Kendig: The City Council unanimously denied Claims No. 16-20 and 16-21 and voted 3-2 (Councilmembers Gomez and Murray dissented) to grant the application to present late claim regarding Claim No. City Council December 6, 2016 Meeting Minutes Page 2 of 12 16-22 and directed payment in the amount of $950 with the exchange of a full release of claims. Lyann Collins CONSENT CALENDAR ITEMS 1-13 It was moved by Councilmember Murray and seconded by Mayor Pro Tem Bernstein to pull Item No. 13, at the request of Councilmember Gomez, and move the balance as recommended by staff. Motion carried 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL AND SPECIAL CLOSED SESSION MEETING HELD ON NOVEMBER 15, 2016 Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council and the Special Closed Session Meeting held on November 15, 2016. 3. RATIFICATION OF DEMANDS AND RATIFICATION OF PAYROLL The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council approve Payroll in the amounts of $725,986.54; and demands in the amount of $4,053,641.60. 4. MILLS ACT PROGRAM - HISTORIC PROPERTY PRESERVATION AGREEMENT FOR 148 NORTH B STREET City Council December 6, 2016 Meeting Minutes Page 3 of 12 The Mills Act is State legislation that provides for reduced property taxes on an eligible historic property if the property owner agrees to maintain and preserve the property for a minimum of ten (10) years. On June 16, 1997, the City Council authorized the implementation of a Mills Act program and established a policy specifying which properties would be eligible for the program. Attachment A of the report includes a draft historic property preservation agreement for the property located at 148 North B Street. This is the seventeenth historic property preservation agreement to be considered by the Council. The agreement contains standard language that is required by State law and customized terms, standards, and conditions for the property. Because the property is in very good condition, the improvements required over the minimum ten (10) -year contract term are relatively minor. Owners: Norman and Candace Alas Motion: That the City Council adopt Resolution No. 16-69 authorizing the execution of a Historic Property Preservation Agreement (Mills Act Contract) with Norman and Candace Alas, the owners of the property, located at 148 North B Street. RESOLUTION NO. 16-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR AUTHORIZED DESIGNEE TO COORDINATE, PROCESS, AND EXECUTE THE HISTORIC PROPERTY PRESERVATION AGREEMENT ATTACHED HERETO AS EXHIBIT 1 WITH THE OWNERS OF THE PROPERTY LOCATED AT 148 NORTH B STREET, TUSTIN, CALIFORNIA. 5. RESOLUTION NO. 16-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR AUTHORIZED DESIGNEE TO COORDINATE, PROCESS, AND EXECUTE THE HISTORIC PROPERTY PRESERVATION AGREEMENT ATTACHED HERETO AS EXHIBIT 1 WITH THE OWNERS OF THE PROPERTY LOCATED AT 148 MOUNTAIN VIEW DRIVE, TUSTIN, CALIFORNIA. 6. CANCELLATION OF THE JANUARY 3, 2017 CITY COUNCIL MEETING Due to a lack of quorum, staff recommends cancellation of the January 3, 2017 Regular City Council meeting. Motion: Direct the City Clerk to post a Notice of Cancellation for the regularly scheduled Council meeting of January 3, 2017. The City Council hereby waives notice of said meeting as required by Government Code §54954. 7. QUARTERLY INVESTMENT REPORT FOR THE CITY OF TUSTIN AND THE SUCCESSOR AGENCY FOR THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY Government Code Section 53646 requires that the Treasurer make an Investment Report to the City Council at least quarterly showing balances by authorized investment and certifying its compliance with the adopted Investment Policy. Motion: That the City Council receive and file. 8. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORT This agenda report transmits the John Wayne Airport (JWA) Noise Abatement Quarterly Report for the second quarter of 2016. The average noise level measured at Tustin's monitoring station (NMS 1ON), located at Columbus Tustin Middle School on Beneta Way (Figure 1), remained consistent with prior quarters during this first quarter reporting period. Average noise levels during the first quarter remained well below the City, County, and State criteria of 65 dB Community Noise Equivalent Level (CNEL) for residential uses. Motion: That the City Council receive and file this report. 