HomeMy WebLinkAboutRES 80-106, 107, 108, 1091 4 6 ? 8 9 10 11 12 13 .15 16 17 19 2O 21 22 23 24 25 26 27 28 3O RESOLUTION NO. 80-106 A Resolution of the City Council of the City of Tustin, California, AGREEING TO THE EXCHANGE OF PROPERTY TAXES IN CONJUNCTION WITH CERTAIN INHABITED ANNEXATIONS WHEREAS, as a result of the enactment of Section 99(b) of the Revenue and Taxation Code, Annexation Nos. 107, 109, 111, 121, 122, and 123 of the City of Tustin cannot become effective until a negotiated agreement between the City and County regarding exchange'bf property tax revenue has begn completed; and, ~ WHEREAS, it is in the best interests of the City, County, and property owners to complete the annexations as soon as possible; and, WHEREAS, the City Council feels, in this instance, that an exchange o'f property tax revenue as a condition of this annexation is not necessary during the first year of the jurisdictional change; and, WHEREAS, there is 'an effort underway by the Orange County Division League of California Cities and the County of Orange to develop an equitable solution to the problem of reallocation of property tax revenues which allocation formula shall thenceforth be applicable for all future annexations in the County; and WHEREAS, this special agreement on Annexation Nos. 107, 109, 111, 121, 122, and 123 of tile City of Tustin is necessary only because of the need to expedite the completion of these annexations and because a formula agreement establishing a tax allocation formula for all annexations has not yet been achieved by the local Orange County Division League of California Cities and the County of Orange; and, WHEP~AS, any future agreement establishing a formula for tax allocation should be co~:ditioned on the understanding that the hereinafter described agreement co!,cerning these specific properties described as Annexation Nos. 107, t09, ].]1, ]21, and 123 of the City of Tustin shall be reconsidered when an overall tax allocation formula has been agreed upon; and, WHEREAS, the Joard of Supervisors, on the motion of Supervisor Riley, on October 8, 1980 adopted a Resolution agreeing to the same terms and conditions as herein stated, NOW THEREFORE, BE IT RESOLVED that the City Council agrees that no property'tax redistribution is necessary at this time as a condition to the completion of Annexation Nos. 107, 109, 111, 121, 122, and 123. BE IT FURTHER RESOLVED ~hat the City Council of the City of Tustin hereby requests that this agreement be re-evaluated at suck time as the Cities and the County of Orange reach an agreement on an appropriate tax allocation formula applicable to all future annexations in the County. BE IT FURTHER RESOLVED that the Executive Officer be petitioned to process and complete the above annexations as being hereby in satisfaction of the requirements of Section 99(b) of the Revenue and Taxation Code. WYNN, CITY CLERK 1 2 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 3O 31 32 RESOLUTION NO. 80-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AGREEING TO THE EXCHANGE OF PROPERTY TAX REVENUES FOR ANNEXATIONS NOS. 97, 110, 114, 115, 116, 117, 118, 119, and 120 TO THE CITY OF TUSTIN WHEREAS, certain annexations have been approved by the Local Agency Formation Commission and the City Council of the City of Tustin, known as Annexations Nos. 97, 110, 114, 115, 116, 117, 118, 119 and 120 with cert- ificates of completion filed by the Executive Officer of the Local Agency Formation Commaission; and WHEREAS, pursuant to Section 99(b) of the Revenue and Taxation Code said jurisdictional changes shall not become effective until the city and county agrees, by resolution, to accept the negotiated exchange of property tax revenues; and WHEREAS, the interest of the city, county, property owners, and residents can best be served by the immediate deter- mination of the jurisdictional changes whereby municipal services may be provided to subject areas; and WHEREAS, the City Council determines that the completion of st~bject annexations justifies the waiver of the pro- perty tax revenue as a condition of these annexations during the first year of the jurisdictional change; and WHEREAS, there is an effort underway by the Orange County Divis[on League of California Cities and the County of Orange to develop an equitable solution to the problem of reallocation of property tax revenues which allocation formula shall thenceforth be applicable for all future annexations in the County; and WHEREAS, a special agreement for the exchange of property tax revenues is necessary to expediate the completion of these annexations prior to the establishment of a tax allocation formula for all annexations by the Orange County Division, League of California Cities and the County of Orange; and WHEREAS, any future agreement establishing an overall formula for tax allocation should be conditioned upon the reconsideration of the tax allocation for the properties subject to this agreement; NOW THEREFORE, BE IT RESOLVED that the City Council agrees that no property tax redistribution is necessary at this time as a condition to the completion of Annexation Nos. 97, 110, 114, 115, 116, 117, 118, 119 and 120 to the City of Tustin. BE IT FURTHER RESOLVED that the City Council of Ge City of Tustin hereby requests that this agreement be re-evaluated at such time as the Cities and the County of Orange reach an agreement on an appropriate tax allocation formula applicable to all future annexations in the County. 