DISTRICT NOS. 03-01 AND 03-02 FOR THE NEWPORT AVENUE
EXTENSION, STATE ROUTE 55 NORTHBOUND RAMP
RECONFIGURATION, VALENCIA AVENUE AND DEL AMC AVENUE
WIDENING PROJECT-PHASE 1 (CIP NO. 7130) AND FOR THE
EDINGER AVENUE ("SMART STREET") WIDENING PROJECT
(ClP NO. 7147)
SUMMARY
Adoption of Resolution No. 03-91 will set the time and place for a Public Hearing regarding the
proposed establishment of Underground Utility District Nos. 03-01 and 03-02. The area of each
District is generally the area bounded by Edinger Avenue on the north, the Burlington Northern anc
Santa Fe railroad spur line east of Del Amc Avenue on the east, Valencia Avenue on the south, anc
State Route 55 on the west.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 03-91, setting the time and place for a
Public Hearing to consider the designation and adoption of Underground Utility District Nos. 03-0'
and 03-02 requiring the removal of poles, overhead wires and associated overhead structures within
the area of the City generally bounded by Edinger Avenue on the north, the Burlington Northern and
Santa Fe railroad spur line east of Del Amo Avenue on the east, Valencia Avenue on the south, and
State Route 55 on the west.
FISCAL IMPACT
Funds to construct both Underground Utility Districts are included in the Fiscal Year 2003-200L
Capital Improvement Program Budget for the Newport Avenue Extension, State Route 55 Northbound
Ramp Reconfiguration, Valencia Avenue and Del Amo Avenue Widening Project-Phase 1 (CIP No.
7130), and the Edinger Avenue ("Smart Street") Widening Project (CIP No. 7147). There are two
sources of funding to underground existing overhead facilities, Rule 20A funds and Rule 20B funds.
Rule 20A funds are set aside funds from Southern California Edison to assist cities to underground
overhead utilities. Rule 20B funds are local agency funds (in this case City of Tustin) used to
underground overhead utilities. Details of the fiscal impact will be described in the agenda report a:
the time of the public hearing and will be identified in the Engineer's Report for each district.

BACKGROUND
The proposed Underground Utility District Nos. 03-01 and 03-02 provide for conversion of all overheac
distribution and transmission utilities to underground utilities on Edinger Avenue between State Route 55
and approximately 1,000 feet southeast of Del Amo Avenue, and on Del Amo Avenue between Edinge'
Avenue and Valencia Avenue. Underground Utility District No. 03-01 provides for undergrounding of the
overhead distribution facilities and a portion of the overhead transmission facilities. Underground Utility
District No. 03-02 provides for undergrounding of the remaining overhead transmission facilities that can
be constructed with the Rule 20A funds provided by Southern California Edison.
In addition to the transmission and distribution utilities being placed underground, it will be necessary to
require the undergrounding of distribution utility services for the private properties as follows:

Since the underground district for the distribution lines is a Rule 20B (City funded) project, the cost of
undergrounding for each property owner will be funded by the City.
Both districts are being formed so that construction of the underground facilities can be implemented in
conjunction with the Edinger Avenue (Smart Street) Widening Project (CIP No. 7147) and Phase 1 of the
Newport Avenue Extension, State Route 55 Northbound Ramp Reconfiguration, Valencia Avenue and
Del Arno Avenue Widening Project (CIP No. 7130).
DISCUSSION
City of Tustin Ordinance 411 (Tustin City Code, Section 7500§) authorizes the City Council to call Public
Hearings to ascertain whether the public necessity, health, safety, or welfare requires the removal of
poles, overhead wires, etc., within certain designated areas of the City and to consider the underground
installation of the above-mentioned appurtenances for supplying electric, communication, and othe~