9. RESOLUTION NO. 16-68 ADOPTING THE COUNCIL CHAMBER RENOVATION SCHEDULE City Council December 6, 2016 Meeting Minutes Page 5 of 12 Adoption of Resolution No. 16-68 would allow the City Council to conduct Regular Meetings during the Council Chamber Renovation at the Clifton C. Miller Community Center. Motion: That the City Council adopt Resolution No. 16-68 to conduct Regular Meetings at an alternative location. RESOLUTION NO. 16-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA AUTHORIZING AN ALTERNATIVE LOCATION TO CONDUCT REGULAR CITY COUNCIL MEETINGS AT THE CLIFTON C. MILLER COMMUNTY CENTER 10. REJECTION OF ALL BIDS AND AUTHORIZATION TO RE -ADVERTISE FOR BIDS FOR THE MOFFETT DRIVE BRIDGE AND ROADWAY CONSTRUCTION PROJECT, CIP NO. 70224 Staff is recommending that the City Council reject all bid proposals received on the Moffett Drive Bridge and Roadway Construction Project, CIP No. 70224 (the "Project"). The City received six (6) bids for the Project, all significantly higher than the engineer's original estimate. Motion: That the City Council reject all six (6) bids received on the Project and direct the City Clerk to return all bid bonds and re -advertise for bids. 11. AWARD OF BID FOR THE HERITAGE PARK PLAYGROUND RENOVATION (CIP NO. 20078) The bid opening for the Heritage Park Playground Renovation project was held on November 21, 2016. The Heritage Park Playground Renovation was identified by the Community Services Commission as the next project to be completed on their seven-year Capital Improvement Project priority list. Motion: That the City Council: 1. Award the construction contract to D D Systems, Inc. (DBA Ace CD, Inc.) of Glendora, California, in the amount of $194,223.89 subject to the approval of contract requirements by the City Attorney and final execution of the contract. 2. Approve a supplemental appropriation of $25,000 for this project. $10,000 of this total was secured from a donation from the Santa Ana - Tustin Rotary Club and the additional $15,000 would be needed from the Park Development Fund (131) to fully fund this project including contingency. 12. AUTHORIZATION TO PURCHASE SIX TRUCKS AND DECLARATION OF City Council December 6, 2016 Meeting Minutes Page 6 of 12 SURPLUS EQUIPMENT FOR PUBLIC AUCTION Staff is requesting City Council authorization to purchase three utility trucks, two pickup trucks and one service truck for Public Works and Parks and Recreation. In addition, the City Council is requested to declare certain City equipment no longer required for public use in accordance with Section 1630a (2) of the Tustin City Code (TCC) and authorize their sale at public auction. Motion: That the City Council: 1. Adopt Resolution No. 16-71 authorizing the State of California Department of General Services to purchase three (3) 3/ ton utility trucks and two (2) 1/ ton pickups, from Winner Chevrolet Elk Grove, Ca. in the amount of $156,948.23 and one (1) medium duty service truck, from Fred M. Boerner Motor Company in the amount $177,815.13; 2. Appropriate $109,815.13 from the Water Enterprise Fund; and 3. Declare, in accordance with Tustin City Code — Section 1630a (2), the attached itemized list of equipment as surplus and not required for public use and authorize the sale of the equipment at the next available public auction, crediting net proceeds to applicable City revenue fund. RESOLUTION NO. 16-71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA AUTHORIZING THE DEPARTMENT OF GENERAL SERVICES OF THE STATE OF CALIFORNIA TO PURCHASE CERTAIN ITEMS 13. SECOND READING AND ADOPTION OF ORDINANCE NO. 1472 AND ORDINANCE NO. 1473 (VINTAGE PROJECT) Ordinance No. 1472 approves Zone Change 2016-001 to change the zoning from Planned Industrial (PM) to Planned Community (P -C). Ordinance No. 1473 for approves Development Agreement 2016-002 to facilitate the development of an approximate 6.81 acre site and accept public benefits. Councilmember Gomez commented that the second