RESOLUTION NO. 81 - 56
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN OVER-R[~IN] ~ PLANNIN~ AGSNCY AND
APPROVING A USE PERMIT FOR ~ME B'NAI ISRAFJ~
CONGREGATION AT SUITES H & I, 13].12 NEWPORT
AVENUE
The City Council of the City of Tustin does hereby resolve as
follows:
I. The City Council finds and determines as follows:
That a proper application, (Use Permit No. 81-13), was
filed o~ behalf B'Nai Israel Congregation by the Robert
P. Warmington Co.any to authorize the use of Suites H
and I, 13112 Nc~vport Avenue for religious instruction
assembly.
B. That a public hearing was duly called, noticed and held
on said application on April 6, 1981.
That the Planning Agency, by Resolution No. 1955B denied
the application on the basis of a conflict in
parking acco~tions between the cofi~aercial use within
the center and congregational uses.
D. That an appeal was filed, duly noticed and ah earing
conducted by the City Council on May 4, 1981.

l~mt evidence was presented to the Council showing that
the establishment,.maintenance, and operation of the use
applied for at the site will be compatible with existing
uses due to the assignment and monitoring of parking
accomodations.
II. The City Council hereby over-rul~ the denial of the Planning
Agency and approves the use of Suites }! and I, 13221 Newport
Avenue for congregational meetin~ and educational progrmas
conducted by the B'Nai Israel Congregation subject to the
following conditions:
The congregation shall be responsible for the monitoring
of parking to assure co~tibility with o~n~rcial
estt.r~tes on the site. '
The occupancy of the structure shall comply ~ith all
health and safety require~nents of the Uniform Building
Code.

The Use Permit shall be subject to review on or about ~lay
17, 1982 and shall be subject to termination if a
determination is made by the Planning Agency that subject
operations are not compatible with existing and
authorized uses of the center.
PASSED AND ADOPTED at a regular n~3eting of the City Council held
on the 18th day of May 1981.
