ROURKE, CITY ATTORNEY SUBJECT: FIREWORKS, REGULATION BY CITIES It will be recalled that earlier this year the City was challenged in Court on its ordinance prohibiting the sale or use of fireworks in the City and that the City successfully defended its ordinance. The City of Riverside and the City of San Jose, among others, were also challenged and were not successful in the trial courts. The City of Riverside appealed in the Court of Appeal. The plaintiff, Pyrotechnics, the same company that brought all of the lawsuits (although in each case they made a charity as the first named plaintiff) is further appealing the decision. The LeagUe of California Cities Legal Committee has en- dorsed an Amicus Curiae Brief in support of the position of the City of Riverside. It is recommended that the City Council authorize joining the City of Tustin to the Amicus Curiae Brief without obligation for expenditure of time or money. JGR:jh:D:ll/18/80 cc: DB
