Binsack, Zoning Administrator PUBLIC CONCERNS: None CONSENT CALENDAR: None PUBLIC HEARING: Opened at 11:01 a.m. 1. CONDITIONAL USE PERMIT 2016-17 APPLICANT: Chase Villafana Planet Fitness 320 Yonkers Avenue Yonkers, NY 10701 PROPERTY OWNER: The District at Tustin Legacy Vestar/Kimco Tustin L.P. 2437 Park Avenue Tustin, CA 92782 LOCATION: 2495 Park Avenue REQUEST: To establish and operate a fitness center located within an existing 23,786 square-foot tenant space. ENVIRONMENTAL STATUS: This project is categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 16-011 approving Conditional Use Permit 2016-17 to establish and operate a fitness center within an existing 23,786 square-foot tenant space located at 2495 Park Avenue. The Zoning Administrator called the meeting to order. It was noted there were no members of the public present for this item. The applicant, Chase Villafana, was in attendance. Zoning Administrator Action Agenda October 24, 2016 Page 2 The Zoning Administrator stated she reviewed the staff report and did not have any questions nor did she need a presentation. She asked Mr. Villafana if he had the opportunity to review the staff report and if he agreed with the Conditions of Approval, which he did. The Zoning Administrator made one (1) minor modification to ZAA No. 16-011, Condition 2.1 of the Conditions of Approval with regards to the business operating 24 hours, and being the only business at the District operating 24 hours. Specifically the Use Restriction which should read as follows: "Modifications to the hours of operation may be limited by the Community Development Director if it is determined that impacts to the surrounding tenants or properties are occurring". The Zoning Administrator asked the applicant if he agreed with the minor modifications made to Condition 2.1 of the Conditions of Approval, as well as providing adequate security, which he did. The Zoning Administrator approved ZAA 16-011, as amended. REGULAR BUSINESS: None ADJOURNMENT: 11:05 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
