. 222"
relative to the Southern California Edison Co., which
was rewritten by City Attorney Nisson for insertion into
the minutes of the meeting of May 2nd, 1949.
Police Chief McMullen read a report of his notification
to Herman E. Fitzgerald, at his place of business at
Mt. View and First Streets, Tustin, in regard to the
abatement of unsatisfactory conditions existing there
relative to the burning of trash, noise and violation of
City Ordinance No. 71.
Deputy City Clerk Pennington read a statement signed by
Herman E. and E. L. Fitzgerald in which they promised
to Cooperate with the Police in the abatement of noise
and loitering in and around their place of business.
RASMUSSEN Mayor Humeston read a letter from Harold Rasmussen,
RESIGNS AS Santa Ana Building Inspector, in which he stated that
BUILDING due to press of business he desired to terminate his
INSPECTOR Inspection Service for the City of Tustin not later
than June 15, I949.
Councilman Miller reported that he had endeavored to
contact Mr. Guy Bolyard regarding acceptance of the
position of Tustin Building Inspector but had been
unable to do so due to Mr. Bolyard's physical condi-
tion and he stated that it would probably be three or
four months before Mr. Bolyard is on his feet again.
City Clerk Morris suggested Ray Pierson, of Tustin,
as a possibility for the temporary position as Tustin
Building Inspector.
Councilman Gray mentioned George Broomell as a possi-
bility for the position and suggested that Councilman
Miller talk with him. Councilman Gray moved that
Comcilman Miller be instructed to interview Mr.
Broomell and if In his mind he was satisfied with
the interview to appoint him as Building Inspector.
Seconded by Councilman Charleton the motion was duly
carried.
Police Chief McMullen reported on a communication
from the Orange County Automobile Club regarding the
accident to the Police Car last December which re-
quired over Four hundred Dollars ($400.00) worth of
repairs. The Club stated that their Mr. Thompson was
endeavoring to collect the full amount of damages,
including the $100.00 deductible item, to prevent
the City from having to pay the $100.00 deductible.
Councilman Miller stated that he had not been handed
the proper book to study regarding the Building Code
Report as requested by the Comcil at the previous
meeting. Mayor Hmeston suggested that Councilman
Miller continue his study of the subject and report
at the next Council Meeting.
Councilman Gray read a letter from the Golden West Citrus
Association requesting fire protection through the Tustin
Fire Department in the future. After.discussion of the
matter Councilman Gray moved that City Attorney Nisson
present them the same type of letter as was sent to the
Tustin Hills Association informing them of the City's
Policy in this respect. Councilman Charleton seconded
the motion which was duly carried.
POPPY DAYS Mayor Humeston read his Proclamation designating Thurs-
PROCLAMATION day, Friday and Saturday, May 26, 27 and 28, as Poppy
Days and directed that a copy of same be delivered to
The Tustin News for publication.
Police Chief McMullen verbally outlined a new Split
Shift Work Schedule for the Police Department.
LEAK IN Councilman Charleton reported that Don Grizet had
PIPE LINE telephoned to him and stated that only a portion of
AT MAIN the S. A. V. I. water users were responsible for the
& A STS. dangerous leak in the pipe line across Main Street at
the intersection of A Street and requested that City
Attorney Nisson write a letter to the Water Company
Stating that the water suppIy would be cut off from
those users only. Attorney Nisson stated that he had
not yet written the letter as he had been requested
to do at the previous meeting and after discussion of
the matter the Council directed Attorney Nisson to
write a letter as formerly instructed and to further
state that the Council would not be able to decide as
to just which users of the water caused the leak.
Councilman Gray moved that Ordinance No. 75 be read
a second time by title only, which was done by Attorney
Nisson. Seconded by Councilman Bacon the motion was
carried.
ORDINANCE Councilman Gray moved to adopt Ordinance No. 75,
NO. 75 seconded by Councilman Miller the motion was duly
ADOPTED carried.
Ordinance No. 75 was then ordered to be published
once in The Tustin News. Fifty copies of The News
were to be delivered to the City Hall containing this
publication of the Ordinance, also one Galley Proof.
City Attorney Nisson stated that he had redrafted a
Resolution repealing Resolution No. 221, to be known
as Resolution No. 223. Councilman Miller moved that
Resolution No. 223 be adopted. Seconded by Councilman
Charleton the motion unanimously carried.
POWER PoliCe Chief McMullen announced the sale of the City's
SWEEPER Portable Power Sweeper to Mr. R. L. Dickinson, of La
SOLD Vida Springs, for the sum of Two hundred Dollars
($200.00), which was approved by the Council.
Councilman Miller submitted a Sketch Plan of the pro-
posed new City Hall and Fire Station which was dis-
cussed by the Council. Councilman. Miller agreed to
have improved Plans and Specifications ready for pre-
sentation to the Council at the next meeting.
BILLS The following bills were presented. On motion of
Councilman Charleton, seconded by Councilman Bacon
they were approved and ordered paid. Motion carried.

Councilman Gray suggested that the next Council Meet-
ing to be held on June 6, 1949, be called to order at
6:30 P.M. one hour earlier than the usual time.
Councilman Charleton moved to adjurn. Councilman Bacon
seconded the motion. Motion carried.
