Three locations have recently been deleted from any required conversion cost due to finalization of the utility c(~pany plans. The cost of these se~;ice conversions will be borne by the City initially and will be ultimately collected fr~ each pr_c~erty o',~er over a ten (10) year period via an assessment district at a raxim~m rate of interest of 7% per year. If a property owner elects to pay ~e entire ~mo~Lnt at the time the conversion is completed, th~v · ay do so at ~at t~r~. The Engineer's estLma~e for ~Sis project is $50,360.00. City 1 2 3 4 § 6 ? 9 10 11 12 13 1§ 16 17 19 !! £9 30 RESOLUTION NO. 81- 41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR ELECTRIC AND TELEPHONE UTILITY SERVICE CONVERSIONS WITHIN THE EL CAMINO REAL UNDERGROUND UTILITY DISTRICT NO. 5 AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. WHEREAS, it is the intention of the Tustin City Council of the City of Tustin, California, to convert certain electric and telephone facilities to underground; and WHEREAS, the City Engineer has presented plans and specifications for the performance of said conversions; and WHEREAS, said plans and specifications contain a liquidated damages clause providing for the payment of damages in the amount of $100 per calendar day in the event that the contractor, contracting owners included, does not complete the ~ork within the time limit specified in the contract or with such further time as the City Council authorizes; NOW~ THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer be and a~e hereby aplcroved as the plans and specifications for: ELECTRIC AND TELEPHONE UTILITY SERVICE CONVERSIONS WITHIN THE EL CAMINO REAL UNDERGROUND UTILITY DISTRICT NO. 5 BE IT FURTHER RESOLVED that the liquidated damages clause contained in said plans and specifications is adopted and approved. Plans and specifications will only be mailed out upon payment of $15.00 per set, which amount shall be nonrefundable. In conformance with Section 5242 of the California Streets and Highways Code, all bids shall be accompanied by cash, a cashier's check or a certified check payable to the City of Tustin, for an amount which shall not be less than 10 percent of the aggregate of the proposal or by a bond for that amount and so payable, signed by the bidder and two sureties, who shall justify, before any officer competent to administer an oath, in double that amount, and over and above ail ~+,~ ..... exemptions, or by a corporate surety bond to the satisfac%i©n and approval of the City Engineer. ~.r~ ~3~'37~sa~ or bid shall be considered unless accom anied ~¥ the c'n~ci' cr bond satisfactory to the City Council. ~ '(~!i~sy Council may reject any and all proposals or bids shc~.~ 55 deem this for the public good, and also the bid of any party who has been delinquent or unfaithful in any former ~o~ract with the City. The City Council also reserves the right to waive any informality on abid. No bidder may withdra%~ his bid for a period of thirty (30) days after the date set for the opening thereof, The contra~t will be awarded to the lowest qualified bidder. A security bond for payment of labor and materials will be required in the amount of fifty percent (50%) of the estimated total contract price. In addition, the contractor 32 -4- 5 ? 8 9 10 11 15 17 g8 shall, at the time of executing the contract for the work, execute either a corporate surety bOnd or a bond to the satisfaction and approval of the City Engineer, with two or more individual sureties and payable to the City, in a sum not less that 100 percent of the amount of the contract, conditioned upon the Faithful Performance of the contract; and the sureties shall justify before any person competent to administer an oath, in the amount mentioned in the bond, over and above all statutory exemptions. Pursuant to Section 5256 of the California Streets and Highways Code the City Council hereby waives the payment in advance of all of the incidental expenses incurred up to the time of entering into the contract. Provisions of the California State Contract Act are not applicable, and prospective bidders will not be required to be prequa!ified. Pa-,-~ent for all work will be advanced by the City of Tustin tz~ ~ke sz. ntractor on behalf of the affected property owners. Said owners will be assessed in the approximate amounts and in the manner described in Resolution No. 81-14. The City Council has obtained from the Director of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which the work is to be performed for each craft or type of work needed and a copy of the same is on file in the office of the City Clerk.
