CONSULTANT SERVICES AGREEMENT
This Agreement for Consultant Services (herein "Agreement"), is made and entered
into by and between the CITY OF TUSTIN, a municipal corporation ("City"), and Interwest
Consulting Group ("Consultant").
WHEREAS, Consultant is qualified to provide the necessary services and has
agreed to provide such services; and
WHEREAS, Consultant has submitted to City a proposal, dated October 5, 2016, a
copy of which is attached hereto as Exhibit "A", and is by this reference incorporated
herein as though set forth in full hereto (the "Proposal').
NOW, THEREFORE, in consideration of the premises and mutual agreements
contained herein, City agrees to employ and does hereby employ Consultant and
Consultant agrees to provide consulting services as follows:
SERVICES OF CONSULTANT
1.1 Scope of Services. In compliance with all terms and
conditions of this Agreement, Consultant shall provide those services
specified in the "Proposal and Scope of Services" attached hereto as
Exhibit "A" and incorporated herein by this reference, (the "services"
or the "work"). Consultant warrants that all services shall be
performed in a competent, professional and satisfactory manner in
accordance with all standards prevalent in the industry. In the event
of any inconsistency between the terms contained in Exhibit "A" and
the terms set forth in the main body of this Agreement, the terms set
forth in the main body of this Agreement shall govern.
1.2 Compliance with Law. All services rendered hereunder
shall be provided in accordance with all laws, ordinances, resolutions,
statutes, rules, and regulations of the City of Tustin and of any
federal, state or local governmental agency of competent jurisdiction.
1.3 Licenses and Permits. Consultant shall obtain at its
sole cost and expense such licenses, permits and approvals as may
be required by law for the performance of the services required by
this Agreement.
1.4 Familiarity with Work. By executing this Contract,
Consultant warrants that Consultant (a) has thoroughly investigated
and considered the work to be performed, (b) has investigated the
site of the work and become fully acquainted with the conditions there
existing, (c) has carefully considered how the work should be
performed, and (d) fully understands the facilities, difficulties and
restrictions attending performance of the work under this Agreement.
Should the Consultant discover any latent or unknown conditions

materially differing from those inherent in the work or as represented
by the City, Consultant shall immediately inform City of such fact and
shall not proceed with any work except at Consultant's risk until
written instructions are received from the Contract Officer.
1.5 Care of Work. Consultant shall adopt and follow
reasonable procedures and methods during the term of the
Agreement to prevent loss or damage to materials, papers or other
components of the work, and shall be responsible for all such
damage until acceptance of the work by City, except such loss or
damages as may be caused by City's own negligence.
1.6 Additional Services. Consultant shall perform services
in addition to those specified in the Proposal when directed to do so
in writing by the Contract Officer, provided that Consultant shall not
be required to perform any additional services without compensation.
Any additional compensation not exceeding ten percent (10%) of the
original Contract sum must be approved in writing by the Contract
Officer. Any greater increase must be approved in writing by the City
Manager.
1.7 Special Requirements. Any additional terms and
conditions of this Agreement, are set forth in Exhibits "B" and "C" and
are incorporated herein by this reference. In the event of a conflict
between the provisions of Exhibit "B" and "C" and any other provision
or provisions of this Agreement including Exhibit A, the provisions of
Exhibits "B" and "C" shall govern.
2. COMPENSATION
2.1 Compensation of Consultant. For the services
rendered pursuant to this Agreement, the Consultant shall be
compensated and reimbursed only such amount as are prescribed in
Exhibit C, in an amount not to exceed those fees.
2.2 Method of Payment. In any month in which Consultant
wishes to receive payment, Consultant shall no later than the first
working day of such month, submit to City in the form approved by
City's Director of Finance, an invoice for services rendered prior to
the date of the invoice. City shall pay Consultant for all expenses
stated thereon which are approved by City consistent with this
Agreement, no later than the last working day of said month.
2.3 Changes. In the event any change or changes in the
work is requested by City, the parties hereto shall execute an
addendum to this Agreement, setting forth with particularity all terms
of such addendum, including, but not limited to, any additional
Consultant's fees. Addenda may be entered into:

A. To provide for revisions or modifications
to documents or other work product or work when documents
or other work product or work is required by the enactment or
revision of law subsequent to the preparation of any
documents, other work product or work;
B. To provide for additional services not
included in this Agreement or not customarily furnished in
accordance with generally accepted practice in Consultant's
profession.
2.4 Payment for Changes. Changes approved pursuant to
an Addendum shall be compensated at the personnel hourly rates
prescribed in Exhibit "C" hereto. Note: Exhibit "C" prohibits billing for
travel.
3. PERFORMANCE SCHEDULE
3.1 Time of Essence. Time is of the essence in the
performance of this Agreement.
3.2 Schedule of Performance. All services rendered
pursuant to this Agreement shall be performed within any time
periods prescribed in any Schedule of Performance attached hereto
marked Exhibit "D". The extension of any time period specified in the
Exhibit "D" must be approved in writing by the Contract Officer.
3.3 Force Majeure. The time for performance of services to
be rendered pursuant to this Agreement may be extended because of
any delays due to unforeseeable causes beyond the control and
without the fault or negligence of the Consultant, including, but not
restricted to, acts of God or of a public enemy, acts of the
government, fires, earthquakes, floods, epidemic, quarantine
restrictions, riots, strikes, freight embargoes, and unusually severe
weather if the Consultant shall within ten (10) days of the
commencement of such condition notify the Contract Officer who
shall thereupon ascertain the facts and the extent of any necessary
delay, and extend the time for performing the services for the period
of the enforced delay when and if in the Contract Officer's judgment
such delay is justified, and the Contract Officer's determination shall
be final and conclusive upon the parties to this Agreement.
3.4 Term. Unless earlier terminated in accordance with
Section 7.7 of this Agreement, the term of the Consultant contract will
be for three (3) years, beginning on the effective date of the
agreement. The agreement may be extended up to two additional
one (1) year periods by mutual agreement of the parties subject to
Community Development Department Director approval. Rates for
services agreed to and established in the contract shall not be

