BACKGROUND
The Mayor and staff met with the Board of Directors of Walnut Park Homeowner's
Association on May 15, 1980 to answer questions pertaining fo annexation of their
area fo the city, since several residents of the area had made a request to be
annexed.
The Board of Directors endorsed the annexation proposal and decided to poll the
attitude of the members of the Association. The response was nearly 2 fo 1 in
favor of the annexation with an equal number of residents having no preference.
The final tabulation o¢ the survey was presented fo the Board for their consider-
afion on September 10 and is not available af the time of preparation of this
report.
A letter has been mailed fo the residents and property owners of this area, indi-
cating the Council's intent fo proceed with an annexation request and soliciting
opinions.
In accordance with the direction of the City Council, on September 2 and the de-
sire of the Board of Supervisors expressed during the hearing on annexation
a resolution commencing proceedings has been prepared for Council consideration
within the time limits of Section 35014 of the Municipal Organization Act, fo
enable completion prior fo January 1, 1981.
RECOMMENDED ACTION
It is recorrrnended that Resoltuion No. 80-95 be passed and adopted.

A RESOLUTION OF THE CITY COUNCIL, CITY OF TUSTIN,
CALIFORNIA, REQUESTING THE RECO~NCEf~NT OF PRO-
CEEDINGS FOR THE ANNEXATION OF CERTAIN INHABITED
TERRITORY DESIGNATED AS SYCAMORE-WALNUT-MITCHELL
ANNEXATION NO. 109 IREVISED) TO THE CITY OF TUSTIN.
WHEREAS, the City Council of Tustin on behalf of residents with a certain
inhabited area constituting an 84-acre unincorporated County island lo-
cated east of Newport Avenue; west of Red Hill Avenue; south of Mitchell
Avenue; north and south of Walnut Avenue; north and south of Sycamore
Avenue in the south Tusfin area consents fo the annexation of said prop-
erties into the city; and
WHEREAS, the proposed annexation-was determined fo be categorically
exempt from fha requirements of the California Environmental Quality Act
for environmental impact review by notice filed on January 4, 1978; and
WHEREAS, fha City of Tustin is willing fO extend fha full range of muni-
cipal services fo the properties within said unincorporated island; and
WHEREAS, the Local Agency Formation Commisson on February 22,1978, found
that the proposed annexation was within Tustin's Sphere of Influence and
met all of the criteria required by Section 35150(f) of the Municipal
Organization Act;
WHEREAS, the Board of Supervisors denied the proposed annexation in 1978
due to the protests of residents fo the additional faxes fhaf would re-
sult from annexation to the city of Tusfin; and
WHEREAS, Proposition 13 has eliminated the basis of protest by establish-
ing maximum tax rates irrespective ofpolifical jurisdiction;
NON, THEREFORE, BE IT RESOLVED by the City Council, City of Tustin:
That fha City of Tustin requests the recommencement of annexation
proceedings in connection with said inhabited territory in accord-
ance with the Municipal Organization Act of 1977 governin9 unin-
corporated islands.
That said unincorporated territory be, and hereby is, designated as
fha "Sycamore-Walnut-Mitchell Annexation No. 109 (Revised) fo fha
city of Tusfin and is shown on Exhibit "A" attached hereto and in-
corporated herein by this reference, and as legally described in
Exhibit "B" attached hereto and incorporated herein by this refer-
ence.
3. That the proposed annexation is made pursuant fo Sections 35013 and
35150(f) of the Municipal Organization Act of 1977.

4. That the subject area is a totally developed urbanized area of _ 84
acres consisfin9 of apartments, condominiums, single family and
fourplex units. The area is totally surrounded by the incorporated
limits of the city of Tusfin.

That the Local Agency Formation Commission is hereby petitioned fo

b. That subject area constitutes the entire island.
c. That subject area is totally surrounded by [he city o¢ Tustin.
d. That subject area is not prime agricultural land.
e. That subject area is fully developed,
That subject area will benefit from such annexation, and
following notice and hearing, authorize the Board o¢ Super-
visors of Orange County to order the annexation of the subject
territory without an election.
7. That the City Clerk shall certify the adoption of the Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council, City
Tustln, California, held on the 15th day of September, 1980.

Beginning at the point of intersection of the centerlines of Newport
Avenue and Sycan~re Avenue as shown on a n~p of Tract No. 4527, recorded
in Book 163, pages 38 and 39 of Miscellaneous Maps, Records of Orange
County, California, said point also being the northerly ~orner of lot
64, block ll of Irvine's Subdivision as per map recorded in Book l,
