Ordinance No. 843, Adoption of State Historical Building Code
BACKGROUND
On April 6, 1981, the City Council adopted Resolution No. 81-33
which addressed selection criteria for historic sites, established
a policy for historic preservation and set procedures for historic
designation.
At present there are no buildings within the City designated as
historic buildings. However, the Gfeller Development will be
making application to the City Council to designate the Stevens
home as a historical building in order to change the occupancy
rating from residential to office use.
Adoption of the State Historical Building Code will permit the
conversion of historic buildings under less restrictive building
standards than those required by the 1979 Uniform Building Code
which is applicable to all other projects. Application of the
Uniform Buildin9 Code would preclude the conversion or
rehabilitation of historical buildings.
RECOMMENDED ACTION
1. Have first reading by title only.
2. Introduce Ordinance No. 843.

OF THE CITY OF TUSTIN, A~DING
THE CITY CODE BY THE ADDITION/X)

The City Council of the City of Tustin does hereby ordain as follc~vs:
SECTION 1: Chapter 1, Article 8, Tustin City Code is amended to read as
~ol lows:
8105 adoption of the State Historical Building Code
The State of California, California Administrative Code, Title 24,
State Building Standards, Part 8, State Historical Building Code,
for the purpose of providing alternative building regulations for
the rehabilitation, preservation, restoration or relocation of
buildings or structures designated as historical buildings by
Federal, State of California, County of Orange, or City of Tustin.
All provisions in effect October 20, 1979, adopted and published by
office of administrative hearings, Department of General
Services, distributed by State of California, Documents
Section, P.O. Box 1015, North Highlands, California, 95660, of
which not less than three (3) copies have been and now ~re filed in
the office of th City Clerk of the City of Tustin, are hereby
adopted and incorporated herein as fillly as though set forth in
full herein.
2. GENERAL P~NALT¥_; CONTINUING VIOLATION
No person shall violate any provisions, or fail to comply with any
of the provisions of this Code, or of any code adopted herein by
reference. Any person violating any of the provisions or failing
to comply with any of the mandatory requirements of this Code, or
of any code adopted by reference herein, unless otherwise specified
in this Code, shall be. punishable by a fine of not more than
$500.~0 or by impriso~nent in the City or County Jail for a period
of not exceeding six ~onths, or by both such fine and
imprisonment. Each such person violating such provision or failing
to comply with such requirements shall be guilty of a separate
offense, and each day during any portion of which any violation of
any provision of this Code, or of any code adopted by reference
herein, is committed, continued, or permitted by such person,
shall constitute a separate offense, and shall be punishable
accordingly. Provided further that each such person violating
a provision which limits the time an act may be permitted or
continued, each such period of portion thereof of which any
violation of such provision is committed, continued or permitted
by such person shall constitute a separate offense, ar~i shall
be punishable accordingly.
In addition to the penalties hereinabove provided, any condition
caused or permitted to exist in violation of any of the provisions
of this Code, or of any code adopted by reference herein, shall be
deemed a public nuisance and may be summarily abated as such by
this City, and each day such condition continues shall be regarded
as a new and separate nuisance and offense.

3. SEVERABILITY OF PARTS OF THIS ORDINANCE AND ~ ADOPTED CODES
It is hereby delcared ~o be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases
of this Ordinance and the adopted Codes are severable, and if
any phrase, clause, sentence, paragraph or section of this Code
shall be declared unconstitutional by the valid judgment or decree
of court of competent jurisdiction, such unconstitutionality shall
not affect aay of the remaining phrases, clauses, sentences,
paragraphs and sections of this Ordinance and the adopted Codes.
The City Clerk shall certify to the passage of this Ordinance,
and shall cause the same to be published once within fifteen (15)
days after it adoption, in the Tustin News, a newspaper of general
circulation, printed, published and circulated in said City, and
i~nediately upon and after its passage it shall take effect and be
in full force.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin, held on the day of , 1981.
