HomeMy WebLinkAboutPH 4a ZONE CHANGE 81-4 06-15-81DATE: June 15, 1981 PUBLIC HEARINGS 6-15-81 NO. 4 Inter-Corn TO: Honorable Mayor and City Council Members FROM: Community Development Department SUBJECT: Zone Change 81-4 Location: Applicant: Newport Avenue, between Main Street and E1Camino Real Cal Pacific Properties BACKGROUND AND DISCUSSION The request is to authorize the change of zone from Retail Commercial (C-l) to the Planned Community Commercial (PC-C). This zone change is only for a portion of a subject property owned by Tustin Main Associates. The remainder of the property is already zoned PC Commercial. Properties designated as Planned Community Commercial will be improved according-to a development plan, that must be submitted either with the zone change or as a Use Permit to the Agency. The applicant will be submitting the development plan as a use permit at a later date. The zone change will allow the entire subject property to be consolidated under one zoning designation and permit the applicant to design one comprehensive project. RECOMMENDED ACTION 1. Have first reading of Ordinance by title oflly. 2. Introduce Ordinance No. 854. EMK/dat 24 26 29 ORDINANCE NO. 854 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, RECOMMENDING APPROVAL OF REZONING APPLICATION NO. 81-4 LOCATED ON THE WESTERN SIDE OF NEWPORT AVENUE, BETWEEN MAIN STREET AND EL CAMINO REAL The City Council of the City of Tustin does hereby ordain as follows: I. The City Council finds and determines: That a proper application (Z.C. 81-4) has been filed by Cal Pacific Properties on behalf of Tustin Main Associates to approve a zone change from Retail Commercial (C-1) to Planned Community Commercial (PC-C) for property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. B. That a public hearing was duly called, noticed, and held on said application. That the zone change as applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, or general welfare of the community and should be granted, evidenced by the following findings: 1. The commercial designation is in conformance with the Tustin Area General Plan. 2. The intent of the PC-C zone is to allow diversification of the relationships of various buildings. 3. Amenities and compatibilitles of PC Disticts will be insured through the approval of use permits. D. This zone change is categorically exempt from the requirements of the California Environmental Quality Act. The City Council approves the findings and recommendations contained in the City of Tustin Planning Agency Resolution No. 1980, recommending to the City Council approval of Zone Change No. 81-4. II. The City Council hereby approves Zone Change No. 81-4, from the present Retail Commercial (C-1) to Planned Community Commercial (PC-C).
