Jamieson on behalf of Far West Savings and Loan Association Location: 615 E. First Street BACKGROUND AND DISCUSSION A zone change application has been filed to request a zone change for the subject property from the Retail Commercial District (C-1) to the Planning Community Commercial District (PC-Commercial). This request is primarily made so that the 35' height limitation in the C-1 Zone may be exceeded by a use permit through provisions of the PC District. The site is approximately 400' from the nearest residential land, northerly on Irvine Boulevard. The applicant has not submitted any development standards with this request and as a result the development of this property will be by approval of a precise plan through a conditional use permit (Section 9244e2.c). On June 18, 1981, the Planning Agency recommended approval of this zone change by the adoption of Resolution No. lg79. RECOMMENDED ACTION Staff recommends that the City Council uphold the findings of the Planning Agency and: 1. Have first reading by title only. 2. Introduce Ordinance No. 853. FIRST STREET (230'+ EAST OF FASHION LANE, NORTH SIDE OF FIRST STREET) The City Council of the City of Tustin, California does ordain as follows: I. The City Council finds and determines as follows: Ae That a proper application (Z.C. 81-3) was filed on behalf of Far West Savings and Loan Association for rezoning from the C-1 (Retail Commercial) to the Planned Community Commercial District for the property described in Exhibit "A" attached hereto and incorporated herein by reference. Bw That the Planning Agency duly recommended approval of said application, after public hearing duly called, noticed, and held. C. The City Council duly called, noticed, and held a public hearing on said application. D. That the zone change is a class 5 categorical exemption from California Environmental Quality Act. II. The subject property is hereby rezoned to the PC (Planned Community - Commercial District) and the Zoning Map of the City of Tustin amended accordingly subject to conditions of Planning Agency Resolution No. 1979.
