The local Sanitary Engineering Section of the State Department of Health Services has notified the City of the need to apply for a permit to operate the City's Water Service. The City Attorney notified them that our application would be promptly forthcoming. Attached is a resolution form provided by the State. It is recommended that the enclosed resoluticn be adopted authorizing the submission of the application. Section 4011 of the California Health and Safety Code states that ne person shall operate a public water system unless he first files a petition for permission to do so with the department and receives a permit as provided in this chapter. Enclosed are excerpts from the California Health and Safety Code and the California Administrative Code, plus water supply permit application forms for your use. The City Council of the City of Tustin does hereby resolve as follows: That pursuant and subject to all of the terms, conditions and provisions of Division 5, Part 1, Chapter 7, Sections 4010 to 4035 of the California Health and Safety Code and all amendments thereto, relating to domestic water supplies, application by this City be made to the State Department of Health, for a permit to operate the existing facilities of the Tustin Water Works, and to renovate and extend the existing distribution system. The source of water to be used is approximately 50 percent from wells and 50 percent purchased from East Orange County Water District. The locality to be served is primarily the City of Tustin and the unincorporated portions of the Tustin Community. ' That the Mayor of said City Council be and is hereby autho- rized· and directed to cause the necessary data to be prepared, and investigations to be made, and in the name of said City to sign and file such application with the said State Department of Health.
