Legislative Action SB 305
SB 305 (Greene) has cleared committee and will soon be heard on the floor of
the Senate.
This bill corrects an action taken last year which provided that the deter-
mination of the Workers Compensation Appeals Board was conclusive in pro-
ceedings before local retirement boards. This removes from the City the
ability to make an independent determination regarding the status of an
employee's disability for retirement purposes in cases where the WCAB has
ruled on the status of the disability.
SB 305 corrects this situation by returning the state of the law to the
pre-1979 status. While this bill has been passed in committee, the City's
input could be valuable ~n insuring passage by the full senate.
Recommendation
That the City Council take a stand in support of SB 305 and authorize the
Mayor to send letters stating such support to,he appropriate officials.

DRAFT LETTER SB 305
This is to voice the support of the City Council of the
City of Tustin for SB 305. In considering this bill, it
is felt that it returns to the City an element of control
in matters concerning disability retirements which is
important to the cost-effective operation of the City.
The City must have the ability to make a determination in
disability retirement cases in order to avoid unwarranted
retirements, which both raise costs ahd undermine disciplinary
and administrative practices and policies. The City of Tustin
has been faced with a number of such cases over the past several
years which have involved retirement board decisions concerning
the disability status of an employee. This bill would insure the
City's full participation in such decisions.
We would urge you to vote in favor of SB 305 when the issue is
considered by the full senate.