amended without the express consent of the Community
Development Department Director.
4. COORDINATION OF WORK
4.1 Representative of Consultant. The following Principal
of the Consultant is hereby designated as being the principal and
representative of Consultant authorized to act in its behalf with
respect to the work specified herein and make all decisions in
connection therewith: James M. Guerra, CBO.
It is expressly understood that the experience,
knowledge, capability and reputation of the foregoing Principal is a
substantial inducement for City to enter into this Agreement.
Therefore, the foregoing Principal shall be responsible during the
term of this Agreement for directing all activities of Consultant and
devoting sufficient time to personally supervise the services
hereunder. The foregoing Principal may not be changed by
Consultant without the express written approval of City.
4.2 Contract Officer. The Contract Officer shall be the
Director of Community Development of City unless otherwise
designated in writing by the City Manager of City. The Co -Contract
Officer shall be the Assistant Director of Community Development. It
shall be the Consultant's responsibility to keep the Contract Officer, or
the Co -Contract Officer in the Contract Officer's absence, fully
informed of the progress of the performance of the services and
Consultant shall refer any decisions which must be made by City to
the Contract Officer. Unless otherwise specified herein, any approval
of City required hereunder shall mean the approval of the Contract
Officer or the Co -Contract Officer.
4.3 Prohibition Against Subcontracting or Assignment. The
experience, knowledge, capability and reputation of Consultant, its
principals and employees were a substantial inducement for the City
to enter into this Agreement. Therefore, Consultant shall not contract
with any other entity to perform in whole or in part the services
required hereunder without the express written approval of the City.
In addition, neither this Agreement nor any interest herein may be
assigned or transferred, voluntarily or by operation of law, without the
prior written approval of City.
4.4 Independent Contractor. Neither the City nor any of its
employees shall have any control over the manner, mode or means
by which Consultant, its agents or employees perform the services
required herein, except as otherwise set forth herein. Consultant
shall perform all services required herein as an independent
contractor of City and shall remain at all times as to City a wholly
independent contractor with only such obligations as are consistent

with that role. Consultant shall not at any time or in any manner
represent that it or any of its agents or employees are agents or
employees of City. Consultant shall be solely responsible for
compliance with State and Federal Law with respect to the wages,
hours, benefits, and working conditions of its employees, including
requirement for payroll deductions for taxes. Employees or
independent contractors of Consultant are not City employees.
5. INSURANCE / INDEMNIFICATION
5.1 Insurance.
A. Consultant shall maintain in full force and
effect during the term of these Agreement policies of
commercial general liability and automobile liability insurance
(each of which shall include property damage and bodily
injury) and each with limits of at least $1,000,000 combined
single limit coverage per occurrence.
B. Consultant shall maintain in full force and
effect during the term of this Agreement a policy of
professional liability insurance coverage with limits of at least
$1,000,000 combined single limit coverage per claim or per
occurrence. If Consultant provides claims made professional
liability insurance, Consultant shall also agree in writing either
(1) to purchase tail insurance in the amount required by this
Agreement or to cover claims made within five (5) years of the
completion of Consultant's service under this Agreement, or
(2) to maintain professional liability insurance coverage with
the same carrier in the amount required by this Agreement for
at least five (5) years after completion of Consultant's services
under this Agreement. Consultant shall also provide evidence
to the City of the purchase of the required tail insurance or
continuation of the professional liability policy by executing the
attached Letter Agreement on Consultant's letterhead.
C. Consultant shall carry and pay for such
workers' compensation insurance as is required fully protect
Consultant and its employees under California Worker's
Compensation Insurance Law. The insurance company shall
agree to waive all rights of subrogation against the City for
losses paid under the policy, which losses arose from the work
performed by the named insured.
D. Other applicable insurance requirements
are: (1) Name the City, its officials and employees as an
additional insured on the commercial, general and automobile
policies. (2) The insurance shall be issued by a company
authorized by the Insurance Department of the State of

California and rated A, VII or better (if an admitted carrier) or
A-, X (if offered, by a surplus line broker), by the latest edition
of Best's Key Rating Guide, except that the City will accept
workers' compensation insurance rated B -VIII or better or from
the State Compensation Fund. (3) The Insurance shall not be
cancelled, except after thirty (30) days written prior notice to
the City; and (4) The commercial general and automobile
liability insurance shall each be primary as respects the City,
and any other insurance maintained by the City shall be in
excess of this insurance and not contribute to it.
E. Upon execution of this Agreement,
Consultant shall provide to City certificates of insurance and
insurer endorsements evidencing the required insurance.
Insurer endorsements (or a copy of the policy binder if
applicable) shall be provided as evidence of meeting the
requirements of Subsections (1), (3) and (4) of Section D
above and the waiver of subrogation requirement in Section C
above. If self-insured for worker's compensation, Consultant
shall submit to City a copy of its certification of self-insurance
issued by the Department of Industrial Relations.
5.2 Indemnification. The Consultant shall defend,
indemnify and hold harmless the City, its officers and employees,
from and against any and all actions, suits, proceedings, claims,
demands, losses, costs, and expenses, including legal costs and
attorneys' fees, for injury to or death of person or persons, for
damage to property, including property owned by City, arising from
errors and omissions of Consultant, its officers, employees and
agents, and arising out of or related to Consultant's performance
under this Agreement, except for such loss as may be caused by
City's sole negligence or that of its officers or employees.
The Consultant shall also defend, indemnify and hold
the City harmless from any claims or liability for City health and
welfare, retirement benefits, or any other benefits of part-time or
fulltime City employment sought by Consultant's officers, employees,
or independent contractors, whether legal action , administrative
proceeding or pursuant to State statue.
6. RECORDS AND REPORTS
6.1 Reports. Consultant shall periodically prepare and
submit to the Contract Officer such reports concerning the
performance of the services required by this Agreement as the
Contract Officer shall require.
6.2 Records. Consultant shall keep such books and
records as shall be necessary to properly perform the services

