Modifications to the existing systems at Irvine Blvd., First Street, Main Street and Laguna Road. 2. New signal installation at Holt Avenue. 3. Construction of twenty handicap ramps at the subject inter- sections. 4. Interconnected traffic signal system along Newport Avenue between Irvine Blvd. and the Santa Ana Freeway. This will be a cooperative project wherein 86% is financed by Federal Aid Urban (F.A.U.) funds and 14% by City funds. There is a good possibility that the City's share (14%) can be financed by a State matching fund to a maximum amount of $52,000.00. The City currently has $64,000.00 budgeted for its share of the project. Recommendation: It is recommended that the Tustin City Council at their meeting of November 17, 1980 pass and adopt the attached Resolution approving plans and specifications for said Traffic Signal modifications and installations along Newport Avenue between Irvine Blvd. and McFadden Avenue and directing the City Clerk to advertise for bids. BOB LEDENDECKER DIRECTOR OF PUBLIC WORKS/ CITY ENGINEER BL:dph RESOLUTION NO. 80~124 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR NEWPORT AVENUE FAU PROJECT M-M033(2) AND ~IRECTING THE CITY CLE~( TO ADVERTISE FOR BIDS. WHEREAS, it is the intention of the City Council of the City of Tustin, California, to construct traffic signal ii~rovements and interconnect on Newport Avenue a~ various intersections desig- nated as Newport Avenue FAU Project M-M033(2), .. WHEREAS, the City Engineer has presented plans and specifi- cations for the construction of said work, NOW, THEREFORE, BE IT RESOLVED that the plans and specifica- tions presented by the City Engineer be and are hereby approved as the plans and specifications for the construction of Newport Avenue FAU Project M-M033(2). BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by ]aw for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the following works and figures, to-wit: "NOTICE TO CONTRACTORS" SEALED PROPOSALS will be received at the office of the City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, until on the day of , at which time they will be publicly opencd and read, for performing work as follows: Traffic Signal Improvements and Interconnect on Newport Avenue at Various Intersections Designated as Newport Avenue FAt Project M-M033(2). Compensation Insurance. Pursuant to the requirements of Section 1860 of the Labor Code (Chapter 1000, Statutes of 1965), Contractor shall take out and maintain, during the life of this contract, workmen's compensation insurance for all his employees employed at the site of improvement, and if any work is sublet, Contractor shall require subcontractor similarly to provide work- men's compensation insurance fo~ all of the latter's employees. Contractor indemnifies City for any damage resulting to it from failure of either Contractor or any subcontractor to take out or maintain such insurance. Public Liability and Property Damages. Contractor shalI take out and maintain, during the life of this contract, such public liability and property damage insurance as shall protect the City ^-1 of Tustin, its elective and appointive boards, officers, agents and employees, Contractor and any subcontractor performing work covered by this contract from claims for damages for personal injury, including death, as well as subeontractor's operations under this contract, whether such operations be by Contractor or by any subcontractor, or by anyone directly or indirectly employed by either Contractor or any subcontractor. The amounts of said insur- ance shall be as follows: Public Liability Insurance - In an amount not less than $250,000 for injuries, including, subject to the same ].imit for each person, in an amo~mt not less than $500,000 on account of any one occurrence~ Property Damage Insurance - In an amount of not less than $100,000 for damage to the property of each person on account of any one occurrence. Contractor shall furnish the City, satisfactory proof of carriage of the insurance required, and adequate legal assurance that each carrier will give the City at least ten days prior notice of the cancellation of any policy during the effective period of this contract. Complete Set - Includes specifications and plans. Total cost $10.00 non-refundable. Plans and specifications will only be mailed out upon payment of a mailing and handling fee in addition to that stated above of $5.00 for a complete set. In conformance with Section 3793] of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by one of the following forms of bidder's security: Cash. Cashier's check made payable to the City of Tustin. Certified check made payable to the City of Tustin. Bidder's bond executed by an accredited surety insurer, made payable to the City of Tustin. The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. A bid shall not be con- sidered unless one of the forms of bidder's security is enclosed therewith. A Surety Bond for payment of labor and materials will be re- quired in the amount ofone hundred percent (100%) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued by a company having a rating of A+AA or better. C~ty of Tustin reserves the right to reject any or all bids and/o~ waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The contract will bo a~'arded to the lowest qualified bidder. Provisions of .the State Contract Act are not applicable, and bidders will not be required to be prequalified.
