LEVIN, DEPUTY CITY ATTORNEY SUBJECT:AMENDMENTS TO CONFLICT OF INTEREST CODE Several amendments to'the City's Conflict of Interest Code are necessary in order to bring the Code into compliance with recent amendments to the Political Reform Act of 1974. The important substantive changes are set forth below: 1. We have inserted the definition of "family" in Section 1.4(j). 2. Section 2.2 has been changed to reflect the Political Reform Act's provisions regarding choice as to place of filing. The Resolution approving the Code selects an alternative (filing with the City Clerk), so no practical change is being made. 3. Section 2.3 has been changed to eliminate the previous distinction between Civil Service and non-Civil Service employees. 4. Reportable interests now include those of the family, not just the spouse, of the employee, so changes have been made through- out the Code in this regard. 5. The exclusions from the definition of "income" have been expanded to include several new exemptions. 6. Section 2.7 has been changed to reflect new monetary reporting requirements. We have also added a subsection (e) to make clear that the principal residence of the employee is not- included in real property interests for disclosure purposes. Similar changes have been made in Section 2.8. 7. 'Section 2.9 has been changed to reflect several changes in the law: " Subsection (a) - Sources of income need only be reported if they provide income of $250 or more, or $25 if a gift; Subsection (c) - Other monetary reporting limitations have changed; Subsection (f) - The interest rate and security given must be reported on loans; Subsection (g) - The distinction between legal and brokerage services with respect to interests in business entities has been eliminated; Subsections (h) and (i) - Have been added. 8. Section 3.5 has been changed to reflect new legal require- ments and, as changed, it incorporates the previous Section 3.6. 9. LEVIN, DEPUTY CITY ATTORNEY UPDATED CONFLICT OF INTEREST CODES Enclosed are updated Conflict of Interest Codes for the Redevelopment Agency and for the other departments of the City. We have also enclosed Resolutions of the City Council approving these Codes, and of the Redevelopment Agency adopt- ing its Code. The Redevelopment Agency must first adopt its Code, and then the City Council, as code reviewing body, should approve it. The updated Code for the other departments of the City need only be approved by the City Council. The City Council finds and determines that the Conflict of Interest Code of the Tustin Community Redevelo Agency has been adopted by that Agency and that said Code is in compliance with the requirements of law and is a reasonable and appropriate Code and should be approved. 2. The City Council hereby approves the Conflict of Interest Code of the Tustin Community Redevelopment Agency heretofore submitted for that Agency, a copy of which said code is attached hereto. 3. Pursuant to Section 2.3 of said Code, the City Council of the City of Tustin, as the Code Reviewing Body, hereby instructs all designated employees required to file Statements of Economic Interests pursuant to said Conflict of Interest Code to file said statements with the City Clerk of the City of Tustin. The City Council of the City of Tustin, California, does hereby resolve as follows: i. The City Council finds and determines that the Con- '~ flict of Interest Codes of the Departments of the City of Tustin have been adopted by those Departments and that said Codes are in compliance with the requirements of law and are reasonable and appropriate Codes and should be approved. 2. The City Council hereby approves the Conflict of Interest Codes of the Departments of the City of Tustin hereto- fore submitted for those Departments, copies of which said Codes are attached hereto. 3. Pursuant to Section 2.3 of said Codes, the City Council of the City of Tustin, as the Code-Reviewing Body, - hereby instructs all designated employees required to file statements of Economic Interests pursuant to said Conflict of Interest Codes and to file said statements with the City Clerk of the City of Tustin.