reading material did not address the concerns she had previously raised. It was moved by Councilmember Murray and seconded by Councilmember Puckett to have second reading by title only and adoption of Ordinance No. 1472 and Ordinance No. 1473. Motion carried: 4-1 (Councilmember Gomez dissented) ORDINANCE 1472 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN City Council December 6, 2016 Meeting Minutes Page 7 of 12 APPROVING ZONE CHANGE 2016-001, AMENDING THE ZONING DESIGNATION FROM PLANNED INDUSTRIAL (PM) TO PLANNED COMMUNITY (PC) TO ACCOMMODATE THE CONSTRUCTION OF A ONE - HUNDRED FORTY (140) UNIT RESIDENTIAL CONDOMINIUM PROJECT AT 320-438 WEST SIXTH STREET AND 620 -694 SOUTH B STREET ORDINANCE NO. 1473 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, APPROVING DEVELOPMENT AGREEMENT (DA) 2016-002 BETWEEN THE CITY OF TUSTIN AND INTRACORP SO CAL -1, LLC TO FACILITATE THE DEVELOPMENT OF ONE -HUNDRED FORTY (140) RESIDENTIAL CONDOMINIUM UNITS ON AN APPROXIMATE 6.81 ACRE SITE LOCATED AT 320-438 W. SIXTH STREET AND 620-694 S. B STREET REGULAR BUSINESS ITEMS 14-15 14. CITY OF TUSTIN SPONSORSHIP OF THE TUSTIN CHAMBER OF COMMERCE'S TUSTIN HANGAR HALF MARATHON AND 5K City Council approval is requested for the City of Tustin to sponsor the Tustin Chamber of Commerce's Tustin Hangar Half Marathon and 5K on March 12, 2017. It was moved by Mayor Pro Tem Bernstein and seconded by Mayor Nielsen to: 1. Authorize the City of Tustin's $50,000 sponsorship of the Tustin Chamber of Commerce's Tustin Hangar Half Marathon and 5K; and 2. Authorize the City Manager to execute a Tustin Hangar Half Marathon and 5K Sponsorship Agreement, and authorize the City Attorney to make non - substantive changes to the agreement as deemed necessary; and 3. Authorize a $50,000 appropriation from Fund 189 — Tustin Legacy Marketing. Motion carried: 5-0 15. WATER CONSERVATION UPDATE - OCTOBER 2016 As a result of the drought, the City of Tustin is required to provide the State Water Resources Control Board with a monthly report regarding water consumption and restrictions. This report summarizes the information provided to the State for the month of October 2016 and provides the City Council and the public with general information on previous and upcoming actions taken by the City. The Council unanimously voted to receive and file this report. Parker Thanked Mayor John Nielsen, on behalf of city staff, for his service. City Attorney David E. Kendig Thanked Mayor John Nielsen for his service. Councilmember Puckett Dispensed commenting on committee reports; thanked Mayor John Nielsen for everything he has done as a City Councilmember and as a Planning Commissioner; enjoyed the four years spent as council members together; wished Mayor John Nielsen luck on his next adventures. Councilmember Gomez November 17 o Attended the Tustin Community Foundation Mayor's Thanksgiving Breakfast. o Attended the Santa Ana River Flood Protection Agency meeting; received an update on the projects and the impending funding; received a written report from Washington D.C. advocate, the budget for the fiscal year 2017 should remain at 37 million but there may be some changes with the new administration in the fiscal year 2018; some of the projects that have been approved in Los Angeles County may affect some of the projects in Orange County but waiting for more information to come. November 18 Attended the Orange County Senior Advisory Council meeting in Rancho Santa Margarita; City Council December 6, 2016 Meeting Minutes Page 9 of 12 speaker was Orange County Supervisor Lisa Bartlett who discussed senior issues and funding at the county level; the board was able to share their concerns with her. November 29 Attended the Ribbon Cutting Ceremony for the new Humanities building at Tustin High School; building is a great addition to the school and helps to promote student learning and collaboration. December 1 Attended the Tustin Area Senior Advisory Board meeting; discussed upcoming schedule of events; main discussion items were the Orange County Strategic Plan Initiative, will have some local members participate with that committee; the Tustin Area Senior Center