An Ordinance of the City Council of the City of Tustin, California,
AMENDING THE ZONING ORDINANCE OF THE TUSTIN CITY CODE TO AUTHORIZE A
WAIVER OF OPEN SPACE REQUIREMENTS IN THE PLANNED DEVELOPMENT
DISTRICT.
BACKGROUND:
Ordinance No. 851 had first reading by title only and introduction
at the June 1, 1981 meeting.
RECOMMENDATION:
M.O.- That Ordinance No. 851 have second reading by title only.
M.O.- That Ordinance No. 851 be passed and adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING THE Z~NING
ORDINANCE OF THE TUSTIN CITY CODE TO AUTHORIZE
A WAIVER OF C~ ~PACE REQUI~ IN THE
PLANNED DEVELOPMENT DISTRICT
The City Council of the City of Tustin, C~lifornia, hereby
ordains that Chapter 2, Section 9224, Paragraph g~, m~t.~,m lot
coverage be smended to res~ as follows:
6. Maximum Lot Coverage
Not more th-n fifty (50) percent of the total lot area shall be
devoted to main and accessory building area, driveways, open or
enclosed parking areas and covered patios. The r~m-ining fifty
(5o) percent of the to~al lot area ~11 be devoted to
landscaping; lawn area, non-commercial outdoor recreational
facilities incidental to the residential development, such as
private ~w.imr,n')n~ pools, putting greens and tennis courts;
~lkw~ys; uncovered patio SA~mS; fences and neoessary
fire-fighting equipment and installations as required in
Subsection d(9) of rh~s Section; further, the open space
required by this 8ectioa sh~ll be s~:k-~nged .nd provided in such
a manner that it' is a~cessible and -~-ble for the purpose
intended herein. Said open sp~e shall not be devoted to
cc.~rci~l a~ricultur~l pursuits or any other activity in
conflict with tb~ stated purpose of this Section ~nd District.
"The Planning Agency.my authorize credit for permanent
open space adjoining a proposed project upon a finding that
there are amenities of design incorporated into the project
and the surrounding area achieves the intent and purpose of
the planned development district by providing an
environment of openness. A waiver of open space
requirenents excccding 5% sh~ll require the filing and
approval of a variance application."
PASSED AND ADOPTED at a regular ~-cting of the City Council, City
of Tustin, California, held on the 1st day of June, 1981.
