Fleagle, C~auanity Development Consultant Holt-I~gr~la Annexation No. 127 The Local Agency Formation Conm~ssion authorized the City Council to be the conducting authority for processing the Holt-Mau~.laAnnexation No. 127. This is an uninhabited annexation with less than unanimous consent which will require conducting a pretest hearing. A hearing has bccn scheduled for the council session starting after 3:00 P.M., on April 20,1981. There are four property ownerswithin the proposed annexation area, and three have given consent to the annexation. By letter, copy attached, I am informing the protesting property owner of her right to file a written protest to the annexation ..... Patterson: The City Council has scheduled a protest hearing on the proposed annexation of your property to the City of Tustin on April 20, 1981. Tb~ hearing will be scheduled for the regular Council meeting session following the Planning Agency ~ctin~ at 3:00 P.M. Since there are leas than 12 registered voters within the territory proposed for annexation, only those property o~mers such as yourself within the are~ to be annexed have a right to file a protest. The City Council is required to approve the annexation if written protests are filed by owners of the land and improvements who own less than 50 precent of the total assessed value of land and Improvements within the territory. You~y file a written protest against the annexation with the City Clerk at any time prior to the close of the hearing. The protest should identify the property by address nnM the legal owner. This is the first' protest hearlngpertatning to the annexation that bmgbeen scheduled for public hearing by the City Council. Previous P~arings were related to the pre-zoning of the area. Although yom were aware of the Planning Agency hearing on the pre-zoning and did not voice a protest at that time, I am certain that the City Council would consider a request from you to retain the E-4 zoning on your ?_~cel. Pmm~la, Edward C. Abt and Roy Standard for the annexation of 3.8 acres located on the easterly side of Bolt Avenue from a point 1154 feet northerly of the centerline of Irvine Boulevard to a point 9.92 feet southerly of Warren Avenue to the City of Tusttn for the purpose of gaining full municipal services of the city; and Whereas, the City Council by Resolution No. 80-114 agrc~ to the exchange of property taxes with the County of Orange for said annexation and consented to the processin~ of said annexation by the Local Agency Fo£~tion Co~,tssion; and Whereas, the Local Agency Foz~tion Coew. ission conducted a public hearing on Narch 11, 1981 and authorized the City Council of Tustin to be the conducting authority to initiate .nnexation proc~"cdings for the proposed uninhabited area; NOW THER~O~ RE, BE IT RESOLVED by the City Council, City of Tustin, California: That a public hearing on the proposed Holt-Pmm~la Annexation No. 127 to the City of Tustin will be conducted on April 20, 1981 at $:00 P.M. or as soon thereafter as the City Council meets in regular session on that date, in the Council Cbsmhers, S00 Centennial Way, Tustin. That any owner of land within the territory may file a written protest against the annexation, with the City Clerk of Tustin at any time prior to the conclusion of the City Oouncil hearing on the proposed annextion. That the City Clerk shall cause notice of hearing on the proposed annexation to he ~iven as required by law · PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the day of , 1981.
