Fleagle, Community Development, Director Protem Annexation No. 127 (Holt-Hamela) BACKGROUND The Holt-Hamela Annexation No-127 was initiated by three (3) of the four (4) property owners on Holt Avenue, Northerly of the Flood Control Channel. The Local Agency Formation Commission on March 11, 1981 authorized the city of Tustin to be the conducting authority for the annexation as an uninhabited area containing less than 12 registered votes. Since there is not a unanimous consent, a protest hearing is required. The City Council by Resolution No. 81-32, scheduled a protest hearing for 7:30P.M. April 20, 1981 and notice has been provided as required by law. Resolution No.81-45 has been prepared which determines the value of protests and orders the annexation of the subject properties. If a protest is not filed, "O" would be inserted in the spaces of Sections III and IV of the Resolution. RECOMMENDED ACTION: Open the protest hearing to receive property owner protests. (Only property owners within the annexation area have a right to file a prokest) 2. Close the protest hearing. Determine the value of protests. (If Ms. Patterson files a protest, it would represent 20% of the value of the area.) Adopt Resolution No. 81-45 Encl: Res. 81-45 Property Values 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3O 31 32 RESOLUTION NO. 81- 45 A RESOIYJTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, DETERMINING THE VALUE OF WRI%TEN P~S AND OBDERING THE ANNEXATION OF THE AREA KNCI~N AS "HOLT-HAMALA ANNEXATION NO. 127" TO THE CITY OF TUSTIN The City Council of the City of Tustin does hereby resolve as follows: Pursuant to Chapter 2, Part 2, Division 2 of Title 4 of the Government Code, preliminary proceedings were completed by the Local Agency Formation Cu,.~lission on March 11, 1981 and the City of Tustin was desi.qnated as the conducting authority and authorized to proceed with the annexation to the City of Tustin - the area designated "Holt-Hamala Annexation No. 127", described in Exhibit "A" attached hereto, and a part hereof. II. The City Council, pursuant to Section 35201 of the Government Code, adopted Resolution No. 81-32, initiating annexation proceedings and fixing a time and place for a protest hearing. III. Due notice ~-~as giva~ and a protest hearing was conducted at 7:30 p.nl. April 20~ 1981 and 1 protest from a property owner representing ._.~2_~_?~ of the total assessed value of the area p,r~scd fo~~ ann~x~-~t!on was-received prior to the close of the hearinc3. IV. Pursuant to Section 35337 of the C~3vernment Code, the City Council finds that the value of written protests is 20 % of the total assessed value of land auld improvements within the area and represents less than 50 percent of the total assessed value of land and improvements within the territory. The City Council hereby orders the annexation to the City of Tustin of the uninhabited territory designated Holt-Hamala Annexation No. 127, as specifically described in the legal description and map attach£~ hereto as Exhibit "A". VI. Satisfaction of the requiren~nts of Section 99(d) of the Revenue and Taxation Code has been accomplished by City Council Resolution No. 80-119 and Board of Supervisor's Resolution No. 80-1903 accepting a Master Property Tax Transfer Agreement applicable to subject fully developed area. Subject annexation shall be effective upon the filing and recording of the certificate of completion by the Executive Officer of the Local Agency Formation Conmission. VIII. The City Clerk shall transmit a certified copy of this Resolution, along with the required fees payable to the State Board of Equalization, to the Executive Officer of the Local Agency Formation C~m,,ission for certification of completion and recording.