required by this Agreement and enable the Contract Officer to
evaluate the performance of such services. The Contract Officer
shall have full and free access to such books and records at all
reasonable times, including the right to inspect, copy, audit and make
records and transcripts from such records.
6.3 Ownership of Documents. All drawings, specifications,
reports, records, documents and other materials prepared by
Consultant in the performance of this Agreement shall be the property
of City and shall be delivered to City upon request of the Contract
Officer or upon the termination of this Agreement, and Consultant
shall have no claim for further employment or additional
compensation as a result of the exercise by City of its full rights or
ownership of the documents and materials hereunder. Consultant
may retain copies of such documents for its own use. Consultant
shall have an unrestricted right to use the concepts embodied therein.
6.4 Release of Documents. All drawings, specifications,
reports, records, documents and other materials prepared by
Consultant in the performance of services under this Agreement shall
not be released publicly without the prior written approval of the
Contract Officer.
7. ENFORCEMENT OF AGREEMENT
7.1 California Law. This Agreement shall be construed and
interpreted both as to validity and to performance of the parties in
accordance with the laws of the State of California. Legal actions
concerning any dispute, claim or matter arising out of or in relation to
this Agreement shall be instituted in the Superior Court of the County
of Orange, State of California, or any other appropriate court in such
county, and Consultant covenants and agrees to submit to the
personal jurisdiction of such court in the event of such action.
7.2 Disputes. In the event of any dispute arising under this
Agreement, the injured party shall notify the injuring party in writing of
its contentions by submitting a claim therefor. The injured party shall
continue performing its obligations hereunder so long as the injuring
party cures any default within ninety (90) days after service of the
notice, or if the cure of the default is commenced within thirty (30)
days after service of said notice and is cured within a reasonable time
after commencement; provided that if the default is an immediate
danger to the health, safety and general welfare, the City may take
immediate action under Section 7.6 of this Agreement. Compliance
with the provisions of this Section shall be a condition precedent to
any legal action, and such compliance shall not be a waiver of any
party's right to take legal action in the event that the dispute is not
cured.

7.3 Waiver. No delay or omission in the exercise of any
right or remedy of a non -defaulting party on any default shall impair
such right or remedy or be construed as a waiver. No consent or
approval of City shall be deemed to waive or render unnecessary
City's consent to or approval of any subsequent act of Consultant.
Any waiver by either party of any default must be in writing and shall
not be a waiver of any other default concerning the same or any other
provision of this Agreement.
7.4 Rights and Remedies are Cumulative. Except with
respect to rights and remedies expressly declared to be exclusive in
this Agreement, the rights and remedies of the parties are cumulative
and the exercise by either party of one or more of such rights or
remedies shall not preclude the exercise by it, at the same or different
times, of any other rights or remedies for the same default or any
other default by the other party.
7.5 Legal Action. In addition to any other rights or
remedies, either party may take legal action, in law or in equity, to
cure, correct or remedy any default, to recover damages for any
default, to compel specific performance of this Agreement, to obtain
injunctive relief, a declaratory judgment or any other remedy
consistent with the purposes of this Agreement.
7.6 Termination Prior to Expiration of Term. The City
reserves the right to terminate this Agreement at any time, with or
without cause, upon thirty (30) days written notice to Consultant,
except that where termination is due to the fault of the Consultant and
constitutes an immediate danger to health, safety and general
welfare, the period of notice shall be such shorter time as may be
appropriate. Upon receipt of the notice of termination, Consultant
shall immediately cease all services hereunder except such as may
be specifically approved by the Contract Officer. Consultant shall be
entitled to compensation for all services rendered prior to receipt of
the notice of termination and for any services authorized by the
Contract Officer thereafter.
7.7 Termination for Default of Consultant. If termination is
due to the failure of the Consultant to fulfill its obligations under this
Agreement, City may take over the work and prosecute the same to
completion by contract or otherwise, and the Consultant shall be
liable to the extent that the total cost for completion of the services
required hereunder exceeds the compensation herein stipulated,
provided that the City shall use reasonable efforts to mitigate
damages, and City may withhold any payments to the Consultant for
the purpose of set-off or partial payment of the amounts owed to City.
7.8 Attorneys Fees. If either party commences an action
against the other party arising out of or in connection with this

Agreement or it subject matter, the prevailing party shall be entitled to
recover reasonable attorneys' fees and costs of suit from the losing
party.
8. CITY OFFICERS AND EMPLOYEES; NON-DISCRIMINATION
8.1 Non -Liability of City Officers and Employees. No officer
or employee of City shall be personally liable to the Consultant, or
any successor -in -interest, in the event of any default or breach by the
City or for any amount which may become due to the Consultant or
its successor, or for breach of any obligation of the terms of this
Agreement.
8.2 Covenant Against Discrimination. Consultant
covenants that, by and for itself, its heirs, executors, assigns, and all
persons claiming under or through them, that there shall be no
discrimination or segregation in the performance of or in connection
with this Agreement regarding any person or group of persons on
account of race, color, creed, religion, sex, marital status, national
origin, or ancestry. Consultant shall take affirmative action to insure
that applicants and employees are treated without regard to their
race, color, creed, religion, sex, marital status, national origin, or
ancestry.
9. MISCELLANEOUS PROVISIONS
9.1 Notice. Any notice, demand, request, consent,
approval, or communication either party desires or is required to give
to the other party or any other person shall be in writing and either
served personally or sent by pre -paid, first-class mail to the address
set forth below. Either party may change its address by notifying the
other party of the change of address in writing. Notice shall be
deemed communicated forty-eight (48) hours from the time of mailing
if mailed as provided in this Section.

9.2 Integrated Agreement. This Agreement contains all of
the agreements of the parties and cannot be amended or modified
except by written agreement.
9.3 Amendment. This Agreement may be amended at any
time by the mutual consent of the parties by an instrument in writing.
9.4 Severability. In the event that any one or more of the
phrases, sentences, clauses, paragraphs, or sections contained in
this Agreement shall be declared invalid or unenforceable by valid
judgment or decree of a court of competent jurisdiction, such
invalidity or unenforceability shall not affect any of the remaining
phrases, sentences, clauses, paragraphs, or sections of this
Agreement, which shall be interpreted to carry out the intent of the
parties hereunder.
9.5 Corporate Authority. The persons executing this
Agreement on behalf of the parties hereto warrant that they are duly
authorized to execute this Agreement on behalf of said parties and
that by so executing this Agreement the parties hereto are formally
bound to the provisions of this Agreement.

