Appraisal of Strip of
Property, 41.75' x 200'+
Sixth Street, Tustin,
California
Dear John:
This will confirm our request and authorization for you
to provide a letter appraisal for the City of Tustin of the strip
of property with 41.75 feet of frontage by 200'~ of depth on
Sixth Street in the City of Tustin.
The property to be appraised is described as follows:
The easterly forty-one and seventy
five-hundredths feet (41.75') of
Parcel 2 of Map recorded Book 106,
Pages 31 and 32 of Parcel Maps,
County Recorder of Orange County,
California.
It is our understanding that you will provide this
appraisal at a cost not to exceed $1,000.00 and that the
appraisal will be provided in one week.
The subject property lies easterly of the Tustin Boys'
Club building and was originally a part of the property leased
by the City of Tustin to the Tustin Boys' Club. If you will
refer to the copy of the aerial photograph enclosed, you
will see that on the easterly end of Sixth Street is the Boys'
Club property, then the subject parcel, then a parcel sold by
the City to Walter J. Foster Company and then furthest to the
East is the existing, developed Foster property.
NOTE:
The City Attorney indicates the preliminary
appraisal figure w~ll be available at the
time of the Council meeting.

I say "originally" part of the property leased by the City of
Tustin to Tustin Boys' Club because on September 30, 1980 the ~ .
lease between the City of Tustin and the Boys' Club of Tustin
was amended to delete from those demised premises the easterly
41.75'.
If you will refer to the title report of First American
Title Insurance Company dated September 13, 1979, their order
number 0R-1278859, you will see a map attached to it which shows
Parcel 3, which is the parcel that was sold by the City to the
Walter Foster Company and Parcel 2 which is the parcel that was
leased to the Tustin Boys' Club. Parcel 2 shows the demised
premises as they were prior to the September 30, 1980 amendment
which deleted the easterly 41.75' You will notice that on the
map attached to the title report that a "40' easement for pipe-
line purposes to Metropolitan Water District per 0R-6924-622" is
shown. I've also enclosed a copy of a drawing I made which may
be of some assistance.
The net result of the situation is that:
1. The property that is to be appraised is 41.75'
wide and 200' + deep.
2. 31~25' of this parcel is burdened with the MWD
easement. The MWD easement does not by its terms permit
placement of any buildings on it. 10.5' of the property to
be appraised is clear of any easements.
3. The Boys' Club building encroaches 3.75' into
the MWD easement.
4. With the September 30, 1980 amendment to the
lease between the City of Tustin and the Tustin Boys'
Club, the new easterly line of the premises demised to the
Boys' Club will be 8.75' inside the MWD easement (i.e. the
line will be 8.75' easterly of the westerly line of the MWD
easement). This new line was set at this point so that there
would be the required 5' setback from the edge of the build-
ing to the edge of the demised premises. (It is anticipated
that there will beAa boundary adjustment to the parcel map
to change the easterly line'of Parcel 2 to this new location.)
City land use limitations would not permit the use of the
41.75' parcel as a separate parcel. It may only be used 1) as
part of the property lying easterly of it or 2) as part of the Boys'
Club property.
The Walter Foster Company is desirous of buying or leasing
the 41.75' parcel from the City of Tustin.

The City of Tustin also must consider'the fact that it owns -
Parcel 2 which is subject to the lease to the Tustin Boys' Club
which has a remaining term of approximately 37 years. The 41.75'
strip appears to have little utility as part of the Boy's Club.
In fact, it has been largely unused by the Boys' Club for a
considerable period. However, at the end of the term of the
Boys' Club lease or upon any sooner termination of that lease,
the 41.75' strip might have considerable utility and value as an
addition to Parcel 2. On the other hand, the Foster Company would
intend to add the 41.75' strip to Parcel 3 as part of a parking
lot in connection with the proposed expansion of the Foster
Company facilities.
The City is mindful of the fact that it received almost
$8.00 a square foot for the sale of Parcel 3 to the Foster Company
on an open, competitive bid basis despite an appraisal of a much
lower figure. Of course, that parcel was not subject to the
building limitations of the MWD easement.
The City is desirous of having this property appraised
for its use and consideration in a possible sale or lease of the
subject property. The City must be aware of the reasonable and
fair market value of the property in order to make appropriate
decisions on the sale or lease of the property and in order to
fulfill its obligations of not disposing of property without
receiving full. and fair consideration for it
If you would like for the Engineering Department to make
a more professional and clear drawing of the situation, please
let me know and we will ask them to do that.

plans, one for development with the subject parcel and one for devel-
opment without the subject parcel and deliver them to you right away.
