HomeMy WebLinkAboutCC 6 TERMINATE ANNEX 06-15-81CONSENT CALENDAR NO. 6 6-15-81 AGENDA ITEM: RESOLUTION NO. 81-70 A Resolution of the City Council of the City of Tustin, California, TERMINATING THE ANNEXATION PROCEEDINGS FOR IRVINE BLVD.-DEAN STREET ANNEXATION NO. 121 BACKGROUND: A Special Annexation Election was held on June 2, 1981 to determine if the Irvine Blvd.-Dean Street Annexation No. 121 should be approved. The voters defeated the annexation by a vote of 188 against and 35 in favor. RECOMMENDATION: Adoption of Resolution No. 81-70 terminating the proceedings of Irvine Blvd.-Dean St. Annexation No. 121. Annexation 1 4 20 RESOLUTION NO. 81-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, TERMINATING THE ANNEXA- TION PROCEEDINGS FOR IRVINE BLVD.-DEAN STREET ANNEXATION NUMBER 121 The City Council of the City of Tustin hereby resolves as follows: WHEREAS, the annexation of territory known as the Irvine Blvd.-Dean Street Annexation No. ~21 to the City of Tustin was approved by the Local Agency Formation Commission on October 10, 1980; and WHEREAS, the City Council of the City of Tustin initiated annexation proceedings at the request of proponents living within the area to be annexed, in accordance with the annexation laws of the State of California; and WHEREAS, the City Council held a duly advertised public hearing on said annexation on December 29, 1980, as required by law; and WHEREAS, pursuant to Section 35228 of the Government Code the City Council, by Resolution No. 81-51 adopted on January 19, 1981, determined the value of written protests and ordered the subject area annexed to the City of Tustin, subject to the confirmation by the voters; and WHEREAS, at the special annexation election for Irvine Blvd.-Dean Street Annexation No. 121, the voters defeated the measure by a vote of 188 against and 35 for, NOW, THEREFORE, the City Council of the City of Tustin, California, hereby resolves: That all pending annexation proceedings for the territory described as Irvine Blvd.-Dean Street Annexation No. 12~ shall be hereby ter- minated; and 2. That pursuant to Government Code Section 35238, the City Clerk shall file a certified copy of this resolution with the executive officer of the commission.