RE: Request for Proposal to Provide As -Needed Building Inspection & Plan Check Services
Interwest Consulting Group is honored to present this proposal to the City of Tustin to provide as -needed plan check and
building inspector services. We are a corporation that is large enough — over 280 professionals — to serve all of your
building & safety needs, yet small enough to ensure that we maintain focus and are responsive to the needs of the
City of Tustin.
Our highly qualified staff will provide plan check review of construction drawings to ensure compliance with City adopted
Building Codes and related State and Municipal Code requirements. We can also provide building inspection services and
other contract services as requested by the City. Our personnel have direct experience serving municipal clients and are
equipped to make policy recommendations and address challenging plan check, inspection and code enforcement
interpretation issues. Our goal is to provide timely, technically sound, and customer -friendly services to support your
building department and development community.
Interwest provides building and safety plan check and inspection, fire prevention plan check and inspection, municipal
engineering, and traffic engineering services to public agencies throughout California. Our proposed team provides the full
spectrum of the required services efficiently and effectively. We do not anticipate using any subcontractors during the
course of this engagement.
We are unaware of any conflict of interest in performing the proposed work for the City of Tustin.

check assistance, building inspection, and planning services. We are excited for the opportunity to continue to
develop and strengthen our relationship with the City.
After reviewing the RFP, we propose to continue providing, the City with the following three services:

Building Plan Check Services
Today's fast -paced marketplace demands projects flow quickly and smoothly through the regulatory approval
process. We fully understand this critical component. You'll find our people are ready to assist with solutions and
recommendations that are specific to your needs.
Plan Review Services include the following elements:
✓ Plan review project plans, construction documents and revisions in conformance with the appropriate ICC,
state and local codes and amendments currently in progress of being adopted to take effect on January 1,
2017. These codes include: the 2016 California Building Code; Title 24 disabled access and energy
requirements; 2016 California Fire Code with OCFA amendments; 2016 California Residential Code; 2016
California Mechanical Code; 2016 California Plumbing Code; 2016 California Electrical Code; 2016 Cal Green
Building Code and the City's ordinances and regulations.
✓ Coordination of plan reviews with other City departments or agencies with jurisdictions and ensure all relevant
Conditions of Approval are met. .
/ Maintain records related to all plans, calculation and documents received. We will provide, in the City's
approved format, a complete list of plan check comments referring to appropriate sheets, details or
calculations pages and the code section of concern. Plan review lists shall bear the stamp and signature of a
licensed engineer when required

✓ Meet and confer with permit applicants to resolve all outstanding plan review comments and approving their

Code Interpretations
Code interpretations are subject to final review and approval by the Building Official and/or City designated staff.
Interwest Consulting Group's engineers and plans examiners will provide unbiased recommendations and
background information to help the Building Official make an informed decision. All plan review comments are subject
to review and approval by the Building department.
Communicating Plan Review Results
Plan reviews will consist of written comments and redlined plans (2 copies). Comments and redlined plans or
approval/denial letter and 1 set of plans will be returned to the City after each review is completed.
Specifically, plan reviews, when not immediately approved, will result in lists of comments referring to specific details
and drawings, and referencing applicable code sections. Interwest Consulting Group will provide a clear, concise,
and thorough comment list from which clients, designers, contractors, and owners can work. Comment lists are
delivered to our clients and other designated recipients (e.g., designers, contractors, owners) via email, FAX, and/or
reliable overland carrier. If requested, Interwest Consulting Group will transmit plan review comments, coordinate re-
checks directly to the applicant as required, and return completed plan review documents to the City for final
approval,

On -Site Consultant Services & Meeting Attendance
Interwest Consulting Group understands the City may require the services of an onsite plan reviewer from time to
time. We have full-time staff of experienced plan reviewers and licensed architects, structural and civil engineers
available to perform on-site plan review when requested. Also, many of our inspection personnel are cross -trained
and skilled in performing both front counter and inspection duties as a potential added cost -savings to the City.
In addition, staff is available for pre -construction or pre -design meetings, field visits, contacts with the design team,
and support for field inspection personnel as -needed. With some reasonable limitations, pre -construction and pre -
design meetings associated with projects that we plan review are considered part of the plan review service.
Electronic Plan Check Services
Interwest Consulting Group currently provides electronic permitting and plan review services for multiple
jurisdictions.
Our belief is that the City should retain ownership of whatever system is put in place so that you control your service
delivery options in the future and do not become too dependent on one particular service provider.

Plan Review Tracking Method & Billing Process
Our staff has experience working with most project tracking databases utilized by building departments. Our staff will
update electronic records and make project related database entries as directed by the City.
Interwest Consulting Group uses a custom-designed database to maintain and track all plans throughout the review
process from the moment you request a pick-up and/or shipment to delivery of the final, approved documents.
Information such as project name, City's project number, assigned plan reviewer(s), date documents were received,
plan check cycle and completion date for current review can be provided. In addition to standard phone
communication, custom reports can be emailed. In addition, we can provide online tracking for the City with a
custom-designed web template geared to provide any reporting and information needs required.
Our staff is available during standard business hours to answer questions via phone or email regarding the actual
plan check in progress. We maintain active email accounts and our staff will be responsive to any City or applicant
needs. If we cannot speak directly to a caller, we will return calls in no later than 24 hours.
Customer Service
Interwest emphasizes superior customer service to all of our employees. We take an out-of-the-box approach to
performing our duties, always willing to meet with clients for pre -design meetings, pre -submittal meetings or as
needed to resolve complex code related plan check issues in the most efficient manner possible. Additionally, our
staff brings a can -do attitude to their work—always focused on efficient plan check processes and successful project
outcomes.
Interwest Consulting Group's engineers, architects, plans examiners and inspectors understand the importance of
providing superior customer service to applicants, contractors and designers. Our philosophy is to provide our
services in a professional, courteous and collaborative manner. We encourage our staff to worts as part of the project
team to ensure successful project outcomes.
Special Projects
Interwest Consulting Group is able to accommodate special project plan check needs such as fast-track, multi -
phased, or expedited plan checks. We establish project specific tum -around goals and procedures with jurisdiction
staff for these types of projects based on the complexity of the projects as well as the construction schedule.
Interwest Consulting Group's staff of engineers and plans examiners will work with the City as well as with applicants
and designers to resolve all plan check issues. Our staff will deal directly with applicants and their designers during
the plan check process to resolve all issues. Interwest Consulting Group will furnish assigned personnel with all

