HomeMy WebLinkAboutORD FOR INTRODUCTION 11-03-80ORDINANCES FOR INTRODUCTIO~ NO. 1 11-3-80 AGENDA ITEM: ORDINANCE NO. 834 An Ordinance of the City Council of'the City of Tustin, California, AMENDING CHAPTER 3 OF ARTICLE 3 OF THE TUSTIN CITY CODE PERTAINING TO POOL HALLS AND BOWLING ALLEYS BACKGROUND: Ordinance No. 834 had fi~s. t reading by title only and introduction at the September 15, 1980~meeting. The Council requested an explanation from the Police Ch~f regarding Section 4, "3306 LOITERING" before the ordinance was adopted. That was done but a new problem was presented by a businessman in that the present language of Section 3301 is so restrictive on building layout as to make most businesses non-conforming. The staff has reviewed the problem and agrees that Section 3301 should be completely deleted. Section 3303(b) already allows the License and Permit Board to review the arrangements and suitability of the location prior to issuing a permit. The City Council of the City of Tustin, California, does ordain as follow,s: Section 1. Tustin C±tv code sect±on 3301 is hereby-repealed Section 2. Tustin C'±tv Code Section 3303 subsection b is amended to read a8 follows: "b Prerequisites to Issuance When a permit sh~ll be issued for the business of billiards, pool, bagatelle, bowling alleys, more than five pinball or electronic games, or other lawful games conducted and carried on for profit and gain, they shall be subject to all conditions contained in this Chapter and like- wise the place where such business shall be carried on, its location, arrangements and suitability for such purposes and the character, reputation and reliability of the person conduct- ing such business subject to the consent and approval of the License and Permit Board." Section 3. Tustin City Code Section 3304 is amended to read as follows: "3304 GAMBLING PROHIBITED It shall be unlawful for any games of cards, dice, or other games of chance to be carried on in any room in which any of the businesses regulated by this Chapter shall be conducted or in any room accessible therefrom." Section 4. Tustin City Code Section 3306 is amended to read as follows: 1 2 3 5 6 7 8 10 11 12 14 16 -~9 20 25 26 27 28 2~ 30 31 "3306 LOITERING It shall be unlawful for any person to loiter in or about any room whereby games regulated by this Chapter are being conducted or carried on and upon which such premises alcoholic beverages are sold or dispensed. It shall be unlawful for any person or his agents or e~ployees to permit any person under the age of eighteen years to loiter about any room in which any of the businesses regulated by this Chapter shall be conducted or in any room accessible therefrom and upon which premises alcoholic bever~s are sold or dispensed."
