Attached is a letter from the County Sanitation Districts of orange County, asking
for a certified copy of the action of the Council in appointing an alternate as well
as the action electing the mayor as soon as possible in order to seat the Director(s)
on the Board(s).
Mayor Sharp gave me the Councilmen that are to be representatives and alternates but
no formal action has been taken.
RECOMMENDED ACTION:
Pursuant to Mayor Sharp's direction, the following are appointed:

The mayor of the city is a member of the Board of Directors of County Sanitation
District No(s). as provided in Section 4730 of the State Health and
Safety Code. The code also provides for appointment of alternate Directors and,
in certain instances, one additional council member (see extract of code attached
- hereto).
In the event recent or forthcoming elections and/or council reorganization result
in a change in your city's representation on the above Board(s), this office would
appreciate being advised as soon as possible of the name and mailing address of
the mayor and/or the council member appointed in order that we may forward a
notice of the District meetings and an agenda of the items to be considered.
The Board(s) meet regularly on the second Wednesday of each month.
To assist you we are enclosing a summary of actions required by the city to
appoint representatives to the Sanitation Districts' Boards. The city council
should appoint an alternate to the mayor, to serve on the District Board(s) in
the mayor's absence, inability, or refusal to serve. We will need a certified

RE: SUMMARY OF HEALTH AND SAFETY CODE SECTION 4730, RE GOVERNING BODY OF A
SANITATION DISTRICT
The governing body of a sanitation district is a Board of Directors of
not less than three members, as follows:
(A) City Representation
1. The mayor of each city, the whole or part of which is included
in a sanitation district, is a member of the board.
2. A city within a sanitation district, the sewered portion of
which city lies entirely within a sanitary district shall have no
representation on the board.
3. If the sanitation district includes unincorporated territory,
and all or part of one city but no sanitary district, the city will be
represented on that board by its mayor and one other member of the
governing body of the city. (Note: This provision presently applies
only in District No. 5 for the City of Newport Beach and District No. 11
for the City of Huntington Beach.)
4. Alternate Directors - The governing body of the city shall
select one of its members other than its mayor as an alternate director
to act as a member of the district board in place of the mayor during
his absence, inability or refusal to act. The Health and Safety Code
does not provide for alternate directors for members representing a
city, other than the mayor- (ie., Newport Beach and Huntington Beach)
(B) Sanitary District Representation
1. A member of the governing body of each sanitary district, the
whole or part of which is included in the sanitation district, is a
member of the board.
2. Alternate Directors - The governing body of the sanitary district
represented on the board of directors shall select one of its members as
an alternate director to act as a member of the district board in place of
its regular director during his absence, inability or refusal to act.
(C) County Representation
1. If the sanitation district includes territory which is unincor-
porated, the presiding officer of the County Board of Supervisors is a
member of the board.
2. Alternate Directors - The Board of supervisors shall select
one of its members, other than its presiding officer, as an alternate
director to act as a member of the district board in place of the Chairman
of the Board of Supervisors during his absence, inability or refusal to act.

(D) Miscellaneous Provisions
1. If a sanitation district includes no territory which is in
cities or sanitary districts, the County Board of Supervisors is the
board of directors of the district.
2. If the territory of the district lies wholly within a city,
the governing body of said city is the board of directors of the
district.