materials, resources and training necessary to conduct plan checks, including a current copy of the applicable City
amendments, policies, procedures and forms.
Technical Capabilities
The Interwest staff members selected for this project possess significant technical capabilities in all of the requested
areas of plan check competence. In addition to the summary below and the individual staff resumes included in the
appendix provides additional information on the firm's capabilities.
CASp
Interwest Consulting Group has Certified Access Specialists (CASp) on staff, knowledgeable of state and federal
accessibility laws and regulations and possessing the expertise necessary to promote access to facilities for
persons with disabilities. In accordance with newly -formed rules and regulations, we will supply a CASp
professional to review all plans for accessibility and will comply with regulations to provide a sufficient number of
CASp building inspectors.
We offer support to municipalities for compliance enforcement and/or developing a transition plan, and
successfully partner with the disabled community to address the needs and requirements for both entities. We can
assist municipal departments, government agencies and local communities to explain various issues relating to
access compliance, such as access compliance obligations, transition planning, construction costs, construction
phasing, code/law'interpretation,' hardship and codeflaw changes.
Green Building Standards
Our staff is familiar with the incorporation of CalGreen building concepts into project designs and its potential
impact from the building code. In addition, staff members have participated in the development of various "green"
standards for super adobe, rammed earth, and straw bale construction, to name a few. We have also reviewed
'straw bale" constructed homes.
LEED
Developed by the US Green Building Council (USGBC), LEED provides building owners and operators a
framework for identifying and implementing measurable green building design, construction, operations and
maintenance solutions. LEED certification consists of a number of different rating systems that apply to many
building types --commercial as well as residential and measures how well a building performs across many
sustainability metrics including: energy savings, water efficiency, CO2 emissions reduction, improved indoor
environmental quality, and stewardship of resources and sensitivity to their impacts. Whether your jurisdiction

Building Inspection Services
Interwest Consulting Group tailors inspection services to the particular needs of each client with special attention to
providing competent, consistent service at all levels—at all times. We handpick our candidates and identify skill levels
required to best match the City's inspection goals and philosophy. All Interwest inspectors are ICC certified and are
fully qualified to perform residential, commercial, industrial and mixed-use project inspection for compliance to
approved plans and related documents. All inspections will be performed in accordance with the City's adopted
version of the California Building Code, California Residential Code, California Green Building code, California
Mechanical Code, California Pluming Code, California Electrical Code and the Accessibility, Noise and Energy
Conservation requirements as mandated by State Title 24 and all applicable City of Tustin Ordinances.
Interwest staff has performed inspection services on a wide variety of construction projects including custom homes,
large residential developments, and commercial, institutional & essential service buildings. We provide valuable
experience gained through successful work with government clients throughout California. This clear understanding
of the construction process enables our people to quickly identify & resolve problems both in the office & in the field.
Assigned staff will perform continuous or periodic inspections to verify that the work of construction is in conformance
with the approved project plans as well as identifying issues of non-compliance with applicable building codes. Many
of our inspector candidates can provide dual plan check and inspector services for our clients. When necessary for
large or fast-track projects, multiple inspectors are available.
Staff assigned will contact the Building Official, or designee, for interpretations, local ordinances, local preferences,
alternate materials and exceptions/alternates to the model codes. They will report directly to the Building Official or
other person designated for all project -related work. Items, if any, which cannot be resolved between the project
inspectors and contractors, will be forwarded to the Building Official for final resolution.
Inspection personnel assigned will be able to read, understand and interpret construction plans, truss drawings and
calculations, as well as prepare and maintain accurate records and reports, communicate effectively orally and in
writing, and work effectively with contractors, the public and general staff. Inspectors will posses knowledge of
approved, up-to-date methods, materials, tools and safety procedures used in building inspection and the most
current building standards.

Interwest Consulting Group inspectors will, on a rotational basis, be required to perform after hours, stand-by, and

As municipal consultants to many jurisdictions, Interwest staff is highly adaptive to all processes and procedures and
quickly and seamlessly assimilates to your specialized requirements. All personnel are cross -trained in municipal

with Planning, Public Works, Code Enforcement and other vital City staff and departments.
Inspection Schedule
Interwest Consulting Group inspectors are familiar with a multitude of jurisdictional scheduling and tracking systems
and can quickly adapt to City requirements. Inspectors will provide inspections for all inspection requests received.
Emergency inspections (usually requests that pertain to a serious or urgent life/safety issue) can be provided as they
are needed; nights, weekends and holidays. Many of our inspectors are also available to serve at the public counter

Ron Beehler, SE, CBO I PRINCIPAL -IN -CHARGE
Ron has more than 30 years of experience performing life safety, accessibility and structural plan reviews. He served
as Chief Building Official with the City of Sacramento, directing a staff of 120 engineers, plan reviewers and building
inspectors. During his tenure, the Building Division issued over 18,000 construction permits annually, with valuation
in excess of one billion dollars. At the Office of Statewide Health Planning and Development (OSHPD), as Senior
Structural Engineer and Regional Compliance Officer, Ron was responsible for structural plan review of hospital
projects and for hospital and health care facility construction oversight in the Los Angeles and San Diego areas. Poor
to joining OSHPD, he was Chief of Engineering Design and Construction for the California National Guard.

Y. Henry Huang, PEI PROJECT MANAGER & CITY LIAISON
Henry has more than 30 years of experience both within municipalities and as a consultant. This experience has
given him a solid understanding of what a building department requires to thrive. He has hands-on expertise
overseeing a large professional staff and managing plan review, inspection, and permit counter services, and has
many years of knowledge and experience performing Code development and building department management.
Henry has authored the 2006 and 2009 IBC Structural Checklist, widely used publications by ICC. Henry believes the
purpose of a building department is to provide future occupants of structures a safe place to live, work and play.
Chandra Desai, PEI PLAN REVIEW - STRUCTURAL
Chandra has more than 30 years of experience in structural engineering, which includes design of structures for
residential, commercial and industrial facilities. He has designed steel and concrete structures for nuclear, petro-
chemical and gas plants. His experience also includes more than 15 years of plan checking for the County of
Riverside for engineering and non-structural plans for all types of buildings.
Tom Campbell, PE, CBO I PLAN REVIEW
Tom has more than 30 years of experience in the industry, with 15 years in management of ICBO's Education
Program. He led and directed work assignments relating to the development of technical publications based on the
UBC, IBC and IRC for use in classroom training of architects, engineers, inspectors and code regulators. In addition,
Tom was a staff liaison and ICBO representative to one of five code development committees charged with
developing the 2000 International Building Code. His experience in the industry includes four years in the evaluation
of new building materials and methods of construction, and six years in the design, detail and plan review stages of
industrial, commercial and residential structures.
Terence Chan, PE I PLAN REVIEW
Terence has over 20 years of industry experience both within municipalities and working as a consultant. This
experience has given him a solid understanding of the building code provisions, details of construction and permit
processes. He has hands-on expertise reviewing complex residential and non-residential projects for compliance with
prevailing codes and regulations.
Sal Kaddorah, PE I PLAN REVIEW LEAD
Sal is a registered engineer with more than 30 years of industry and municipal experience, serving major
metropolitan governmental agencies throughout Southern California. He spent 18 years of his career serving the

