This SuDolement NO. 2 covers the installation of traffic signals and interconnect system on Newport Avenue from the Santa Ana Freewav (I-5) to Irvine Blvd. and is the last Dbase of paperwork for the subiect proiect. This aoreement provides for fundinq as follows: Federal Aid Urban (F.A.U.) State Matchinq 169.1 Funds City Funds TOTAL. RECOMMENDATION: It is recommended that the Tustin City Council, at their meetina of December 15, 1980, adopt a Minute Order authorizin~ the MaYor to execute said Supplemental Aqreement No. 2. Please return both the original and the copy of Supplemental Agreement No. 2~ executed on the part of the City, with a copy' of the authorizing resolution attached to each. After execution of the agreement by the State, a fully executed copy of the agreement will be returned for your file. The date of execution bY the City should be typed in the space provided on the first page of the agreement. Attachments Local Agency City of Tustin Date October 30, 1980 Supplement No. 2 To Local Agency-State Agreement No. 07-5271 PROGRAM OF LOCAL AGENCY FEDERAL AID URBAN SYSTEM PROJECTS IN THE City of Tustin Local Agency Pursuant to the Federal Aid for Urban Systems Acts, the attached "Program" of Federal Aid Urban System Projects marked "Exhibit B" is hereby incorporated in that Master Agreement for the Federal-Aid Program, which was entered into between the above-named LOCAL AGENCY and the STATE on October 15, 1979 , and is subject to all of the terms and conditions thereof. The City of Tustin will advertise, award and administer this project. o In awarding the contract, the Local Agency agrees the payment of Federal funds will be limited to the detail estimate amount approved by the Federal Highway Administration in the Federal- Project-Agreement (PR-2), or its modification PR-2A, and accepts any increases in local agency funds. 4. The availability of Federal Funds will be subject to meeting deadlines and/or other conditions as may be imposed by the Director upon the reco~m~Lendation of the FAU Advisory Co~m~ittee. 5. The iocal agency's share of matching funds for construction engineering and construction will be 100% of the amount remain- ing after Federal participation and 169.1 funds. A portion of the local agency funds required to match Federal Highway Funds in the project will be provided by the State as authorized by Item 169.1 of the Budget Act of 1979 and allocated by the California Transportation Co~mLission. The 169.1 funds assigned to this project are shown on Exhibit B and may be in- creased, if funds become available, to the amount required to match the Federal funds shwon in the detail estimate approved by the FHWA in the Federal-Aid Project Agreement (PR-2), or its modification (PR-2A). In accordance with Section 16304 of the Government Code, Item 169.1 funds were available for expenditure until June 30, 1982. The Budget Act of 1980 reappropriated Item 169.1 funds extending the expenditure period to June 30, 1983. o The local agency may be required to report to the California Transportation Co~m'~ission identifying use of Item 169.1 funds and identifying the use of funds freed as a result of the re- ceipt of 169.1 funds. Funds freed must be eligible for street, road and highway purposes. In executing this Program Supplemental Agreement, LOCAL AGENCY hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program.
