BACKGROUND AND DISCUSSION
At the May 4, 1981 meeting the Planning Agency tabled this matter
until the Planned Development (PD) standards were reviewed by the
Agency with changes in mind for the condominium standards.
On June 1, 1981 the Tustin City Council introduced Ordinance No.
851 which added the following provision to the existing 50% open
space requirement~
"The Planning Agency may authorize credit for permanent open
space adjoining a porposed project upon a finding that there
are amenities of design incorporated into the project and the
surrounding area achieves the intent and purpose of the
planned development district by providng an evironment of
openness. A waiver of open space requirements exceeding 5%
shall require the filing and approval of a variance
application."
The developers of the subject proposal would like their project
considered by the Agency with the above provisions. Staff believes
this is acceptable with the understanding that any approval by the
Agency is only effective upon enactment of the ordinance amendment.
The project tabulation is as follows:

A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, AUTHORIZING DEVELOPMENT OF
NINE (9) RESIDENTIAL CONDOMINIUM UNITS
PURSUANT TO THE PLANNED DEVELOPMENT STANDARDS
AT 14632 MOLT
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application, (Use Permit No. 81-11),
has been filed on behalf of Spirit Development Company,
to request authorization to develope nine (9)
residential condominiums at 14632 Holt pursuant to
Planned Development Standards.
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance, and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort, or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
1. The use is in conformance with the land use
element of the Tustin Area General Plan.
2. The proposal is within the maximum density allow-
able by the district.
3. That there are amenities of design incorporated
into the project and surrounding area that provides
an environment of openness.
That the establishment, maintenance, and operation
of the use applied for will not be injurious or detri-
mental to the property and improvements in the neighbor-
hood of the subject property, nor to the general welfare
of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uni-
form Building Codes as administered by Orange County
Fire Marshal, and street improvement requirements as
administered by the City Engineer.
F. That this project is categorically exempt from the
requirements of the California Environmental Quality
Act.
G. Final development plans shall require the review and
approval of the Community Development Department.

II. The Planning Agency hereby adopts amended Conditional
Use Permit No. 81-11, to authorize development of nine (9)
residential condominiums not to exceed 55% land coverage
subject to the following conditions:

The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street
improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street
Improvement Standards". This work shall consist of,
but is not limited to:
a. Curb and gutter
b. Drive apron
c. Sidewalk
d. Street trees
e. Street lights
f. Flood control inlet
g. Sanitary sewer connections
h. Domestic water services

A permit to be issued by the Orange County Environmental
Management Agency for connection to the EL Modena Irvine
Channel/North Tustin Channel will be required.
Submission of a final grading plan for review and
approval.
Annexation of said parcel to the Tustin Lighting
District. Proof of submission of said annexation to
the County Surveyor's office must be furnished the
City prior to approval of final map by the City
Engineer.
Payment of East Orange County Sanitation District
No. 7 sewer connection fees.
Payment of East Orange County Water District fees in the
amount of $500/dwelling unit.
Submission of C.C.&Rs to City Attorney for review and
approval.
Confirmation from Holthe Disposal Company must be
provided that they are able to service the development
with the present location of the trash bin.
Dedication of all access rights to the City along Holt
Avenue except at approved access points will be
required.
A public fire hydrant shall be provided adjacent to the
driveway apron.

The C.C.&Rs shall limit patio, balcony overhangs
and shade structures, due to the building coverage
limitation to 25 square feet for each unit.
Me
Planting and irrigation plans shall be submitted for
review and approval. Minimum on-site tree planting
requirements are:
Three 24" box trees
Sixteen 15 gallon trees
N. That a copy of this Resolution shall be made available
to potential buyers of these units.
O. That approval and enactment of this Resolution is
effective only upon the enactment of Tustin City
Ordinance No. 851 to amend provisions of the Planned
Development
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency, held on day of , 1981.