Southern California City of Manhattan Beach, beginning as a Senior Plan Check Engineer and progressing to
become the City's Building Official and filling in as the Director of Community Development as -needed. This has
given him valuable perspective on and respect for working in a municipality at multiple levels. This insight allows him
to problem -solve and work effectively within this environment to the satisfaction of existing City staff and the
development community.
Hossein Afrouzeh, PE (ME+EE) I P L A N R E V I E W- M E P
Hossein is a registered electrical and mechanical engineer with 10 years of construction experience and 30 years of
design and construction management support experience. He is a well-rounded project leader with strong
interpersonal and communication skills with ability to lead a design team of Electrical, Mechanical, and Plumbing
engineers to adhere to the client and code requirements. He has been responsible for the electrical system design for
many projects, including construction administration and commissioning of medium voltage power distribution
systems, substations, lighting and power, fire alarm and security systems.
Tony Dormanesh, CASp, PE, CBO I PLAN REVIEW & CASp
Tony spent 31 years in the City of Irvine, with 20 years in the Department of Public Works and the Department of
Community Development Building and Safety Division as a Senior Engineer. He also served as the Acting Building
Official for the City of Morgan Hill. Tony has 16 years of experience as a Principal Engineer Certified Inspector and
has worked as a Code Consultant, He is an ICC Certified Building Official and Plans Examiner.
David Marcum, CASp I INSPECTION & CASp
David is an inspection professional with nearly 30 years of relevant, municipal building inspection experience. In
addition to his years of practical expertise, he also possess several ICC certifications, confirming his ability to inspect
Mechanical, Plumbing and Residential projects. More notably still, David is a Certified Access Specialist, CASp,
making him a uniquely qualified inspector to assist our clients with accessibility compliance.
Wayne Webb I PLAN REVIEW
Wayne has more than 25 years of industry experience relating to mechanical, electrical, and plumbing (MEP)
systems. He is familiar with all MEP requirements and the complexities of code compliance including Title 24 codes.
He has worked with and within municipalities, filling both the City employee and consultant role, and has cultivated a
productive approach that balances a commitment to compliance with all City requirements and a partnership with the
design community. Having started as an inspector, Wayne brings field experience and hands-on expertise to his plan

Barry has more than 40 years of on-the-job construction trade experience, having worked in local government since

to 2013, Barry reviewed the majority of the commercial building projects in non -incorporated Riverside County,

• Interwest has provided building plan review services to the City since 2009. During that time, we have
consistently reduced our expected tum -around times. On average, our staff can perform first time plan
check within the same working week of submittal. All subsequent plan checks are completed by the next day.
• Our staff developed the City's first single, combination building permit which allowed for the same permit
number to address all of a structure's elements (electrical, mechanical, plumbing and structural) requiring
approval. This greatly reduced the man hours and paperwork once dedicated to the recreation of forms.
• We have introduced several key documents that have allowed staff to efficiently communicate, including a
work flow tracking sheet to document approvals, a standardized monthly report using the City's EnerGov
software, and several of the City's Building and Safety handouts, reflecting current codes and standards.

Baker Ranch
Baker Ranch is currently the City's largest scale residential
development, including approximately 2,379 single -and multi-
family homes with varying floor plans. The development offers
several amenities including private recreational centers
complete with swimming pools and neighborhood parks with a
baseball field and a full basketball court. It also contains 10
community parks totaling 33.44 acres.
Since the project's conception in 2012, our staff has been involved in engineering and building plan review, permit
processing, and inspection. The commencement of construction on this large-scale development caused a significant
increase in demand for inspections. Anticipating this, our team collaborated with EnerGov staff to create
eLakeForest, a portal that allows contractors to schedule their inspections online. Interwest also brought on an
additional inspector to help the City address the workload: This addition is exemplary of Interwest's commitment to
adjusting service levels to maintain adequate staffing on a case by case basis.
Portals Center
The Portola Center is a 243 acre project including a 5 -acre community
park and three private neighborhood parks. Amenities also include a
scenic 1.5 mile hiking and walking trail, exercise stations, a playground, a
picnic pavilion, and 10,000 square feet of mixed-use space. This
neighborhood will provide roadway and landscape enhancements and
bring approximately 930 single- and multi -family homes.
Interwest staff has been responsible for providing plan review and
inspections on this project. We were also responsible for implementing
the City's first geotechnical peer review process in response to this
development's hillside location. The site's natural grade of 30.400/6 required the use of specialized fills and retaining
walls, including Mechanically Stabilizing Earth (MSE) walls, Soil Nail walls, and Shear -Pin walls. Because many of
the Citys new residential developments are planned for construction on hillsides, geotechnical peer review will
continue to be a useful process on future projects.

Whisler Ridge
Whisler Ridge is a subdivision of approximately 12 acres, with 68 single-family homes built out
in 2013. Our staff performed plan check, permitting and inspection services and remained ZERO CRO
available to work special off -hours in order to keep the project on schedule. ENERGY READY HOME
Interwest staff inspected environmentally conscious amenities available to these homes including solar panels, high -
efficiency Forced Air Units (FAUs), and electric water heaters, which combined to create zero -energy housing for the
first time in the City of Lake Forest. Our efforts on this project put us on the ground -floor of the City's new standard
for energy-efficient residences and established the process for making these features available on all future
residential developments.
Sports Park & Recreational Center
Interwest was pleased to provide services on one of the largest (86 acres!)
sport parks in Orange County and a premier project for the City of Lake
Forest. Interwest employees were responsible for the structural, electrical,
mechanical, and plumbing plan review and inspection for the main
Recreational Center and Gymnasium and two outer buildings.
Made possible in 2013 by a $35.9 million contract, the park has 57 acres devoted to sports fields and a multi-
functional center. Amenities include 5 Baseball/Softball Diamonds, 3 Natural Turf Soccer Fields and 2 Synthetic Turf
Soccer Fields, a 27,000 Square Foot Recreation Center/Gymnasium, 2 Restroom and Concession Buildings, 38
Sports Field Lights, 2 Outdoor Basketball Courts, 8 Gazebo Picnic Structures, 2 Playgrounds/Tot Lot, over 500
Parking Spaces, and a Hiking Trail. The park has been open to the public since November 2014.

