Refund of Parking District Fees
Planning staff has received a request from the owners of the
Los Anesentes Building, 220 E1 Camino Real, for a refund of the
parking district fees which were paid at the time of building permit
issuance. This request is being made because the Los Anesentes
Partnership has been leasing parking spaces for its use from the
adjoining Sunset Office Building, 224 E1Camino Real.
After researching the parking demands of the Sunset Building, it
appears to have thirteen (13) excess spaces for the professional
uses. The extra spaces were planned, however, by the owners to enable
the first floor to be used for retail commercial uses. Currently, all
of the tenants occupying the Sunset Building are professional
businesses.
The Los Anesentes Partnership paid into the Parking District for 26
spaces. If the City Council authorizes a refund for thirteen (13)
leased spaces, the refund would amount to $7,592. The following
conditions should be placed upon such a refund of parking district
fees:
A letter of agreement, to be approved by the city attorney in
which it is understood that the authority to operate the Los
Anesentes Building as a retail structure is dependent upon the
continued leasing of the thirteen (13) parking spaces. Also, that
upon termination of such lease that the repayment of the Parking
District fee will be calculated at the schedule in effect at the
time the fee is required. As a result, the fee will probably be
greater than.what the refund will be.
That due to the lack of parking accommodations, the Sunset
development should not be authorized for retail commercial
businesses.

Dear Mr. Warren:
As per our previous correspondences and specifically
the requirements set out in your letter of September
30, 1980, we are submitting the following information
in support of the possible refund of the PARKING DISTRICT
FEES.
I. Enclosed please find a letter from the owners
of the Sunset building.
2. We understand that the authority to operate
the Los Anesentes building as a retail
structure is dependent upon the continual
leasing of the 13 parking spaces. We also
understand that upon termination of such lease
that the repayment of the parking district fee
will be calculated at the schedule in effect
at the time the fee is required.
3. We are therefore requesting a refund of monies
paid into this parking fund.
