BACKGROUND
On November 19, 1979, the Planning Agency by the adoption of
Resolution 1856, granted a use permit authorizing the
construction of two canopies over existing gas pumps. Two of the
conditions contained in that Resolution were:
1. The removal of a billboard sign on the property; and
2. The removal of the rotor device in the pole sign located on the
northwesterly.corner of First and Prospect.
The above conditions were imposed to accommodate Ordinance 684,
Article VI, Section 3 and Article IV, Section SE. The
applicant did not pursue the project and the use permit has
since expired. The billboard, however, has been removed.
In an action on August 18, 1980, the City Council granted a sign
code exception to the operator of the service station. Again as a
condition, the rotor device in the pole sign was to be removed. To
date, this condition has not been met.
DISCUSSION
The application for Use Permit 81-20 is a request for authorization
to allow the construction of a small snack shop, an accompanying
storage area, and a mechanism to facilitate a pre-pay/self-service
gasoline purchase system, for the station located at 171 East First
Street. The subject property is zoned commercial general (CG) and
the requested use is allowed subject to a use permit.
While staff has no problem in recommending approval of this
project, it feels that now would be an appropriate time to ensure
that the non-conforming rotor device be removed from the pole sign.

RECOMMENDED ACTION
Staff recommends that the Agency approve Use Permit 81-20 by the
adoption of Resolution No. 1982 as drafted.

RESOLUTION NO. 1982
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, APPROVING USE PERMIT 81-20,
AUTHORIZING THE CONSTRUCTION OF A SNACK SHOP/
SELF SERVE OPERATION INSIDE THE SERVICE STATION
LOCATED AT 171 EAST FIRST STREET
Agency of the City of Tustin does hereby resolve as
I. The Planning Agency finds and determines as follows:
A. That a proper application,(Use Permit No.81-20), has
been filed on behalf of Mobil Oil Corporation, to
authorize the construction of a snack shop/self-serve
operation at the service station located at 171 East
First Street.
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance, and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort, or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
That the subject use is in conformance with the
Tustin General Plan, and the City of Tustin
Zoning Ordinance.
D. That the establishment, maintenance, and operation
of the use applied for will not be injurious or detri-
mental to the property and improvements in the neighbor-
hood of the subject property, nor to the general welfare
of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uni-
form Building Codes as administered by the Building
Official, Fire Codes as administered by the Orange
County Fire Marshal, and street improvement requirements
as administered by the City Engineer.
F. This project is categorically exempt from the
requirements of the California Environmental Quality
Act.
G. Final development plans shall require the review and
approval of the Community Development Department.

II. The Planning Agency hereby adopts Conditional
Use Permit No. 81-20, to authorize the construction of a
snack shop/self-serve operation at 171 East First Street
subject to the following conditions:

The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street
improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street
Improvement Standards". This work shall consist of,
but is not limited to: curbs and gutters, sidewalks,
drive apron, and street pavement.
Street lights may be required. Applicant shall submit 3
copies of the site plan to Southern California Edison
Company (Dave Peterson) 1241S. Grand, Santa Ana for the
required layout.
In the event the existing facility does not have
underground electrical and telephone services, all
existing overhead faciliies shall be converted to
underground.
A trash enclosure shall be provided to replace the one
displaced by construction.
No outside storage of any kind will be permitted.
Prior to the issuance of a building permit, project
approval from the Orange County Health Department
shall be obtained.
Prior to the issuance of any sign permits, the following
provisions shall be met:
1. All signs shall comply with Sign Ordinance 684.
2. The rotor device in the pole sign located on the
northwest corner of Prospect and First shall be
removed.

3. A complete sign plan for the site shall be submitted
to the Community Development Department for review
and approval. The plan shall include the location
colors, copy, dimensions and type of construction of
all signs.
4. Any signs that overhang into the public right-of-way
shall comply with Ordinance 684, Section 3C.
PASSED AND ADOPTED at a regular meeting of the Planning Agency of
the City of Tustin held on the 15th day of June, 1981.
