SUBJECT: R-3 ZONED PROPERTIES CN "C" STREET
There are ten lots fronting on "C" Street across from Peppertree Park and the
Tustin School District Administrative Offices which are zoned R-3, but called
out by the General Plan for commercial use. These lots are within the E1 Camino
Real Co~nercial Area Specific Plan No. 1. The specific plan has always been
treated as an overlay zone on properties between First and Sixth Streets and "C"
and Prospect (as extended from Main to Sixth). The specific plan is an
uncodified ordinance adopted on July 6, 1971 which established use, parking and
design criteria affecting the area; however, base zones continued to exist as
noted by the City's rezoning of the former City Hall site to accommodate office
development.
The rest of the properties in the specific plan area zoned C-2 or C-2P with only
the SE corner of First and "C" Streets being C-1. Property owners of R-3 lots
are faced with some confusion when explaining to potential brokers, buyers or
financial institutions that the lots are really commercial not multiple
residential because the General Plan and E1 Camino Real Specific Plan call them
out for commercial and the City has acted to permit office buildings on R-3
properties by use permit. In addition, the "consistency" requirements of State
Law ~ould call for either a rezoning or general plan amendment to make zoning .
and the General Plan compatible.
RECOMMENDATION:
Direct Staff to advertise a Public Hearing to change the zone classification
from R-3 to C-2 for the above mentioned properties on "C" Street in the E1
Camino Real Specific Plan area.
