SUBJ£CT: SEVENTEENTH STREET TRAFFIC SIGNAL AND STREET WIDENING IMPROVEMENTS
This project provides for the modification of Traffic Signal improvements
at Seventeenth Street (north and south) and street widening improvements
on the south side of Seventeenth Street between the Costa Mesa Freeway
and Yorba Street (south). The Traffic Signal modification project is a
Federal Aid Urban (~.A.U.) cooperative pr6ject wherein 86% is financed
by F.A.U. funds and 14% by city funds.
There ~s presently $154,000.00 budgeted for this work. The Engineer's
estimate for the project is, $t61,500.00.
Staff is requesting this authorization prior to the final Caltrans and
F.A.U. approval so that we may advertise prior to August 31, 1980. This
will allow the city to process this contract without having to conform
to new Minori_ty Business Enterprise ('M~E) Program which becomes effective
on September l~t.
Following is a tentative schedule for the project depending on Caltrans
and F.A.U. approvals prior to August 31st~

The attached Resolution is for the City Counci. l'~s approval of plans and
specifications for the Seventeenth Street Traffic Signal and street
widening improvements between the Costa Mesa (Newport) Freeway and Yorba
Street (north) and directing the City Clerk to advertise for bids.
Recommendati. on:
It is recommended that the Tustin City Council at their meeting of August
18,1980 pass and adopt the attached Resolution approving plans and specifications
for said Traffic Signal modilfi.cations and street widening improvements along
Seventeenth Street between the Costa Mesa (]Newport) Freeway and Yorba Street
(]north.), subject to final project approval by Caltrans and F.A.U.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIOHS
FOR SEVENTEENTH STREET TRAFFIC SIGNAL IMPROVEMENTS FAU
PROJECT L-056(1) AND STREET WIDENING IMPROVEMENTS (NON
FAU PARTICIPATION) AND DIRECTING THE CITY CLERK TO
ADVERTISE FOR BIDS.
WHEREAS, it is the intention of the City Council of the City of Tustin,
California, to construction traffic signal improvements and street widenin9
improvements designated .as Seventeenth Street Traffic signal-Im?ro~ements
FAU Project L-056(1) and Street Widening Improvements (non FAU participation),
WHEREAS,"t'he City 'Engineer has p~esented plans and]specificat~on~ for
the ~onstruction of said Work,
NOW,-THEREFORE, BE iT RESOLVED that the plans and specifications pre-
sented by the City Engineer be and are hereby approved as the plans and speci-
fications for the construction of Seventeenth Street Traffic Signal Improve-
merits FAU Project L-056(1) and Street Widening Improvements (non FAU partici-
pation).
BE IT FURTHER RESOLVED that the City Clerk is hereby authori'zed and
directed to advertise as required by law for the receipt of sealed bids or
proposals for the doing of the work specified in the aforesaid plans and
specifications which said advertisement shall be substantially in the follow-
inD works and figures, to-wit:
"NOTICE TO CONTRACTORS"
SEALED PROPOSALS will be received at the office of the City Clerk,
Tustin City Hall, 300 Centennial WaN, Tustin, California, until ll:O0 AM on
the23RD day of September, 19BO , at which time they will be
publicly opened and read, for performing work as follows:
Traffic Signals at the intersections of Seventeenth Street with Yorba
Street(South) - Carroll Way, Yorba Street(North) - Enderle Center
Drive, Northbound off-ramp(ORA-55)
Street Widen_i~n~_ Imp_rovements (non FAU participation) between ORA-55
Costa Mesa Freeway Northbound off-ramp and Yorba Street(South)
Compensation Insurance. Pursuant to the requirements of Section 1860 of
the Labor Code ~-pter 1000, Statutes of 1965), Contractor shall take out
and maintain, during the life of this contract, workmen's compensation in-
surance for all his employees employed at the site of improvement, and if
any work is sublet, Contractor shall require subcontractor similarly to
provide workmen's compensation insurance for all of the latter's employees.
Contractor indemnifies City for any damage resulting to it from failure of
either Contractor or any subcontractor to take out or maintain such insur-
ance. ~
P~blic Liabili$~_and Property Da?_a~e~s. Contractor shall take out and
maintain, during the life of this contract, such public liability and prop-
erty damage insurance as shall protect the City of Tustin, its elective and

appointive boards, officers, agents and employees, Contractor and any sub-
contractor performing work covered by this contract from claims or damages
for personal injury, including death, as well as subcontractor's operations
under this contract, whether such operations be by Contractor or by any sub-
contractor, or by anyone directly or indirectly employed by either Contractor
or any sub~ontractor. The amounts of said insurance shall be as follows:
Public Liability Insurance - In an amount not less than $250,000
for injuries, including, subject to the same limit for each person,
in an amount not less than $500,000 on account of any one occur-
rence.
Property Damage Insurance - In an amount of not less than $100,000
for damage to the property of each person on account of any one
occurrence.
Contractor shall furnish the City, satisfactory proof of carriage of the in-
surance required, and adequate legal assurance that each carrier will give
the City at least ten days prior notice of the cancellation of any policy
during the effective period of this contract.
Bids are required for the entire work described herein:

Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the
City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, 92680,
upon payment of the following amounts at the City Clerk's office, which
amounts shall not be'refundable.
Complete Set - Includes specifications and plans. Total cost $10.00
non-refundable.
Plans and specifications will only be mailed out upon payment of a mail-
ing and handling fee in addition to that stated above of $5.00 for a com-
plete set.

In conformance with Section 37931 of the Government Code, all bids
shall be presented under sealed cover on the proposal form provided and
accompanied by one of the 'following forms of bidder's security:
a. Cash
b. Cashier's check made payable to the City of Tustin.
c. Certified check made payable to the City of Tustin.
d. Bidder's bond executed by an accredited surety insurer, made
payable to the City of Tustin.
The security shall be in an amount equal to at least ten percent (10%)
of the amount of the bid. A bid shall not be considered unless one of the
forms of bidder's security is enclosed therewith.
A Surety Bond for payment of labor and materials will be required in
the amount of one hundred percent (100%) of the estimated total contract
price and a Faithful Performance Bond in zne amount of one qundred percent
(t00%) of the estimated total contract price in the form attached to the
contract documents. Said bonds shall be issued by a company having a
rating of A+AA or better.
City of Tustin reserves the right to reject any or all bids and/or
waive any informality on a bid. No bidder may withdraw his bid for a
period of thirty (30) days after the date set For the opening thereof.
The contract will be awarded to the lowest qualified bidder.
Provisions of the State Contract Act are not applicable, and bidders
will not be required to be prequalified.
All work to be done under the direct supervision of the City Engineer,
City of Tustin.