Interwest Consulting Group began serving the City of Pomona [population
160,000] in September 2009. Traditionally a full service city, Pomona
examined a number of cost saving strategies including contracting for
services that had historically been provided by in-house staff. Interwest

Center, the City's first LEED Silver engineered IIIL 1
project, The FairPlex Conference Center is an 85,000 !
square foot, state-of-the-art building featuring the latest in construction styles and technology features with an eco -
friendly balance. Understanding the importance of this project we dedicated seasoned inspectors who collaboratively
worked with a half dozen deputy inspectors and maintained a weekly inspection schedule, plus weekend inspections,
as needed to keep the project on schedule. The project presented some unique challenges due to the incorporation
of the new construction with an existing Depression -era historical building. This required that all adjoining parts of the
Exhibit Hall, including electrical and plumbing, conform to rigorous Fire Rating Standards.
Mayfair Hotel
The Mayfair is a downtown icon and landmark for the City of Pomona. The Interwest team provided plan review and
inspection services on the Mayfair Hotel. Our experienced engineers reviewed the project design, which included

both structural and non structural elements. Our inspectors were on the project
every week to resolve any potential issues, ensure the project is adhering to
current building codes and collaboratively working with the contractor to
maintain an aggressive schedule.
The five story hotel will deliver four floors of completely new and modem
housing, targeting primarily the Western University campus, mixed retail, a restaurant on the ground level and an
Irish Pub in the basement. The developer is targeting completion before the end of 2012.
Western university Campus
Interwest Consulting Group was honored to work on such a premier project
for the City. Our staff has provided plan review and inspection services since
2010 on the Western University Campus. As part of a growing campus
Interwest provided plan review and inspection for many tenant
improvements (TI) which included the 2nd Floor Administration Offices &
Testing, Patient Care Center, Health Building, Student Housing Building and a 300,000 square -foot residential,
assembly, and offices. Western University's $10 million, 133,000 square foot mixed-use project for student housing
and administration offices began construction in the spring of 2013. The university set an aggressive completion
date for the contractor to be finished and occupied for the 2014 fall semester.
The contractor met with Interwest staff to discuss their dilemma and concerns that such an aggressive time schedule
placed by the university in all probability could not be met. The main contributing factor the schedule possibly not be
met was due to an extremely congested area where the building was proposed to be
built. Logistics in moving material and construction crews was going to be critical. Over
the course of about a month of meetings with the general contractor, Interwest began
the process of developing an inspection schedule that would help the contractor achieve
completion of the project within the deadlines of the owner without compromising fire
and life safety of the students that will ultimately reside in the building. The project was
completed in July 2014, thirty days ahead of schedule and in time for occupancy of
the building for the fall semester.
Interwest's experience within the fields of Construction Management, Engineering and Building & Safety has been
the road to successfully partnering with the construction community to deliver quality projects that are completed on

time, deliver quality construction to the owner, a safe environment for the end user and, in this case, approximately
450 students and school administrators.
Monterey Station
Monterey Station is a 150,000 square foot, 4 story, 311 unit
mixed-use retaillapartment complex developed within an entire
city block. One goal of the mixed use concept is to lower the
carbon footprint for the community. This project does that
through people being able to work from home and being within
walking distance to the Pomona Metrolink station; keeping
citizens out of their cars and on the commuter rail system.
Interwest recognized the overall concept and importance of a pedestrian friendly project. The project management
team initially forecasted a project of this scope and magnitude taking 18 to 24 months to complete — at a minimum.
To complete a project of this size has its own inherent complexities and challenges to complete in a timely fashion.
Interwest, owner and contractor met at the onset to discuss scope and expectations. From this meeting, Interwest
and the contractor devised a strategy to complete the project on time, benefiting the owner, without compromising fire
and life safety provision of the building code. Interwest provided an on-the-job resident inspector to ensure timely
inspections and quality of construction. The collaborative process of all stakeholders working in partnership (the
development team, contract and Interwest) the project was completed for occupancy within 12 months!
Pomona Valley Mental Health Center
The Pomona Valley Mental Health Center is a 100,000 square foot,
2 story, concrete tilt -up building. It is the main facility for the region
to train professionals to help the mentally impaired. The project was
proposed to be located in the Phillips Ranch that was undeveloped
and would need access via a new road. The road would be
constructed under a private development then upon completion of
the project the road would be turned over to the city as a public street. Adding to the complexity was Pomona Valley
Mental Health Center current lease was not going to be renewed and time was of the essence,
Interwest inspectors with infrastructure inspection experience were brought in to start collaborating with the
developer, contractor and public works staff. This project would eventually have two end users, the City of Pomona

and Pomona Valley Mental Health Center. Interwest inspectors assigned to this project not only had infrastructure
inspection experience but also construction management experience and fully understood the complexity of the
project.
A building pad had to be graded and certified in tandem to road construction. Meetings began to take place with the
contractor and the building & safety division to devise a plan to achieve the maximum efficiency to complete the
project. From these meetings we concluded it would be in the owner's best interest to have inspections on demand.
Interwest tailored our services to meet our clients' needs, both internal and external. Interwest's ability to deliver
experienced staff and partner with the development community helped produce a successful turnkey project that was
delivered to Pomona Valley Mental Health Center and the City of Pomona.
City of Eastvale
Interwest Consulting Group performed a variety of services resulting in the
delivery of efficient and cost effective services to the newly incorporated City of
Eastvale. These services included: (1) the gathering of essential information and
key data which served as the basis for confirming service area responsibilities
for the City of Eastvale, (2) preparation of fiscally prudent and conservative
operating budgets and, (3) identified cost effective, efficient, and innovative
methods of providing public works, planning, building and safety activities and
services transitioned from the County of Riverside

BUILDING & SAFETY SERVICES
Our compensation schedule is provided to accommodate the different ways the City may collect fees for service in
the building and safety department. We look forward to the opportunity to refine the mechanics of the m od of
compensation, if required, to align with new or revised fee schedules the City may implement in the futur .
INSPECTION SERVICES
If the City wishes, we are also available to provide inspection services on an hourly basis us' g our General Hourly
Rates Schedule below. We assume that our building inspector would be on a 40 hour pe eek basis with additional
inspectors only called upon when workload necessitates. 4

