Fleagle ¢~ Irvine Boulevard/Dean Street Annexation No. 121 BACKGROUND Several residents of the area southerly of Irvine Boulevard and easterly and westerly of Dean Street requested the assistance of Councilman Edgar in having their area annexed fo the city. They have circulated petitions and provided the residents of the area with an information brochure. The petitions represent approximately 10% of the registered voters within the area. The area would be processed as an inhabited annexation with the City Council as the conducting authority for a protest hearing. The ¢ify Engineer has prepared a map and legal description of the property and the annexation application would be initiated by the City of Tustln on the basis . of the petition of the residents of the area. A Resolution has been prepared to this effect. Answer: To have our property annexed to the City of Tustin. A~swer: Question: Why ? Because there is so'much to gain and nothing to lose. What would we gain by annexation? Police service from the City of Tustin. Hopefully, you will never need it. If you do, you are less than a mile from the police station with four patrol cars serving a concentrated area. A higher level of service and quicker response time can be provided than tha~ of the sheriff's patrol services, which cover a larger area with fewer units. Refuse service at no charge with a resultant savings of $37.80 per year· 3. .Weekly street sweeping at no cost. Participation in recreation programs and the use of public buildings at reduced rates for City residents. An opportunity to vote and have a voice in the affairs of the community. In Tustin there are five council persons, elected at large, serving 30,000 inhabitants. They must listen to what the residents say if they wish to remain the people's representatives. In the County there are five supervisors representing 1.85 million residents and one supervisor representing 370,000 people. You would have a greater voice in the affairs of the City than you would in the government of the county or any other larger unit of government, and the Tustin area is where we live. o The fire services are the same that you now receive. The differ- ence is that the City contracts for fire services from the County, while County residents pay for fire service in the Fire Protection District. -2- Question: What will it cost me if my property is annexed to the City? Answer: Since Proposition 13, the tax rate is limited to 1% of the full cash value of~the property based upon the 1975-76 tax bill. It doesn't make any difference whether you are in the City of County, the tax rate is the same. There are additional City tax rates for the Parks and C~vic Center. bond~which are currently less than SO. lO per $100 assessed value.' For a residence with a 1975-76 assessed value of.$20,000, this additional tax would be less than $20 per year. With a savings of S37.80 per year in refuse charges, you will be reducing your total housing costs by being a City resident. Question: There must be a catch to this. Why would the City approve this annexation and Qhat do I give up in exchange? Answer: The Council is not promoting this annexation, but they have publicly stated that, in the interest of community identity and economy of government services, they will accept annexations of contiguous areas when the majority of the residents request it. We don't know of any thing you have to lose by the annexation, and the gains, are to your advantage. WHEREAS, certain property owners and registered voters within Tusfin's Sphere of Influence have petitioned the City Council to commence prO- ceedings for fha annexation of their area to fha city of Tustin; and WHEREAS, it is the policy of fha City Council fo annex into ifs boundaries and to provide municipal services fo those contiguous properties within ifs Sphere of Influence; and WHEREAS,the City Council has determined fhaf the proposed annexation of the fully developed area in a Class 19 Categorical Exemption pursuant to Section 15119 of the Guidelines for Implementation of the California Environmental Qualify Act of 1970; NOW, THEREFORE, BE IT RESOLVED by the City Council, City of Tusfin, California: That the City Council hereby adopts a Resolution of Application for annexation proceedings of said inhabited territory pursuant fo Chapter 2, Article 4, Section 55140(a) of the Municipal Or- ganization Act ct 1977. II. That said unincorporated territory be, ana is hereby designated as the J'lrvine Boulevard-Dean Street Annexation No. 121" to the City of Tusfin and is as shown on Exhibit "A" attached hereto and incorporated herein by this reference, and as legally des- cribed in Exhibit'"B" attached hereto and incorporated herein by this reference. II1. That fha subject area is a totally developed urbanized area of 55 acres containing 218 single family residences. IV. That the justification for the proposed change o¢ organization is to provide full municipal services to a contiguous urbanized county area that is identified with the city of Tustin by postal address and mutuality of community interests. That municipal services shall be provided to subject area to the same extent as provided for properties within the existing juris- diction of fha city in accordance with fha service plan on file with the Local Agency Fo~mation Commission and to be financed from the ~isfribufion of property fax revenues as agreed to by the Orange County Board of Supervisors and fha City Council and such other regular and normal revenues accruing fo the City. VI. That the Local Agency Fromation Commission is hereby petitioned fo conduct a hearing and make a determination pursuant fo Chapter 2, Article 5, Section 35150 of the Municipal Organization Act of 1977, designating the City of Tustin as the conducting authority fo initiate annexation proceedings. VII. That required filing fees payable fo the Local Agency Formation Commission are hereby authorized. VIII. That the City Clerk shall certify the adoption of the Resolution.
