LAVOIE, DEPUTY CITY ATTORNEY ORDINANCE CONCERNING ICE CREAM VENDORS This office has reviewed your Tustin Inter-Com dated July 24, 19g0, relating to the proposed ordinance concerning ice cream vendors. Pursuant to your con~nents therein, we have revised the proposed ordinance to provide that applicants for a license as an ice cream vendor shall provide the name and address of all owners~ officers and of all other persons having an interest in the busi- ness, to state that the providing of false or misleading informa- tion on the application shall be a misdemeanor and grounds for denial or revocation of an ice cream vendor's permit, and to enumerate violations of Penal Code Section 290, Health and Safety Code Section 11590, or of any misdemeanor which children under the age of 14 are the primary corn-non victim as prima facie grounds for denial of a permit. Please review the revised proposed amendment and advise this office if you have any further comments. cc: Dan Blankenship (w/encl.} RLL:Iw:D:g/5/g0 1 3 4 5 6 ? 8 9 10 11 12 1S 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 3O 31 3.2 ORDINANCE NO. 833 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING PART 4 OF CHAPTER 4 OF ARTICLE 3 OF THE TUSTIN CITY CODE PERTAINING TO ICE CREAM VENDORS. The City Council of the City of Tustin, California does ordain as follows: Section 1: Section 3441 of the Tustin City Code is amended to read as follows: "3441. APPLICATION Any person desiring a vendors permit shall make application in the form prescribed by the License and Permit Board. Applications shall include the following information: (1) The name and address of the applicant; (2) The name and address of all o%~ers and officers of the applicant's business and of any other persons having an interest therein; (3) A description of each vehicle proposed to be operated by the applicant; (4) The name and address of the registered owner of each vehicle proposed to be operated; (5) Evidence of insurance in a form satisfactory to the Lfcense and Permit Board; (6) Evidence of compliance with the provisions of Part 1 of Chapter.. 1 of Title 4 of the Tus%in City Code pertaining to food and food establishments; (7) The name, address, birthdate, city and state of birth, physical description and social security num- ber or vehicle operator's license number of each driver proposed to operate any vehicle to be licensed; (8) The name, address, birthdate, city and state of birth, physical description, and social security number or vehicle operator's license number of each 1 2 6 7 8 10 11 12 15 16 18 2O 21 22 23 24 25 26 27 28 2~ 30 3.2 person, other than a-driver, proposed to ride in, or upon, a vehicle to be licensed; and (9) Such other information as may be required by the License and Permit Board. .Any person providing false or misleading information shall be guilty of a misdemeanor. The provision of false or misleading information shall be grounds for denial or revocation of any permit required by this Chapter." Section 2. Section 3442 of the Tustin City Code is amended to read as follows: "3442. INVESTIGATION OF DRIVERS AND VEHICLES All persons proposed to drive or operate or drive in, on or upon any vehicle to be licensed pursuant to this part shall be photographed and fingerprinted at the police department. The police department shall make a record check of each such person and shall make a report thereon to the License and Permit Board~ All vehicles proposed to be licensed shall be inspected for safety at the police department. A person shall be prima facie disqualified to drive or operate or ride in, on or upon any vehicle licensed pursuant to this part if he has been convicted of a felony or of any offense enumerated in Section 290 of the California Penal Code or in Section 11590 of the Health and Safety Code or of any misdemeanor in which children under the age of 14 are the primary or co~Lu~on victim of such crimes. The License and Permit Board may adopt such requirements and standards for qualification to drive or operate or to ride upon any vehicle licensed pursuant to this part as the board deems reasonable."
