EMERGENCY ACCESS EASEMENT - TRACT 10281 (TUSTIN COMMONS)
Mt. Pert has requested by'letter (copy attached) that the City quitclaim
its interest and rights to the 15 foot wide emergency access easement
on Lot 2 of Tract No. 10281. This easement is shown in green on the
attached sketch and extends from Second Street to the southerly boundary
of Lot 1 of Tract No. 10281.
This emergency access easement was required initially when Lot No. 1
was being developed as condominiums with underground parking, so as
to provide emergency access to the westerly portion of the development
without utilizing the underground parking structure. The design concept
of the developemnt has now been revised. The development is still a
condominium project, but there is no underground parking. Access and
adequate turn around area-is now available on the ground surface to
service the entire development.
The Community Development Department, Tustin Police Department and
the Orange County Fire Marshall have all reviewed this request and
concur with the city's quitclaim of the easement.
Recommendation:
It is recommended that theTustin City Council at their meeting of October
6, 1980 authorize the Mayor to execute the attached Quitclaim deed
relinquishing the city's interest and claim to the 15 foot wide emergency
access easement along the westerly side of Lot 2 of Tract No. 10281.