Scope of Services
The following is the itemized scope of services which the consultant is expected to perform
as a part of this Agreement.
The Building Division of the Tustin Community Development Department provides
comprehensive Plan Checking and Building Inspection services for building
improvements proposed by private or public applicants/owners that includes, but is not
limited to the following:
Plan Check Assistance: The City may select more than one firm to perform the
requested services with plan check submittals assigned to the consultant from
the approved list in a rotational manner. The Consultant shall review plans,
calculations, reports and specifications for compliance with the most recently
enacted rules and regulations as adopted by the Federal, State and local
legislative bodies. The selected consultant shall provide transportation from
his/her place of business to the City for pick-up (within 24 hours of notification by
the City) and delivery of plans for the first check and all rechecks unless the City
approves an alternative delivery method. The standard turn -around time for
assigned plan reviews shall be 10 (ten) working days for the initial review and 5
(five) working days for rechecks unless otherwise directed by the City (not
including designated/approved holidays when City Hall is closed). This
turnaround time should be measured from the time a plan is received and sent
back with complete comments. When authorized by the City and agreed to by the
consultant, developer -initiated expedited plan check may be accommodated and
shall be compensated at a rate not to exceed 1 Y2 times the agreed upon hourly
rate. Plan review letter comments shall be specific, detailed, complete, and
reference plan sheet numbers and code sections where applicable. Contractor
shall agree to attend meetings at City Hall or a particular job site when needed to
resolve plan check matters or questions, but is encouraged to work directly by
telephone or email with the project's applicant, engineer/architect or City of
Tustin staff when reviewing submitted plans or subsequent corrections (provided
that City Building staff are informed as to any substantive content of these
conversations). Review shall be performed by a professional that is
registered/licensed in the State of California to perform work within their
respective field of competency. Two copies of the plan check correction list shall
be provided to the City for each project reviewed. All plan check services shall
be performed by or under the responsible charge of a California licensed
professional eligible to prepare and sign such plans.
Inspections: Consultant upon request of the City shall provide ICC or Other
Certified and experienced contractors to conduct inspections of all phases of
construction for compliance with approved plans and all applicable codes and
City Ordinances including but not limited to those relating to structural integrity,
fire and life safety, electrical, plumbing, heating and air conditioning, as well as
energy conservation, handicapped access, grading and site work. Contract
inspection services could also include enforcement of compliance with conditions

of approval, and the requirements set forth on the plans for which the permit was
issued. At the request of the City, and upon the availability of the consultant,
building inspection may be performed after hours at a rate not to exceed 1 '/Z
times the agreed upon hourly rate. In addition, building inspectors are required
to perform after-hours stand-by emergency response in the event of fires,
accidents, etc. Currently, contract inspectors participate in this role on a
rotational basis with City staff members and are compensated at a rate of two (2)
hours of overtime compensation (time and one-half) for any call (fifteen (15) or
more minutes beyond the end of their shift) which requires them to return to duty.
Call Back Pay begins when an employee returns to work and does not include
travel time. Standby Duty shall be compensated at the rate of one (1) hour of
straight -time compensation for each eight (8) hours of such duty. Such
compensation on Holidays (including the holiday closure) shall be at the rate of
two (2) hours of straight -time compensation for each eight (8) hours of Standby
Duty. Call Back or Stand-by pay does not apply to regular or pre -scheduled
work.
Optional Contract Services: Periodically, the Community Development
Department may meet unexpected or temporary, project or Department -specific
requirements through contract services provided by the proponent firm in the
following areas on an hourly -rate basis.

SPECIAL REQUIREMENTS
1. That Section 1.8 shall be added to read:
1.8 Conflict of Interest. In order to assure City that Consultant is not subject to any
conflict of interest, Consultant affirms that while Agreement is in effect, neither
Consultant nor any of its officers or employees will accept private work from or provide
services for any company whose project Consultant is plan checking or inspecting for
City. Consultant shall not accept a project from City if the project owner or applicant is
a client of Consultant or its officers or employees. If either City of Consultant thinks
there may be a conflict of interest involving any project, Consultant shall immediately
return plans or remove inspector from project. In the event of uncertainty about
whether a potential conflict of interest exists, Consultant shall advise Contract Officer
whose decision shall be final.

GENERAL CONDITIONS
1. The schedule of performance identified in the Scope of Services (Exhibit A) shall
be complied with.
2. Consultant shall comply with all existing state and federal labor laws including
those applicable to equal opportunity employment provisions. No discrimination
shall be made in the employment of persons because of the race, color, or
religion of such persons and every bidder in violation of this section is subject to
all penalties imposed for a violation of Chapter 1 of Part VII, Division 2 of the
Labor Code, in accordance with the provisions of Section 1753 thereof.
3. Consultant shall have in full force and affect all licenses, certifications and
permits required by all applicable laws.
4. Consultant shall obtain and continuously hold a City of Tustin Business License
during the term of the contract.
5. Consultant shall at all times provide services with the utmost respect to the
public.
6. All employees of Consultant shall wear clean clothing in the performance of their
duties and equipment shall be cleaned and maintained in a safe operating
manner. All equipment shall be subject to inspection by the City at any time. All
Consultant personnel shall wear appropriate safety gear at all times while
working in the City. Consultant shall provide satisfactory warning devices that
meet the requirements of the California Occupational Safety and Health Act (Cal -
OSHA) for protection of workers when and where required at all times in the
performance of this contract.
7. Consultant, its agents, and employees shall comply with all laws, ordinances,
rules and regulations of the federal and state governments, the County of
Orange, the City of Tustin and all governing bodies having jurisdiction applying to
work done under the agreement.
8. The City reserves the right to negotiate special requirements and proposed
service levels using the selected proposal as a basis. Compensation for such
services will be negotiated with the Consultant.
9. Consultant shall not sublet any portion of the agreement with the City without the
express written permission of the Community Development Director or
designated representative.

10. The City reserves the right to review and approve the qualifications of
subcontracting firms or persons. Substitutions that are not approved are
considered sufficient grounds for termination of contract.
11. The City, or any of its duly authorized representatives, shall have access to and
the right to examine, audit, excerpt, copy or transcribe any pertinent transaction,
activity, time and work records, employment records or other records relating to
personnel employed by the Consultant. Such material, including all pertinent cost
accounting, financial records and proprietary data, will be kept and maintained by
the Consultant for a period of at least four years after completion of a
Consultant's performance unless the City's written permission is given to dispose
of same prior to that time.
12.All documents, records, designs, and specifications developed during the
contract period by the Consultant in the course of providing the contracted
services to shall be the property of the City. Anything considered to be
proprietary should be so designated by the proponent.