Assessment Needs, which was approved by City Council, was further discussed by the group; the Tustin Area Senior Center is partnering with the Orange County Adult Services and the Tustin Police Department to bring holiday cheer to some of Tustin's disabled seniors; small appliances, new clothing such as white cotton socks, slippers, pajamas, jackets, shirts or blouses, nutritional supplements, and gift cards to drug and grocery stores are being collected at the Tustin Area Senior Center and the Parks & Recreation Office until December 15tH December 5 Attended the very last portion of the Orange Teachers Service Dinner in Costa Mesa. Congratulated Mayor Pro Tem Bernstein and Councilmember Puckett on their re-election and welcomed newly elected Leticia Clark. Congratulated Mayor John Nielsen on his years of service on the Tustin City Council; wished him well on his future endeavors. Councilmember Murray Attended six (6) Association of California Cities of Orange County (ACCOC) meetings. Attended two (2) Orange County Transportation Authority (OCTA) meetings. November 23 Attended the Tustin Police Department Turkey Giveaway at the Tustin Family Youth Center with Councilmember Puckett; thanked Chief Charles Celano for his leadership and the Tustin Police Department staff for the generous work they do. November 24 o Volunteered with serving Thanksgiving meals at the Orange County Rescue Mission; opportunity to give back to the community and those less fortunate. o Provided food for Operation Warm Wishes Thanksgiving Feast at Peppertree Park; thanked TyRon Jackson for the wonderful volunteer work he does within the Tustin community. Announced that Chief Celano and the Tustin Police Department are on top of the disabled parking issues that many residents are concerned about; thanked Chief Celano for his City Council December 6, 2016 Meeting Minutes Page 10 of 12 hard work with the disabled parking issue. Tustin Police Department received tremendous amount of recognition on their Global Positioning System (GPS) tracking device on cough syrup; announced it was a national story; thanked Chief Celano and the Tustin Police Department for their hard work and dedication in catching the "bad" guys. Thanked Mayor John Nielsen for his years of service on the Tustin City Council and the Tustin Planning Commission; thanked Mayor Nielsen for his guidance and everything he has done for the Tustin Community; thanked Mayor Nielsen for a job well done. Mayor Pro Tem Bernstein November 17 o Attended the Tustin Community Foundation Mayor's Thanksgiving Breakfast; another great event once again by the Tustin Community Foundation; congratulated the organizations which were able to receive grants; a fun time was had by all. o Attended the Tustin Memorial Academy Blue Ribbon Recognition Ceremony; Tustin Memorial Academy is an outstanding educational facility and received a very special award; congratulated Tustin Unified School District and Tustin Memorial Academy on the award. o Attended the Orange County Vector Control meeting; the West Nile Virus is at its lowest occurrence of infectious disease and transmittal in the last three (3) years; congratulated everyone on the Orange County Vector Control for their efforts. o Attended the Orange County Business Council (OCBC) Turning Red Tape into Red Carpet event; City of Tustin received an Honorable Mention Award for their Public/Private Partnership in the creation of the Tustin Veterans Outpost with the Orange County Rescue Mission; congratulated Jim Palmer, CEO of the Orange County Rescue Mission, and all those who were involved. Announced the City of Tustin is beyond the water conservation numbers; congratulated the Tustin community on being water conscience this past year. November 24 Attended Operation Warm Wishes Thanksgiving Feast at Peppertree Park; congratulated Tyron Jackson for a wonderful event and thanked him for all his volunteer work he does within the Tustin community. Thanked Mayor John Nielsen for his help and guidance he provided the past four (4) years; thanked Mayor Nielsen for sharing information and knowledge on public policies; wished Mayor Nielsen best of luck