Binsack, Zoning Administrator PUBLIC CONCERNS: None. CONSENT CALENDAR: None. PUBLIC HEARING: The Zoning Administrator heard the items out of order in order to allow the applicant, Guillermo Del Rio, travel time to attend the hearing. 1. CONDITIONAL USE PERMIT 2016-11 & DESIGN REVIEW 2016-014 APPLICANT/ Guillermo Del Rio PROPERTY OWNER: EI Camino Cafe 195 EI Camino Real Tustin, CA 92780 LOCATION: 195 EI Camino Real, Suite 101 REQUEST: A request to establish an alcoholic beverage sales establishment with outdoor seating and to modify an existing Old Town Parking Exception Program Agreement at 195 EI Camino Real, Suite 101. ENVIRONMENTAL STATUS: This project is categorically exempt pursuant to the California Environmental Quality Act (CEQA) Section 15301, Class 1. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 16-016 approving Conditional Use Permit (CUP) 2016-11 and Design Review (DR) 2016- 014 to authorize on-site beer and wine sales (ABC License Type 41) in conjunction with a restaurant and outdoor seating area and to modify an existing Old Town Parking Exception Program Agreement at 195 EI Camino Real, Suite 101. The meeting resumed at 10:10 a.m. and the Zoning Administrator opened the Public Hearing item. It was noted there were no members of the public in attendance for this item. Zoning Administrator Action Minutes January 9, 2017 Page 2 The applicant, Guillermo Del Rio, was not in attendance; however, his representative, Susan Vanderpool, was. The Zoning Administrator stated she reviewed the staff report and did not have any questions regarding the staff report. She asked Ms. Vanderpool if she had the opportunity to review the staff report, as well as the applicant, Mr. Del Rio, and if she and Mr. Del Rio agreed with the Conditions of Approval. Ms. Vanderpool stated she did give the Conditions of Approval to Mr. Del Rio, but she could not confirm if he understood them or not. Only that they had "discussed it" and he wanted to know "if it was approved or not". The Zoning Administrator explained to Ms. Vanderpool that Mr. Del Rio needs to comply and follow the Conditions of Approval and that he cannot actually establish the approval of the CUP and the ABC License until the various conditions that are associated with the project are completed accurately. The Zoning Administrator asked Ms. Vanderpool to make sure Mr. Del Rio understood and was clear on what is expected of him as far as the fencing area. Otherwise it could put his CUP and his ABC License in jeopardy. The Zoning Administrator approved ZAA 16-016. The public hearing item was closed at 10:11 a.m. 2. CONDITIONAL USE PERMIT 2016-27 APPLICANT: Amy Lee J Fish 13882 Newport Avenue, Suite A Tustin, CA 92780 PROPERTY OWNER: Eldon & Linda Primrose 4823 Surrey Drive Corona Del Mar, CA 92625 REQUEST: To sell alcoholic beverages (ABC Type 41 License) for the on-site consumption of beer and wine in conjunction with an existing restaurant. ENVIRONMENTAL STATUS: This project is categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 16-015 approving Conditional Use Permit (CUP) 2016-27 to authorize an ABC Type 41 License for the sale of alcoholic beverages (beer and wine) for on-site consumption in conjunction with an existing restaurant establishment (J Fish) located at 13882 Newport Avenue, Suite A. Zoning Administrator Action Minutes January 9, 2017 Page 3 The Public Hearing item was opened at 10:01 a.m. The Zoning Administrator called the meeting to order. It was noted there were no members of the public present for this item. The applicant, Amy Lee, was in attendance. The Zoning Administrator stated she reviewed the staff report and did not have any questions regarding the staff report. She asked Ms. Lee if she had the opportunity to review the staff report and if she agreed with the Conditions of Approval, which she did. The Zoning Administrator approved ZAA 16-015. The Public Hearing item was closed at 10:02 a.m. REGULAR BUSINESS: None ADJOURNMENT: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
