BACKGROUND
The Nisson Road-"B" Street area will be the only County island remaining within
Tusfin's Sphere o¢ Influence south of the Santa Ana Freeway.
The majority of the residents of the area have expressed a desire not to be annexed,
although several property owners and tenants desire fo be within the incorporated
limits of the city.
The Board of Supervisor's has indicated a desire fo transfer jurisdiction fo the
cities' island areas that are uneconomical for County services. The Board
recognizes that protests can be expected, but fhaf there is no valid basis for the
protests.
The City Council has indicated that there is no desire on the part of the City to
annex areas against the will of the area residents.
DISCUSSION
To enable the Board of Supervisors fo order the annexation of the area fo the
city o¢ Tusfin, the application must be initiated by the City Council. There is no
direct benefit to the City resulting from the annexation and a liability will be
created for $250,000 in public improvements,
Indirect benefits will accrue in the reduction of service costs to the area and to
the benefit of the totality of county residents. Additional indirect benefits will
accrue fo the City in the exercise of jurisdiction and control of a blighted area
with substandard public improvements. Since the character of the community is
determined by county islands as well as city developments, if would be in the
City's best interest fo exercise jurisdiction over the area.
It is suggested that the City file an application with the Local Agency Formation
Commission on behalf of the County and not as an active proponent of the ann~ka-
lion. It would.then be the responsibility of the Local Agency Formation Com-
mission and the Board of Supervisors to determine if the area should be within the
city limits and the City would indicate acceptance of the area, if so ordered
by the Board of Supervisors. A letter fo this effect would be mailed fo the
property owners and residents of the area. (If is noted that unless an agreement
is soon reached with the Board of Supervisors pertaining fo the distribution of
property tax revenues, the authority for island annexations will expire before the
annexation can be processed.)

A RESOLUTION OF THE CITY COUNCIL, CITY OF TUSTIN,
REQUESTING THE RECO/V~NCEMENT OF PROCEEDINGS FOR
THE ANNEXATION OF CERTAIN INHABITED TERRITORY DESIG-
NATED AS NISSON-"B" STREET ANNEXATION NO. 1II IRE-
VISEDI TO THE CITY OF TUSTIN.
WHEREAS, the County island area known as Nisson Road-"8" Street area will
be the only unincorporated area within Tustin's Sphere of Influence
southerly of the Santa Ana Freeway, and
WHEREAS, the Board of Supervisors has indicated a desire to transfer.juris-
diction fo a city of a county island when the transfer would result in
economies and efficiencies of governmental services due fo the remoteness
of subject areas from county service areas and facilities; and
WHEREAS, fha City of Tustin agrees to extend the full range of municipal
services to the properties within said unincorporated island; and
WHEREAS, the territory was determined fo be categorically exempt from the
requirements of the California Environmental Qualify Act for environmental
impact review by notice filed on January 4, 1978; and
W~EREAS, fha subject area is within Tusfin's Sphere of Influence as defer-
mined by the Local Agency Formation Commission;
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, City of Tustin:
That the Local Agency Formation Commission is requested in the interest
3~ the economy and e~ficiency of governmental services, fo recommence
annexation proceedings in connection with said inhabited territory
in accordance with the Municipal Organization Act of 1977 govern;rig
unincorporated islands.
That said unincorporated territory be, and hereby is, designated as
the "Nisson-"B" Street Annexa[ion No. 111 (Revised)" to the City of
Tustin, as more ~ully described by the map and legal description
accompanying the Justification of Proposal.
That fha proposed annexation is made pursuant fo Sections 35013 and
35150(fl o¢ the Municipal Organization Act of 1977.
That the subject area is a totally developed urbanized area of ~ 31
acres consisting of apartment houses~ mobile home park, and single
family residences.
5. That the justification for the proposed change of organization is to
provide full municipal services to an urbanized County island area
that is remote from County service facilities and thereby increase the
economy and eff[ciency of urban services.
6. That the Local Agency Formation Corfrnission is hereby pefifloned to
determine pursuant fo Section 35150(f) of the ~unicipal Organization
Act of !977 that the proposed area:
a. Does not exceed lO0 acres in area
b. That subject area constitutes the entire island
c. That subject area is totally surrounded by fha city of Tusfin
d. That subject area is not prime agricultural land

That subject area is fully developed.
That subject area will benefit from such annexation, and
following notice and hearing, authorize the Board o¢ Supervisors
of Orange County fo order the annexation of the subject territory
without an election.
7. That the City Clerk shall certify the adoption of the Resolution.'
PASSED AND ADOPTED at a regular meeting of the City Council, City of
Tusfin, held on the 6th day of October, 1980.
