BACKGROUND AND DISCUSSION: See Planning Agency Report for Public Hearing No. 1. RECOM/~ENDED ACTION: Staff recommends that if the Planning Agency recommended continuance or denial then the City Council consider this item when it would be appropriate. If the Planning Agency recommended that the City Council approve this item then it would be appropriate to uphold the findings as contained in Planning Agency Resolution No. 1924 and that Ordinance No. 837 have first reading by title only and introduction. 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 i~. 23 24 25 26 27 28 29 3O 31 32 ORDINANCE NO. 837 An Ordinance of the City Council of the City of Tustin, California, APPROVING REZONING APPLICATION NO. 80-3 AT THE SOUTHEAST CORNER OF YOP~A STREET AND NORWOOD PARK PLACE TO A PLANNED DEVELOPmeNT- SINGLE FAMILY (PD) DISTRICT The City Council of the City of Tustin does hereby ordain as follows: I. The A. City Council finds and determines: That a proper application (Z.C. No. 80-3) has been filed by Joe Nardulli for a zone change from the present Single-Family Residential (R-l) District to the Planned Development (PD) Single-Family for property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. Do That a public hearing was duly called, noticed, and held on said application. Co That a zone change, should be granted for the following reasons: 1. The Planned Dev~O~pment District was established to provide most of the desirable residential characteristics found in single-fami~ area. 2. The single-family designation for any development is in conformance with the Tustin Area General Plan. Development of the subject property shall be in accordance with the policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as adminis- tered by the Orange County Fire Marshal, and street improvement requirements as administered by the City Engineer. Thst a Negative Declaration has been applied for to conform with the requirements of the California Environmental Quality Act, and is hereby approved, subject to the followin~ mitigation measure: Ail existing healthy trees that can be saved durinq development shall remain as part of the final develo[~ment. The City Council hereby approves Zone Change No. 80-3 from the Single Family Residential (R-l) to Planned Develooment (PD) with a single familv residential designation, subject to the following conditions: A. The density shall not exceed one unit per 7,180 s~uare feet of gross land area. B. The units shall be of a detached single-family type with no multiple-family units.
