RABE, CITY CLERK SUBJECT: INTRODUCE ORDINANCE NO. 1474 ALLOWING THE CITY COUNCIL TO CONDUCT BUSINESS DURING REGULAR MEETINGS AT ALTERNATE LOCATIONS WHEN NECESSARY SUMMARY Adoption of proposed Ordinance No. 1474 would amend Section 1301 of the Tustin City Code to allow the City Council to conduct business during Regular Meetings at locations other than the Council Chamber when deemed necessary. RECOMMENDATION That the City Council: Introduce and have first reading by title only of Ordinance No. 1474 and set the second reading for November 1, 2016. FISCAL IMPACT There is no fiscal impact associated with this item. BACKGROUND On October 4, 2016, the City Council awarded the contract for the Council Chamber Renovations Construction Project (CIP No. 10075) to TBC Contractors, Inc. It is anticipated the project will commence construction in January 2017. Once construction begins, it will be necessary for the City Council to hold meetings in an alternate location for a period of time. In addition to the renovation, the flexibility to hold Regular meetings in an alternate location at larger venues such as the Marketplace Community Center or Clifton C. Miller Community Center would be available to accommodate more members of the public. Tustin City Code Section 1301 requires Regular Meetings of the City Council and Housing Authority to be held in the Council Chamber located at 300 Centennial Way, Tustin CA 92780. Therefore, any meetings conducted offsite are considered Special Meetings. One important difference between a Special Meeting and a Regular Meeting is the ability to Agenda Report Ordinance No. 1474 Page 2 approve an Ordinance. Pursuant to Government Code Section 36934, Ordinances may only be passed at a Regular Meeting or at an adjourned Regular Meeting. The adoption of Ordinance No. 1474 would allow the City Council to approve a schedule for Regular Meetings to be conducted at an alternative location by adoption of a Resolution. Staff will present a Resolution with the proposed construction schedule for Council's consideration at an upcoming meeting once the timeframe is determined. Further, should the City Council desire to hold a Regular Meeting in an alternate location in the future to accommodate more members of the public, staff will present a Resolution at that time for approval. In an effort to continue to be transparent and public is notified of the temporary schedule boards, and in the Tustin News. Attachment: Draft Ordinance No. 1474 provide proper noticing, staff will ensure the by noticing on the City's website, posting ORDINANCE NO. 1474 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 1301 OF THE TUSTIN CITY CODE RELATING TO MEETING DATES The City Council of the City of Tustin, California, ordains: Section 1. Section 1301 of the Tustin City Code is amended to read: 1301 REGULAR MEETINGS A. Regular meetings of the City Council shall be held on the first and third Tuesdays of each calendar month at the hour of 7:00 p.m. in the Council Chambers, Tustin City Center, Centennial Way at Main Street, Tustin, California. An alternative time or location for one or more regular meetings may be approved by City Council Resolution approved at least fourteen (14) calendar days prior to the meeting date. When the regular meeting date falls on a legal holiday, the meeting shall be held on the following day. B. Closed sessions of the City Council at 5:30, prior to the 7:00 p.m. business portion of regular meetings and at the same location. If necessary, Closed Sessions not completed prior to the business portion will be considered at the conclusion of the business portion of the meeting, or as otherwise determined by the City Council.
