BACKGROUND
On April 20, 1981, the Planning Agency continued the scheduled
public hearing concerning Use Permit 81-14. The problems that
staff had at that time regarding the project have been resolved,
and it would now be appropriate for the Agency to act on the
subject matter.
DISCUSSION
The applicant, on behalf of the Sathya Sai Baba Society has
requested to be allowed to operate a mail order, and
over-the-counter book store at 305 West First Street. The
development will include:
1. A revitilization of the store front;
2. A provision for landscaping and planter areas; and
3. The following parking provisions (breakdown as allowed in the
CG-PUD District) -
2 spaces for the 287 square feet of retail sales area
2 spaces for the 692 square feet of office area
3 spaces for the 1,390 square feet of storage area
Since the location of the proposed project is zoned Commercial
General- Planned Unit Development (CG-PUD), a use permit is
required. The proposed use is appropriate for this zone
designation.
RECOMMENDATION
Staff recommends that the Planning Agency approve Use Permit 81-14
by the adoption of Resolution No. 1967 as drafted.

RESOLUTION N0.1967
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING A USE PERMIT TO
AUTHORIZE THE OPERATION OF A MAIL ORDER, AND
OVER-THE-COUNTER BOOK STORE AT 305 WEST FIRST
STREET.
Agency of the City of Tustin does hereby resolve as
The Planning Agency finds and determines as follows:
A. That a proper application,(Use Permit No.81-14), has
been filed on behalf of the Sathya Sai Baba Society,
to permit the operation of a mail order and over-the
counter book store at 305 West First Street
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance, and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort, or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
1. The requested use is in conformance with both the
City of Tustin Zoning Ordinance, and the Tustin Area
General Plan.
D. That 'the establishment, maintenance, and operation
of the use applied for will not be injurious or detri-
mental to the property and improvements in the neighbor-
hood of the subject property, nor to the general welfare
of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uni-
form Building Codes as administered by Orange County
Fire Marshal, and street improvement requirements as
administered by the City Engineer.
F. This project is categorically exempt from the
requirements of the California Environmental Quality
Act.
G. Final development plans shall require the review and
approval of the Community Development Department.

II. The Planning Agency hereby adopts Conditional
Use Permit No.81-14, to authorize the operation of a mail
order, and over-the-counter book store at 305 West First
Street subject to the following conditions:
The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street
improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street
Improvement Standards". This work shall consist of,
but is not limited to: curbs and gutters, sidewalks,
drve apron, and street pavement.
A landscape plan shall be submitted and approved prior
to the issuance of a building permit.
All signing will conform to the Tustin Sign Ordinance
No. 684.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency, held on the 4th day of May 1981.
