Location: 301W. First St.
A Variance ~pplication was filed by AT~n Albright to vary with the
required ten foot front setback along First Street and ten foot
sidewalk setback along '~" Street. The applicant proposed azero lot
line setback for the front and sideyard setback.
The Planning Agency denied the variance, 3-2, .at the December 1, 1980
mccting. The applicant appealed the decision to the City Council.
At the January 19, 1981 meeting of the City Council, the Council
overruled the findings of the PlanningAgency and approved the project
subject to the condition that the proposed buildings at 301W. First
Street conform to the front setback for 215 West First Street. After
reviewing the Planning file for 215 West First Street, it w~s
determined that the structural front setback for 215 West First street
is ~en feet. A variance (71-279) was applied for to v~ry with this
ten foot requirement, but was denied. There is a 5'6" second story
overhang that runs the entire lenght of the First Street elevation,
and visually gives the appearance that the building is closer to the
sidewalk than it actually is.
Staff is requesting further clarification regarding the front yard
setback for the proposed project at 301W. First Street. Should staff
apply the structural setback of the ten feet as the standard to
confom to, or allc~ the development at 301 W. First Street to
encrouch the distance equal to the second story overhang, which is
5'6"?
