Binsack, Zoning Administrator PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: None PUBLIC HEARING: Opened at 10:30 a.m. 1. CONDITIONAL USE PERMIT 2016-18 APPLICANT: Mike Elliott Compass Bible Church 140 Columbia Aliso Viejo, CA 92656 PROPERTY OWNER: Tustin Unified School District 300 South C Street Tustin, CA 92780 LOCATION: 17952 Beneta Way REQUEST: Establish a religious assembly use on public school property. ENVIRONMENTAL STATUS: This project is categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 16-012 approving Conditional Use Permit (CUP) 2016-18 to authorize the establishment of a religious assembly use at an existing public school site located at 17952 Beneta Way. The Zoning Administrator called the meeting to order. It was noted there were no members of the public present for this item. Mr. Steve Camp, representative for the applicant, was in attendance. Zoning Administrator Action Agenda November 1, 2016 Page 2 The Zoning Administrator stated she reviewed the staff report and did not have any questions nor did she need a presentation. She asked Mr. Camp if he had the opportunity to review the staff report and if he agreed with the Conditions of Approval, which he did. The Zoning Administrator approved ZAA 16-012. CONDITIONAL USE PERMIT 2016-22 APPLICANT: James Hurley Hurleylll Enterprise, LLC 16005 Legacy Road Tustin, CA 92782 PROPERTY OWNER: Jeffrey Mayhem Strata Tustin, LLC 4631 Teller Avenue, Suite 150 Newport Beach, CA 92660 LOCATION: 14075 Newport Avenue REQUEST: To sell alcoholic beverages (ABC Type 41 License) for the on-site consumption of beer and wine in conjunction with an existing restaurant. ENVIRONMENTAL STATUS: This project is categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 16-013 approving Conditional Use Permit (CUP) 2016-22 to authorize an ABC Type 41 License for the sale of alcoholic beverages (beer and wine) for on-site consumption in conjunction with an existing restaurant establishment (Chronic Tacos) located at 14075 Newport Avenue. The Zoning Administrator called the meeting to order. It was noted there were no members of the public present for this item. The applicant, Mr. James Hurley, was in attendance. The Zoning Administrator stated she reviewed the staff report and did not have any questions nor did she need a presentation. She asked Mr. Hurley if he had an Zoning Administrator Action Agenda November 1, 2016 Page 3 opportunity to review the staff report and if he agreed with the Conditions of Approval, which he did. The Zoning Administrator asked the Assistant Planner, Jessica Aguilar to make one (1) minor amendment to #12 of the Land Use Fact Sheet (which was part of the staff report) with regards to the number of parking spaces (add an additional column identifying the number of parking spaces for this project). The Zoning Administrator also asked if the applicant agreed with the Conditions of Approval, which he did. The Zoning Administrator approved ZAA 16-013. Closed Public Hearing Item #2 at 10:41 a.m. REGULAR BUSINESS: None ADJOURNMENT: 10:41 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