1 5 6 ? 8 9 10 11 15 14 15 16 17 18 19 20 $0 51 BE IT FURTHER RESOLVED that the acceptance of this agreement shall be deemed to satisfy the requirements of Section 99 (b) of the Revenue and Taxation Code whereby the subject annexation shall be complete. City of Tustin, and WHEREAS, pursuant to Section 99(b) of the Revenue and Taxation Code the proposed annexation may not be considered by the Local Agency Formation Commission until such time as the city and county agree to the exchange of property tax revenue from said area, and WHEREAS, it is in the best interests of the city, county, and property owner to complete the annexations as soon as possible; and, WHEREAS, the City Council feels, in this instance, that an exchange of property tax revenue as a condition of this annexation is not necessary during the first year of the jurisdictional change; and, WHEREAS, there is an effort underway by the Orange County Division League of California Cities and the County of Orange to develop an equitable solution to the problem of reallocation of property tax revenues which allocation formula shall thenceforth be applicable for all future.annexations in the County; and WHEREAS, this special agreement on Annexation No. 124 to the City of Tustin is necessary only because of the need to expedite the completion of these annexations and because a formula agreement establishing a tax allocation formula for all annexations has not yet been achieved ~y the local Orange County Division League of California Cities and the County of Orange; and, WHEREAS, any future agreement establishing a formula for tax allocation should be conditioned on the understanding that the hereinafter described agreement concerning the specific property described as Annexation No. 124 to the City of Tustin shall be reconsidered when an overall tax allocation formula has been agreed upon, NOW THEREFORE, BE IT RESOLVED that the City Council agrees that no property tax redistribution is necessary at this time as a condition to the completion of Annexation' No. 124. WYNN, CITY CLERK RKF:mac 10-9-80 1 2 4 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 3O 31 RESOLUTION NO. 80-109 A Resolution of the City Council, City of Tustin, California REQUESTING THE COMMENCEMENT OF PROCEEDINGS FOR THE REORGANIZATION OF CERTAIN TERRITORY FO~4ING THE COMMON SPHERE OF INFLUENCE AND BOUNDARY LINES BETWEEN THE CITY OF TUSTIN AND THE CITY OF IRVINE WHEREAS, the City Councils of Tustin and Irvine and the affected property owners have reached agreement as to the present and ultimate boundaries of said cities; and, WHEREAS, the City of Tustin has consented to be the lead agency in the processing of a reorganization consisting of annexation of unincorporated area and the transfer of jurisdiction of territory within the existing incorporated limits of the cities of Tustin and Irvine; and, WHEREAS, the subject proposal is made for the purpose of establishing identifiable boundaries, mutuality of interests, and enabling the planning and development of subject areas in accordance with mutually acceptable goals and objectives; and WHEREAS, the subject proposal is made in accordance with Phase II and Phase III of a project as previously addressed in City of TustinEIR78-3, as certified by the City Council of Tustin and approved by the Local Agency Formation Commission, and as further addressed by 79-EIR-0040 of the City of Irvine, N~9 THEREFOHE BE IT RESOLVED by the city Council, City of Tustin, Ca]ifor~]ia: That the City Couqcil hereby adopts Resolutions of application for reorqanization proceedings of said territory pursuant to Chapter 2, Art~le 4, Section 35140(a) of the Municipal Organization Act of 1977. That said reorganization shall consist of an amendment to the Sphere of Influence, "Santa Ana Freeway-Myford Road Annexation No. 124 to the City of Tustin", "New Myford-Old Myford Transfer of Territory from the City of Irvine to the City of Tustin Deannexation No. 125", and the "M.C.A.S. Transfer of Territory from the City of Tustin to the City of Irvine Deannexation No. 126". That subject area is more fully defined by the map and legal descriptions appendixed to the justification of the proposal. That the Local Agency Formation Commission is hereby petitioned to conduct a hearing and make a determination pursuant to Chapter 2, Article 5, Section 35150 of the Municipal Organization Act of 1977, designating the City of Tustin as the conducting authority to initiate annexation proceedings.
