Jamieson Location: 615 E. First Street BACKGROUND & DISCUSSION An application has been submitted on behalf of Far West Savings and Loan Association to change the zoning of the firm's First Street property from the present Retail Commecial District (C-1) to a Planned Community - Commercial District (PC-COMM). Previous actions within the zone change area include: Zone Change 68-180 established the C-1 District on the property as well as others in the First Street area. This request is made primarily so that the 35' height limit property designated by the C-1 District may be exceeded by a use permit through provisions of the PC District. The applicant has not submitted any development standards with this request and as a result the development of this property will need to be by approval of a precise plan use permit (Section 9244e2.c). Staff has reviewed a preliminary plan for the development of the property for office use. The proposed use and development design are not a part of this hearing however, and should not be considered by the Agency in making their determination. The Planned Community - Commercial District would be in conformance with the Tustin Area General Plan and the zone change is categorically exempt from environmental considerations (Class 5). RECOMMENDED ACTION It is recommended that the Planning Agency recommend approval of Zone Change Application 81-3 to the City Council by the adoption of Resolution No. 1979, with the applicants understanding that such a recommendation does not infer approval of any subsequent use permit applications. ...... FIRST (230'+ EAST OF FASHION LANE, NORTH SIDE OF FIRST STREET). The Planning Agency of the City of Tusttn does hereby resolve as follows: I. The Planning Agency finds and determines: That a proper application (Zone Change 81-3) has been filed by John W. Jamieson on behalf of Far West Savings and Loan Association, for a zone change from the Retail Commercial (C-1) District to the Planned Community-Commercial District of the property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. B. That a public hearing was duly called, noticed and held on said application; C. That a zone change should be granted for the following reasons: 1. The zone is in conformance with the Land Use Element of the Tustin Area General Plan. That the Planned Community District allows greater flexibility for mixed uses through the use permit process. De Development of subject property shall be in accordance with the policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal, and street improvement requirements as administered by the City Engineer. E. Final development plans shall require the review and approval of the Community Development Director. F. That the zone change is a Class 5 categorical exemption from the California Environmental Quality Act. II. The Planning Agency hereby recommends to the City Council approval of Zone Change 81-3 from the Retail Commercial District to the Planned Community Commercial District, subject to the following conditions: 3 4 5 7 8 9 ~.§~ ~? ~4 £§ ~7 Reso]ution No. 1979 Page Two A.