on his future endeavors; thanked Mayor Nielsen for his services within the Tustin community and congratulated him on a job well done. City Council December 6, 2016 Meeting Minutes Page 11 of 12 Mayor Nielsen November 16 o Attended the Orange County Sanitation District Board meeting; great board to be on; topics discussed consisted of procurements, report of investments and funding for the waste water flow study. o Was interviewed by Charter Communications, which was previously Time Warner, on upcoming projects occurring in Tustin. November 17 o Attended the Tustin Community Foundation Mayor's Thanksgiving Breakfast; another great event once again by the Tustin Community Foundation; Lois Taube, a Lincoln Historian, was the speaker; everyone had a good time. o Attended the Orange County Business Council (OCBC) Turning Red Tape into Red Carpet event; City of Tustin received an Honorable Mention Award from OCBC. November 20 Attended the Orange County Forum, with Councilmember Puckett; Orange County Supervisor Lisa Bartlett gave the State of the County Address; presentation on many of the challenges coming up for the County of Orange, particularly the homelessness issue, as well as discussion on how to handle Proposition 64. November 24 Attended Operation Warm Wishes Thanksgiving Feast at Peppertree Park; thanked TyRon Jackson for his hard work with the event; many people were able to get clothed and fed for the holidays. December 1 o Attended the Southern California Association of Government (SCAG) meeting with Councilmember Puckett; Councilmember Puckett will be replacing Mayor Nielsen on the committee. o Attended the Southern California Economic Summit; former Governor of California, Gray Davis, and Lieutenant Governor of California Gavin Newsom were the speakers; presented information on future economics of California. Thanked everyone for attending the council meeting; appreciated all the recognition received; thanked fellow councilmembers, city staff, and the Tustin community for the effort and teamwork when working on city projects and events; recognized City of Huntington Beach newly elected councilmember Patrick Brenden for attending the council meeting. DECLARING RESULTS OF THE NOVEMBER 8, 2016 GENERAL MUNICIPAL ELECTION On November 8, 2016, the City's General Municipal Election was held to elect three Members of the City Council. It was moved by Councilmember Puckett and seconded by Councilmember Murray to adopt Resolution No. 16-73 declaring the results and other such matters as provided by law for the November 8, 2016 General Municipal Election. Motion carried: 5-0 RESOLUTION NO. 16-73 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2016, AND OTHER SUCH MATTERS AS PROVIDED BY LAW OATHS OF OFFICE - Oath of Office administered to Letitia Clark by Councilmember Rebecca "Beckie" Gomez Oath of Office administered to Dr. Allan Bernstein by Community Services Commissioner Donna Marsh Peery Oath of Office administered to Charles E. "Chuck" Puckett by Gaddi H. Vasquez, Senior Vice President, Government Affairs Edison International Southern California Edison 2. MAYOR AND MAYOR PRO TEM SELECTION The City Council selected those members of the Council who will serve as Mayor and Mayor Pro Tem for the following year Mayor Pro Tem Bernstein invited nominations for Mayor. Councilmember Murray nominated Mayor Pro Tem Bernstein. Councilmember Puckett seconded the nomination. Motion carried: 4-1 (Councilmember Gomez dissented) Mayor Bernstein invited nominations for Mayor Pro Tem. Councilmember Puckett nominated Councilmember Murray. Mayor Bernstein seconded the nomination. Councilmember Clark nominated Councilmember Gomez for Mayor Pro Tem. Councilmember Gomez seconded the nomination. City Clerk Erica N. Rabe presented ballots for voting which resulted in the following: City Council December 9, 2016 Special Meeting Minutes Page 2 of 3 Councilmember Murray received votes from Mayor Bernstein, Councilmember Murray, Councilmember Puckett. Councilmember Gomez received votes from the following: Councilmember Clark and Councilmember Gomez. Councilmember Murray received a 3-2 vote to be selected as Mayor Pro Tem.