similar services. This project will also consist of installation of new marbelite street light poles anc
luminaires. At the September 18, 2000 City Council meeting, the project to underground the existin.c
overhead facilities on Edinger Avenue between State Route 55 and approximately 1000 feet southeas:
of Del Amo Avenue, and on Del Amo Avenue between Edinger Avenue and Valencia Avenue was
added to the City's Public Utility Commission (PUC) Rule 20A project list and established as the firs:
priority project. The existing overhead facilities within these limits consist of both distribution lines anc
transmission lines. Rule 20A funds currently available from Southern California Edison are sufficient to
fund only a portion of the underground costs for the transmission facilities. The remaining transmission
facilities and all distribution facilities will be funded with Rule 20B funds.
Ordinance No. 411 also requires the City to notify all affected property owners and all concerned utilities
by mail of the time and place of said hearings at least ten (10) days prior to the date of said hearing to
determine whether to form an underground utility district.
Resolution No. 03-91 sets the date of the Public Hearing for consideration of the establishment of
Underground Utility District Nos. 03-01 and 03-02 on Monday, November 17, 2003, at 7:00 P.M. in the
City Council Chambers, 300 Centennial Way.
It is proposed to fund Underground Utility District No. 03-01 with City of Tustin Rule 20B monies and to
fund Underground Utility District 03-02 with Rule 20A funds. A complete cost breakdown of both
proposed districts will be inclUded within the Engineer's Reports for District Nos. 03-01 and 03-02, which
will be available at least ten days prior to the public hearing date of November 17, 2003.
Based upon ongoing utility coordination meetings with the affected utility companies, it is anticipated that
both projects will take 18 months to complete which includes approximately 3 months for construction.
The construction will be coordinated with the construction of the Newport Avenue Extension, State
Route 55 Northbound Ramp Recenfiguration, Valencia Avenue and Del Amo Avenue Widening Project -
Phase I (CIP No. 7130) and the Edinger Avenue ("Smart Street") Widening Project (CIP No, 7147). The
roadway project schedule will include
construction of the underground facilities.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
SETTING A TIME AND PLACE FOR A PUBLIC HEARING TO CONSIDER THE
DESIGNATION AND ADOPTION OF UNDERGROUND UTILITY DISTRICT NOS. 03-
01 AND 03-02, REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES AND
ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE CITY OF
TUSTIN GENERALLY BOUNDED BY EDINGER AVENUE ON THE NORTH, THE
BURLINTON NORTHERN AND SANTA FE RAILROAD SPUR LINE EAST OF DEL
AMO AVENUE ON THE EAST, VALENCIA AVENUE ON THE SOUTH, AND STATE
ROUTE 55 ON THE WEST WHICH AREA IS MORE PARTICULARLY DESCRIBED
IN EXHIBIT "A" A'I-DACHED HERETO AND ON FILE IN THE OFFICE OF THE CITY
CLERK AND CITY ENGINEER OF THE CITY OF TUSTIN
WHEREAS, Ordinance No. 411 of the City of Tustin authorizes the City Council
from time to time to call Public Hearings to ascertain whether the public necessity,
health, safety or welfare requires the removal of poles, overhead wires and associated
overhead structures within certain designated areas of the City and to consider the
underground installation of the aforementioned appurtenances for supplying electric,
communication, or similar associated services and to establish an Underground Utility
District or Districts; and
WHEREAS, by the aforementioned Ordinance No. 411, the City Clerk is required to
notify all affected property owners, if any, as shown on the last equalized assessment
roll and also to notify all concerned utilities by mail of the time and place of hearings to
determine whether to form an underground utility district and of the availability of the
Engineer's Report of the details of the district in the office of the City Clerk prior to said
hearing; and
WHEREAS, said notice is required to be given to the aforementioned property
owners and concerned utilities at least ten (10) days prior to the date of the public
hearing; and
WHEREAS, the City Engineer has advised that the reports for both districts will be on
file in the office of the City Clerk at least ten (10) days prior to the date of the public
hearing; and
WHEREAS, the City Council has determined that a Public Hearing should be set on
November 17, 2003, at the hour of 7:00 P.M. in the City Council Chambers at 300
Centennial Way in the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that
said Council hereby sets Monday, November 17, 2003 at 7:00 P.M. in the City Council
Chambers at 300 Centennial Way in the City of Tustin, California, as the time and place
for a Public Hearing to ascertain whether the public necessity, health, safety or welfare
requires the removal of poles, overhead wires and associated overhead structures and
the establishment of Underground Utility District Nos. 03-01 and 03-02 within an area of
the City of Tustin generally bounded by Edinger Avenue on the north, the Burlington
Northern and Santa Fe railroad spur line east of Del Amo Avenue on the east, Valencia
Avenue on the south, and State Route 55 on the west as shown on a certain map on file
in the office of the City Clerk and the City Engineer of the City of Tustin.
BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized to notify all
affected property owners, if any, as shown on the last equalized assessment roll and to
also notify all utilities affected by this proposal by a notice through the United States
mail of the time and place of said Hearing, and of the availability of the Engineer's
Reports of the details of both districts in the office of the City Clerk prior to said Hearing,
ten (10) days prior to the date thereof.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin, California held on the 20th day of October 2003.
